The Registrar,\n   Tamil Nadu Administrative Tribunal,\n   Chennai                              Respondents  \n\n        Petition under <a href=\"\/doc\/1712542\/\" id=\"a_1\">Article 226<\/a> of the Constitution of  India  praying\nfor issuance of writ of certiorarified mandamus as stated therein.\n\n For petitioner :  Mr.S.Parthasarathy\n\n\n:O R D E R \n<\/pre>\n<p id=\"p_1\">(Order of the Court was made by R.  Jayasimha Babu,J.)<br \/>\n        We do  not  find  any  error  in  the order of the Tribunal.  The<br \/>\nScheme of compassionate appointments,  as  rightly  pointed  out  by  the<br \/>\nTribunal,  is  intended  to  help  persons who are thrown into unforeseen<br \/>\ndifficulties by reason of the sudden demise of the earning family  member<br \/>\nwho held post in the Government.\n<\/p>\n<p id=\"p_1\">        2.   In  this  case,  the death of the employee occurred in 1987.<br \/>\nHis widow had sent an  application  for  a  job  for  their  son.    That<br \/>\napplication  was  not  pressed  because  he  got  a  job elsewhere, which<br \/>\nobviously was better than what he would have got in the Government.  That<br \/>\ncertainly  took  care  of  whatever  difficulties  the  family  may  have<br \/>\nencountered at  that time.  Thereafter, there was no further right in the<br \/>\nfamily to demand that another job be provided in the  Government  because<br \/>\nseveral  years  later  that  son,  who  had secured employment, allegedly<br \/>\nstopped helping that family.\n<\/p>\n<p id=\"p_2\">        3.  Positions under the Government are positions to  which  every<br \/>\nqualified citizen is entitled to aspire.  It is not a legacy to be passed<br \/>\non from father to son, or daughter.  Each post occupied by one would mean<br \/>\ndenial of  the  chance  to  occupy  the  same  post to many others.
