Bhatti, Advocate, for the respondent.\n\n\n\nRajesh Bindal, J.\n<\/pre>\n<p id=\"p_1\">              The petitioner through the present petition has challenged the<br \/>\norder of his conviction passed by the Chief Judicial Magistrate, Gurdaspur,<br \/>\nunder <a href=\"\/doc\/1823824\/\" id=\"a_1\">Section 138<\/a> of the Negotiable Instruments Act, 1881, which was<br \/>\nupheld by the Additional Sessions Judge, Gurdaspur. He has been sentenced<br \/>\nto undergo rigorous imprisonment for a period of six months and to pay fine<br \/>\nof Rs. 500\/-. In default of payment of fine, he is to undergo further<br \/>\nimprisonment for one month.\n<\/p>\n<p id=\"p_1\">              The complaint in the present case was filed by the respondent<br \/>\non account of dishonour of cheque bearing no. 397842 dated 17.4.2006 for<br \/>\nRs. 60,000\/-, issued by the petitioner in favour of the respondent company<br \/>\ndrawn on Oriental Bank of Commerce, Dinanagar.\n<\/p>\n<p id=\"p_2\">              Learned counsel for the petitioner submitted that after<br \/>\nconviction of the petitioner in the present case, the dispute between the<br \/>\nparties has been settled by way of compromise and in terms thereof, the<br \/>\nentire amount due against the petitioner of the cheque, in question, in<br \/>\ncomplaint has already been paid, and accordingly, the offence may be<br \/>\ncompounded and the conviction of the petitioner be set aside.\n<\/p>\n<p id=\"p_3\">              This fact is not disputed by the learned counsel appearing for<br \/>\nthe respondent, rather he very fairly submitted that he has no objection in<br \/>\ncase the conviction of the petitioner is set aside. The respondent, who was<br \/>\npresent in court in person, had admitted the factual position. The respondent<br \/>\nhas also made a statement to this effect in the court.\n<\/p>\n<p><span class=\"hidden_text\" id=\"span_1\">      Criminal Revision No. 2794 of 2009                           -2-<\/span><\/p>\n<p id=\"p_4\">             Once the parties have settled their dispute, in terms of the<br \/>\njudgment of Hon&#8217;ble the Supreme Court in <a href=\"\/doc\/1981864\/\" id=\"a_1\">Vinay Devanna Nayak v. Ryot<br \/>\nSeva Sahakari Bank Ltd<\/a>., 2007 (5) Law Herald (SC) 3843, the offence<br \/>\ncommitted by the petitioner for which he has been convicted, is<br \/>\ncompoundable. Relevant paras therefrom are extracted below:-\n<\/p>\n<blockquote id=\"blockquote_1\"><p>               &#8220;17.     As observed by this Court in <a href=\"\/doc\/979235\/\" id=\"a_2\">Electronic Trade &amp;<br \/>\n                        Technology Development Corporation Ltd. v.<br \/>\n                        Indian Technologists &amp; Engineers<\/a>, (1996) 2 SCC<br \/>\n                        739, the object of bringing <a href=\"\/doc\/1823824\/\" id=\"a_3\">Section 138<\/a> in the statute<br \/>\n                        book is to inculcate faith in the efficacy of banking<br \/>\n                        operations and credibility in transacting business on<br \/>\n                        negotiable instruments. The provision is intended to<br \/>\n                        prevent dishonesty on the part of the drawer of<br \/>\n                        negotiable instruments in issuing cheques without<br \/>\n                        sufficient funds or with a view to inducing the payee<br \/>\n                        or holder in due course to act upon it. It thus seeks to<br \/>\n                        promote the efficacy of bank operations and ensures<br \/>\n                        credibility in transacting business through cheques. In<br \/>\n                        such matters, therefore, normally componding of<br \/>\n                        offences should not be denied. Presumably, Parliament<br \/>\n                        also realised this aspect and inserted <a href=\"\/doc\/177946336\/\" id=\"a_4\">Section 147<\/a> by<br \/>\n                        the      Negotiable   Instruments     (Amendment    and<br \/>\n                        <a href=\"\/doc\/269107\/\" id=\"a_5\">Miscellaneous Provisions) Act<\/a>, 2002. (Act 55 of<br \/>\n                        2002). The said section reads thus:\n<\/p><\/blockquote>\n<blockquote id=\"blockquote_1\"><p>               S.147. Offences to be compoundable.- Notwithstanding<br \/>\n                        anything contained in the Code of Criminal Procedure,<br \/>\n                        1973 (2 of 1974), every offence punishable under this<br \/>\n                        Act shall be compoundable.\n<\/p><\/blockquote>\n<blockquote id=\"blockquote_2\"><p>               18.      Taking into consideration even the said provision<br \/>\n                        (<a href=\"\/doc\/269107\/\" id=\"a_6\">Section 147<\/a>) and the primary object underlying<br \/>\n                        <a href=\"\/doc\/269107\/\" id=\"a_7\">Section 138<\/a>, in our judgment, there is no reason to<br \/>\n                        refuse compromise between the parties. We, therefore,<br \/>\n                        dispose of the appeal on the basis of the settlement<br \/>\n                        arrived at between the appellant and the respondent.\n<\/p><\/blockquote>\n<blockquote id=\"blockquote_3\"><p>               19.      For the foregoing reasons the appeal deserves to be<br \/>\n<span class=\"hidden_text\" id=\"span_1\">       Criminal Revision No. 2794 of 2009                          -3-<\/span><\/p>\n<p>                         allowed and is accordingly allowed by holding that<br \/>\n                         since the matter has been compromised between the<br \/>\n                         parties and the amount of Rs. 45,000\/- has been paid<br \/>\n                         by the appellant towards full and final settlement to<br \/>\n                         the respondent-bank towards its dues, the appellant is<br \/>\n                         entitled to acquittal. The order of conviction and<br \/>\n                         sentence recorded by all courts is set aside and he is<br \/>\n                         acquitted of the charge levelled against him.&#8221;<\/p><\/blockquote>\n<p id=\"p_5\">              Hon&#8217;ble the Supreme Court in 2008 (2) Criminal Court Cases<br \/>\n233 (R.Rajeshwari v\/s H.N.Jagdish) opined that table appended to <a href=\"\/doc\/91933\/\" id=\"a_8\">Section<br \/>\n320<\/a> Cr.P.C. is not attracted for offences under the Act as <a href=\"\/doc\/269107\/\" id=\"a_9\">Section 147<\/a><br \/>\nthereof gives it overriding effect as the same provides for a non obstente<br \/>\nclause, Stricto Senso, however, the table appended to <a href=\"\/doc\/91933\/\" id=\"a_10\">Section 320<\/a> Cr.P.C. is<br \/>\nnot attracted as the provisions mentioned therein refer only to provisions of<br \/>\n<a href=\"\/doc\/1569253\/\" id=\"a_11\">IPC<\/a> and none other. It is further held that even a compromise arrived at by<br \/>\nthe advocate of the party, authorised to do so, is binding on the party<br \/>\nconcerned.\n<\/p>\n<p id=\"p_6\">              In view of settlement of dispute between the parties, the offence<br \/>\nand conviction is compoundable, accordingly, it is directed that the order of<br \/>\nconviction and sentence awarded by the Courts below in the case of the<br \/>\npetitioner is set aside and he is acquitted from all the charges levelled<br \/>\nagainst him.
