SANKARAN, J.\n                     ---------------------------\n                      B.A. No.1340 of 2010\n                 ------------------------------------\n               Dated this the 22ndday of March, 2010\n\n                             O R D E R\n<\/pre>\n<p id=\"p_1\">      This is an application for anticipatory bail under <a href=\"\/doc\/1783708\/\" id=\"a_1\">Section 438<\/a><\/p>\n<p>of the Code of Criminal Procedure. The petitioners are accused<\/p>\n<p>Nos.1 and 2 in Crime No.36\/2010 of Perumpetty Police Station,<\/p>\n<p>Pathanamthitta.\n<\/p>\n<p id=\"p_1\">      2.    The offences alleged against the petitioners are under<\/p>\n<p><a href=\"\/doc\/770961\/\" id=\"a_1\">Sections 323<\/a>, <a href=\"\/doc\/267625\/\" id=\"a_2\">324<\/a> and <a href=\"\/doc\/1264755\/\" id=\"a_3\">326<\/a> read with <a href=\"\/doc\/37788\/\" id=\"a_4\">Section 34<\/a> of the Indian<\/p>\n<p>Penal Code.\n<\/p>\n<p id=\"p_2\">      3.    The prosecution case is that on 14\/2\/2010, the<\/p>\n<p>petitioners, father and son, attacked the de facto complainant<\/p>\n<p>and the de facto complainant sustained serious injuries. It would<\/p>\n<p>appear that there was some quarrel between the de facto<\/p>\n<p>complainant and the second accused. The allegation is that<\/p>\n<p>thereafter when the first accused, the father of the second<\/p>\n<p>accused, asked the de facto complainant about the incident,<\/p>\n<p>accused No.2 attacked the de facto complainant asking why the<\/p>\n<p>de facto complainant had assaulted the first petitioner. The first<\/p>\n<p>B.A. No.1340\/2010<br \/>\n<span class=\"hidden_text\" id=\"span_1\">                                  2<\/span><\/p>\n<p>petitioner assaulted the de facto complainant with stick and<\/p>\n<p>stone, which caused grievous hurt. He had to undergo a surgery<\/p>\n<p>as a result of the injuries sustained.\n<\/p>\n<p id=\"p_3\">      4.    The learned counsel for the petitioners submitted that<\/p>\n<p>Crime No.33\/2010 was registered on 15\/2\/2010 in respect of the<\/p>\n<p>incident which occurred on 14\/2\/2010. In that case, the second<\/p>\n<p>petitioner herein is the de facto complainant and the accused<\/p>\n<p>persons include the de facto complainant in the present case.<\/p>\n<p>Crime No.33\/2010 was registered for the offences under<\/p>\n<p><a href=\"\/doc\/1086076\/\" id=\"a_5\">Sections 294(b)<\/a>, <a href=\"\/doc\/770961\/\" id=\"a_6\">323<\/a>, <a href=\"\/doc\/661069\/\" id=\"a_7\">341<\/a>, <a href=\"\/doc\/267625\/\" id=\"a_8\">324<\/a> and <a href=\"\/doc\/1326470\/\" id=\"a_9\">427<\/a> read with <a href=\"\/doc\/37788\/\" id=\"a_10\">Section 34<\/a> of<\/p>\n<p>the Indian Penal Code.\n<\/p>\n<p id=\"p_4\">      5.    Taking into account the facts and circumstances of the<\/p>\n<p>case, it can be seen that the grievous injuries caused to the<\/p>\n<p>de facto complainant are attributable to the overt acts done by<\/p>\n<p>the first petitioner\/first accused. The overt acts made by the<\/p>\n<p>second petitioner\/second accused have not resulted in any<\/p>\n<p>grievous injuries to the de facto complainant.<\/p>\n<p id=\"p_5\">      6.    In the facts and circumstances of the case, I am of the<\/p>\n<p>view that anticipatory bail can be granted to the second<\/p>\n<p>B.A. No.1340\/2010<br \/>\n<span class=\"hidden_text\" id=\"span_1\">                                  3<\/span><\/p>\n<p>petitioner\/second accused. At the same time, I am of the view<\/p>\n<p>that the first petitioner\/first accused is not entitled to the<\/p>\n<p>discretionary relief under <a href=\"\/doc\/1783708\/\" id=\"a_11\">Section 438<\/a> of the Code of Criminal<\/p>\n<p>Procedure. If anticipatory bail is granted to the first petitioner, it<\/p>\n<p>would adversely affect the proper investigation of the case.<\/p>\n<p>Accordingly, there will be a direction that in the event of the<\/p>\n<p>arrest of the second petitioner\/second accused, the officer in<\/p>\n<p>charge of the police station shall release him on bail on his<\/p>\n<p>executing bond for Rs.15,000\/- with two solvent sureties for the<\/p>\n<p>like amount to the satisfaction of the officer concerned, subject<\/p>\n<p>to the following conditions:\n<\/p>\n<blockquote id=\"blockquote_1\"><p>         A)   The second petitioner\/second accused<br \/>\n              (Febin Charles Joy) shall appear before<br \/>\n              the investigating officer for interrogation<br \/>\n              as and when required.\n<\/p><\/blockquote>\n<blockquote id=\"blockquote_1\"><p>         B)   The second petitioner\/second accused<br \/>\n              (Febin Charles Joy) shall not try to<br \/>\n              influence the prosecution witnesses or<br \/>\n              tamper with the evidence.\n<\/p><\/blockquote>\n<blockquote id=\"blockquote_2\"><p>         C)   The   second    petitioner\/second   accused<br \/>\n             (Febin Charles Joy) shall not commit any<br \/>\n             offence or indulge in any prejudicial activity<br \/>\n             while on bail.\n<\/p><\/blockquote>\n<p id=\"p_6\">B.A. No.1340\/2010<br \/>\n<span class=\"hidden_text\" id=\"span_2\">                                   4<\/span><\/p>\n<p>         D) In case of breach of any of the conditions<br \/>\n             mentioned above, the bail shall be liable to<br \/>\n             be cancelled.\n<\/p>\n<p id=\"p_7\">       For the aforesaid reasons, the Bail Application is dismissed<\/p>\n<p> in so far as it relates to the first petitioner\/ first accused and it<\/p>\n<p> is allowed in the manner indicated above, in so far as it relates<\/p>\n<p> to the second petitioner\/second accused.<\/p>\n<p id=\"p_8\">                                     K.T.
