R.P.No.1048 of 2010\n                       -------------------------------\n            Dated this the 28th day of October, 2010.\n\n                            O R D E R\n<\/pre>\n<p id=\"p_1\">      Challenging    the   conviction      and     sentence u\/s.138 of<\/p>\n<p><a href=\"\/doc\/1132672\/\" id=\"a_1\">Negotiable Instruments Act<\/a>, the accused preferred this revision<\/p>\n<p>petition.\n<\/p>\n<p id=\"p_1\">      2. The counsel for the revision petitioner submitted that the<\/p>\n<p>revision petitioner has no contention on merit and he require some<\/p>\n<p>time to pay the compensation amount and it is also the<\/p>\n<p>submission of the learned counsel that the revision petitioner may<\/p>\n<p>be permitted to pay the compensation amount directly to the<\/p>\n<p>complainant.    I find no reason to deny the above request and<\/p>\n<p>while granting 3 months time to pay the compensation, the<\/p>\n<p>amount can be enhanced slightly.\n<\/p>\n<p id=\"p_2\">      In the result, this revision petition is disposed of confirming<\/p>\n<p>the conviction against the revision petitioner u\/s.138 of <a href=\"\/doc\/1132672\/\" id=\"a_1\">Negotiable<\/p>\n<p>Instruments Act<\/a> as recorded by the courts below. Accordingly,<\/p>\n<p>while confirming the sentence of imprisonment as ordered by the<\/p>\n<p>court below, the revision petitioner is directed to pay a sum of<\/p>\n<p>Rs.2,40,000\/- as compensation to the complainant u\/s.357(3) of<\/p>\n<p><span class=\"hidden_text\" id=\"span_1\">                                      2<\/span><br \/>\nCrl. R.P.No.1048 of 2010<\/p>\n<p><a href=\"\/doc\/445276\/\" id=\"a_2\">Cr.P.C<\/a>.,within 3 months from today.           Accordingly the revision<\/p>\n<p>petitioner is directed to appear before the trial court on 28.1.2011,<\/p>\n<p>to receive the sentence of imprisonment and to pay the<\/p>\n<p>compensation amount as directed by this court. It is made clear<\/p>\n<p>that the revision petitioner is free to pay the above amount of<\/p>\n<p>compensation either directly to the complainant or by remitting the<\/p>\n<p>same in the trial court, which ever subject to the satisfaction of<\/p>\n<p>the learned Magistrate of the trial court. In case, any failure on<\/p>\n<p>the part of the revision petitioner in appearing before the court<\/p>\n<p>below as directed above and in paying the compensation amount,<\/p>\n<p>the trial court is free to take coercive steps to secure the<\/p>\n<p>presence of the revision petitioner and to execute the sentence<\/p>\n<p>awarded against the revision petitioner.
