Ravishankar, Adv. for R2)<\/p>\n<p>%&#8217;<\/p>\n<p><span class=\"hidden_text\" id=\"span_1\">2<\/span><\/p>\n<p>This MFA is \ufb01led U\/S 173(1) of <a href=\"\/doc\/785258\/\" id=\"a_1\">MV Act<\/a>, against the<br \/>\njudgement and award dated 27.10.2007 passed in MVC<br \/>\nNo.3306\/ 2002 on the \ufb01le of V Additional Judge,<br \/>\nMember, MACT, Bangalore, SCCH-20, partly allowing<br \/>\nthe claim petition for compensation and {seeking<br \/>\nenhancement of compensation.   <\/p>\n<p>This appeal coming on for  <\/p>\n<p>the Court. delivered the following:<\/p>\n<p>JUDaMEnrd&amp;n&#8217;<\/p>\n<p>This appeal is  the  &#8230;seekin&#8217;gl&#8217;<\/p>\n<p>enhancement of compensation.  g\n<\/p>\n<p id=\"p_1\">2.. Heard. The    and with the<br \/>\nconsent of ie;;r&#8217;m\u00a2d for the parties, it<br \/>\nis  A\n<\/p>\n<p id=\"p_2\">3.    are:\n<\/p>\n<p id=\"p_3\">p   when the claimant was riding<\/p>\n<p> .__on Assayee road, Frazer Town, Bangalore a<\/p>\n<p>A  registration No.KA~O4 A 4475 came in a<\/p>\n<p>&#8216;rash  &#8220;negligent manner and dashed against the<\/p>\n<p>cyciegas a result he sustained injuries. Hence, he filed<\/p>\n<p> v  petition before MACT, Mangalore seeking<\/p>\n<p> compensation of Rs.3,00,000\/- and the Tribunal has<\/p>\n<p>W<\/p>\n<p><span class=\"hidden_text\" id=\"span_1\">3<\/span><br \/>\nawarded compensation of Rs.6l,900\/&#8211; with interest at<br \/>\n6% pa.\n<\/p>\n<p id=\"p_4\">4,-. As there is no dispute regarding occurrence of<\/p>\n<p>accident, negligence and liability of the <\/p>\n<p>offending Vehicle the only point that <\/p>\n<p>consideration is: 9 9 T _ A _<br \/>\nVlfhether the compensation awarded  it<br \/>\nthe Tribunal is just  reasonable o1=i._does.wit<br \/>\ncall for enhancemer1t&#8217;?_     1\n<\/p>\n<p id=\"p_5\">5. After hearing: the  bounselllllajapearing for<br \/>\nthe parties and perL;_si&#8217;ng   award of the<\/p>\n<p>Tribunal {I V of&#8217;   the compensation<\/p>\n<p>awarded  is not just and reasonable, it<br \/>\nis on theta  therefore it is deserved to be<\/p>\n<p>e;r1hanced.&#8221;&#8216; .  V I<\/p>\n<p>l  &#8221; .   has sustained the following injuries:<\/p>\n<p>it   over abdomen;\n<\/p>\n<p id=\"p_6\">,.   Lacerated injury over the dorsal aspect of<br \/>\n &#8216; the right foot;\n<\/p>\n<p id=\"p_7\"> iii) Contusion over right side of the chest;\n<\/p>\n<p id=\"p_8\">iv) Lacerated injury over the right arm lateral<\/p>\n<p>aspect.\n<\/p>\n<p id=\"p_9\">\n<p>Injuries sustained by him are evident from discharge<br \/>\nsummary Ex. P 6 and supported by oral evidence of<\/p>\n<p>the claimant examined as PW 1. He  in<\/p>\n<p>Bowring Hospital and Abhaya Hospital, <\/p>\n<p>ESI Hospital, Indiranagar. as  A&#8217;<\/p>\n<p>Hospital, Bangalore for daysdtkp  it<\/p>\n<p id=\"p_10\">7. Considering the I1a&#8217;\u00a3&#8217;ii&#8217;i.&#8217;:(:.3&#8243;0f  in the<br \/>\ndischarge summary  awarded by the<br \/>\nTribunal towards  the lower side<\/p>\n<p>and it is   by another sum of<\/p>\n<p>Rs.E,~;OO.\u00aeO&#8217;:V&#8217;\/&#8217;tttvihaiid 1 award *Rs;2.o\u00a700o\/&#8211; under this head.\n<\/p>\n<p id=\"p_11\">8.  As Rs;V&#8217;tfZ6.t:9O'()i\/.:-L&#8221;awarded by the Tribunal towards<\/p>\n<p>rnedicineydt   charges is based on the bills<\/p>\n<p> &#8216;b&#8217;y-,.the claimant there is no scope for<\/p>\n<p>&#8216;  &#8220;eniiance1n&#8217;ent under this head.<\/p>\n<p> 2    was treated as inpatient for 4 days in Ahhaya<\/p>\n<p> Bangalore and taken treatment in Bowring<\/p>\n<p> ii &#8216;ti\ufb01uospital and ES} Hospital. Considering the same<\/p>\n<p> &#8216;F&#8217;lis.2,500\/&#8211; awarded towards incidental expenses such<\/p>\n<p>@&#8217;<\/p>\n<p><span class=\"hidden_text\" id=\"span_2\">5<\/span><br \/>\nas conveyance, nourishment and attendant charges is<\/p>\n<p>the lower side and I award Rs.6,000\/- under this head.<\/p>\n<p id=\"p_12\">10. Claimant claims to be a Security Guarc.i'&#8221;e\u00bbarr1ing<\/p>\n<p>Rs.2,902\/&#8211; pm. In the absence of  I<\/p>\n<p>assess the income of t he claimant at <\/p>\n<p>as against Rs.2,500\/&#8211; assessedilipbyf  and <\/p>\n<p>award Rs.9,000\/~ towardsloss&#8221;oftincome-it-tdu\ufb01ng\ufb01aid up<\/p>\n<p>period as against Rs.7,5O(l\/*.;_V&#8217;awarded &#8216;l_oyVthe&#8217;:\u00a7Tribuna1.<\/p>\n<p>ll. The Tribunal&#8217;co_nsidV\u00e91~iing:&#8211;p&#8217;tires: &#8216;nature of injuries,<br \/>\nand duratitin \u00abof V&#8221; awarded Rs.10,000\/&#8211;<br \/>\ntowardshloiss  is just and proper and<br \/>\nit does. not cs-ii. for&gt;&#8217;en:h&#8217;a.ncement.<\/p>\n<p id=\"p_13\">12. The .c1aimantV::having not examined the doctor<\/p>\n<p> &#8216;disability is not entitled for compensation<\/p>\n<p>&#8216;  &#8220;towa_r&#8221;dsfv1osts of future income.<\/p>\n<p>   the claimant is entitled for the following<\/p>\n<p>it it , compensation:\n<\/p>\n<p id=\"p_14\">1) Pain and suffering Rs. 20,000 \/ &#8211;\n<\/p>\n<p id=\"p_15\">2) Medical expenses Rs. 26,900 \/ &#8211;<br \/>\n3] Incidental expenses Rs. 6,000\/-<br \/>\n4] Loss of income of parents<\/p>\n<p>$(<\/p>\n<p><span class=\"hidden_text\" id=\"span_3\">6<\/span><\/p>\n<p>During treatment period Rs. 9,000\/-\n<\/p>\n<p id=\"p_16\">5) Loss of amenities Rs. 10,000\/&#8211;<\/p>\n<p>Total 125.7 1 .900 \/-\n<\/p>\n<p id=\"p_17\">14. Accordingly the appeal is allowed in  The<br \/>\njudgment and award of the Tribunal is the<br \/>\nextend stated hereinabove.
