No. 2144 of 2008\n            -------------------------------------------------\n            Dated this the 6th day of June, 2008\n\n                               ORDER\n<\/pre>\n<p id=\"p_1\">      The petitioners, along with the co-accused, faced<\/p>\n<p>indictment in a prosecution for offences punishable, inter alia,<\/p>\n<p>under Secs.326 and 307 read with Sec.149 of the <a href=\"\/doc\/1569253\/\" id=\"a_1\">IPC<\/a>. Some of<\/p>\n<p>the co-accused, who were available, faced trial.             They have<\/p>\n<p>been found not guilty and acquitted. The petitioners were not<\/p>\n<p>available for trial.   The case against them has been split up.<\/p>\n<p>Reckoning the petitioners as absconding accused, coercive<\/p>\n<p>processes have been issued against the petitioners.               The<\/p>\n<p>petitioners apprehend imminent arrest.\n<\/p>\n<p id=\"p_1\">      2. The learned counsel for the petitioners, first of all,<\/p>\n<p>submits that the petitioners are entitled to get the proceedings<\/p>\n<p>against them quashed invoking the extraordinary inherent<\/p>\n<p>powers available to this Court under Sec.482 of the <a href=\"\/doc\/445276\/\" id=\"a_1\">Cr.P.C<\/a>.<\/p>\n<p><span class=\"hidden_text\" id=\"span_1\"> Crl.M.C. No. 2144 of 2008 -: 2 :-<\/span><\/p>\n<p id=\"p_2\">      3. What is the reason? According to the petitioners, out of<\/p>\n<p>the five injured persons, three have been examined in the trial<\/p>\n<p>against the co-accused and all the three have not supported the<\/p>\n<p>prosecution case.     According to them, they are not able to<\/p>\n<p>identify the accused.      In these circumstances, the learned<\/p>\n<p>counsel contends that continuance of the prosecution against the<\/p>\n<p>petitioners is unlikely to produce any useful result and would<\/p>\n<p>entail endless waste of time, energy and resources.     In these<\/p>\n<p>circumstances,     the petitioners are entitled to premature<\/p>\n<p>termination of the proceedings against them, submits the<\/p>\n<p>learned counsel for the petitioners.\n<\/p>\n<p id=\"p_3\">      4. I am unable to agree.    The decision in <a href=\"\/doc\/1958014\/\" id=\"a_2\">Moosa v. Sub<\/p>\n<p>Inspector of Police<\/a> (2006 (1) KLT 552) is authority for the<\/p>\n<p>proposition that the absconding co-accused is not entitled to<\/p>\n<p>claim premature termination of the proceedings on the basis of<\/p>\n<p>the materials adduced in evidence in the trial against the co-<\/p>\n<p>accused. More so, in this case where two of the injured persons<\/p>\n<p>have admittedly not been examined in the trial against the co-<\/p>\n<p>accused. It is not necessary to speculate whether three who were<\/p>\n<p>already examined and whether two who have not been examined<\/p>\n<p>shall support the case of the prosecution in the trial which is to<\/p>\n<p>be held against. The petitioners herein, in these circumstances,<\/p>\n<p><span class=\"hidden_text\" id=\"span_1\"> Crl.M.C. No. 2144 of 2008 -: 3 :-<\/span><\/p>\n<p>prayed for quashing of the proceedings against them.<\/p>\n<p id=\"p_4\">      5. The learned counsel for the petitioners submits that the<\/p>\n<p>petitioners&#8217; absence earlier was not wilful or deliberate.    The<\/p>\n<p>proceeding was initiated as early as in 1994, it is seen.     The<\/p>\n<p>learned counsel for the petitioners submits that the petitioners<\/p>\n<p>are willing to surrender before the learned Magistrate and seek<\/p>\n<p>regular bail.      But the petitioners apprehend that their<\/p>\n<p>applications for regular bail may not be considered by the<\/p>\n<p>learned Magistrate on merits, in accordance with law and<\/p>\n<p>expeditiously.\n<\/p>\n<p id=\"p_5\">       6.   It is for the petitioners to appear before the learned<\/p>\n<p>Magistrate    and    explain   to  the   learned  Magistrate   the<\/p>\n<p>circumstances under which they could not earlier appear before<\/p>\n<p>the learned Magistrate. I have no reason to assume that the<\/p>\n<p>learned   Magistrate     would   not   consider  the   petitioners&#8217;<\/p>\n<p>applications for regular bail on merits, in accordance with law<\/p>\n<p>and expeditiously.     No special or specific directions appear to<\/p>\n<p>be necessary. Every court must do the same. Sufficient general<\/p>\n<p>directions on this aspect have already been issued in the decision<\/p>\n<p>reported in Alice George v. Deputy Superintendent of Police<\/p>\n<p>(2003 (1) KLT 339).\n<\/p>\n<p id=\"p_6\">      7.   In the result, this Crl.M.C. is dismissed; but with the<\/p>\n<p><span class=\"hidden_text\" id=\"span_2\">Crl.M.C. No. 2144 of 2008 -: 4 :-<\/span><\/p>\n<p>observation that if the petitioners surrender before the learned<\/p>\n<p>Magistrate and seek bail, after giving sufficient prior notice to<\/p>\n<p>the Prosecutor in charge of the case, the learned Magistrate<\/p>\n<p>must proceed to pass appropriate orders on merits and<\/p>\n<p>expeditiously &#8211; on the date of surrender itself.<\/p>\n<p id=\"p_7\">                                                  Sd\/-\n<\/p>\n<p id=\"p_8\">\n                                       (R.
