Dave, learned advocate for the respondent-University waives<br \/>\nservice of rule.  With the consent of the learned advocates, the<br \/>\nmatter is taken up for hearing.\n<\/p>\n<p>2.\tThe<br \/>\npresent petition is filed challenging the Notification dated 21st<br \/>\nMay 2008, which is produced at Annexure &#8216;A&#8217;, whereby the petitioner,<br \/>\nwho is serving as Reader in Mahatma Gandhi Rural Studies PG Section<br \/>\nwas appointed as Officiating Head by Resolution No.52 passed by the<br \/>\nSyndicate in its meeting dated 13th December 2007. Taking<br \/>\ninto consideration the contents of letter dated 17th<br \/>\nDecember 2007 bearing No.JN\/ EST\/ T\/ 15077\/ 2007  he was conferred<br \/>\nthe status of Ex-Officio Member of the University, as he was<br \/>\nappointed as Officiating Head of the Said Department.  The University<br \/>\nthen decided to remove him from the Membership of the Senate, to<br \/>\nwhich he was elected uncontested.\n<\/p>\n<p>3.\tLearned<br \/>\nadvocate for petitioner submitted that it is not in dispute that the<br \/>\npetitioner is appointed as Officiating Head and by virtue of that<br \/>\nappointment he is conferred Ex-Officio Membership of the Senate.  But<br \/>\nthen his Membership of Senate, which he obtained by getting elected<br \/>\nuncontested cannot be taken away. Learned advocate for the petitioner<br \/>\nsubmitted that in the event the University decides to appoint someone<br \/>\nelse as Head of Department in place of the petitioner as he is the<br \/>\nonly officiating head, the petitioner will lose this Ex-Officio<br \/>\nMembership as well as the one to which he is elected uncontested.\n<\/p>\n<p>4.\tThe<br \/>\nCourt finds substance in the submission of the learned advocate for<br \/>\nthe petitioner.  It was recorded on 28th May 2008 by this<br \/>\nCourt that the petitioner is ready to relinquish his charge as<br \/>\nIn-charge\/ Officiating Head of the Department, Faculty of  Rural<br \/>\nStudies.  It was after recording this decision that the &#8216;notice&#8217; was<br \/>\nissued so as to find out the stand of the University.\n<\/p>\n<p>The<br \/>\nlearned advocate for the University submitted that the University is<br \/>\nof the opinion that a person cannot be allowed to be a Member of the<br \/>\nSenate in two capacities.  The petitioner is appointed as Officiating<br \/>\nHead and by virtue of that he gets Ex-Officio Membership of the<br \/>\nSenate.  Therefore, he is to be removed from the Membership of the<br \/>\nSenate, to which he was elected uncontested.\n<\/p>\n<p>Learned<br \/>\nadvocate for the respondent-University relied upon Statute 287 of<br \/>\nSouth Gujarat University Statutes, 1998.  The Statute reads as under:\n<\/p>\n<p>\u00fdS(a)\t\t If a<br \/>\ncandidate elected to the Senate form (sic., from) more than one<br \/>\nconstituency, he shall by notice in writing signed by him and<br \/>\ndelivered to the Registrar of the University within seven days of the<br \/>\npublication in the Gazette of the result of the last of such<br \/>\nelections, choose which of these constituencies he shall represent<br \/>\nand such choice once made shall be conclusive;\u00fd\u00fd<\/p>\n<p>Reliance<br \/>\nplaced is not well placed.  What is provided  in Statute 287 is,  if<br \/>\na candidate is  elected to the Senate.  In the present<br \/>\ncase the petitioner is not elected from more than one constituencies.<br \/>\n He is elected from one constituency only.  So far as another<br \/>\nMembership is concerned, it is the conferred one on account of  he<br \/>\nbeing appointed as Officiating Head of the Department.  In view of<br \/>\nthat, Statute 287 cannot be said to have any application to the facts<br \/>\nof the  present case. Learned advocate for the respondent-University<br \/>\nalso contended that there is alternative remedy available under<br \/>\nsection 59 of the Act.  The Court finds that the same is not<br \/>\napplicable to the facts of the case.\n<\/p>\n<p>5.\tThe<br \/>\ncontentions raised on behalf of the University cannot be accepted. In<br \/>\nview of that, the decision of the University of removing the<br \/>\npetitioner from the Membership of Senate, to which he was elected<br \/>\nuncontested, is hereby quashed and set aside.  The petition is<br \/>\nallowed.  Rule is made absolute to the aforesaid extent.  Direct<br \/>\nservice is permitted.\n<\/p>\n<p>(RAVI R.
