Justice THOTTATHIL B.RADHAKRISHNAN\n\n Dated :24\/09\/2009\n\n O R D E R\n            THOTTATHIL B.RADHAKRISHNAN, J.\n                  -------------------------------------------\n                  W.P(C).No.21751 OF 2009\n                  -------------------------------------------\n           Dated this the 24th day of September, 2009\n\n\n                              JUDGMENT\n<\/pre>\n<p id=\"p_1\">      The petitioners have sought for certain directions on the<\/p>\n<p>allegation that there are attempts to fill up a Government owned<\/p>\n<p>canal. The allegation regarding the filling up of the canal is<\/p>\n<p>apparently supported by the counter affidavit of the Deputy<\/p>\n<p>Tahsildar on behalf of the fifth respondent. She states that on<\/p>\n<p>the basis of the petitioners&#8217; application, the Tahsildar,<\/p>\n<p>Thodupuzha Taluk has taken action and obtained a list of<\/p>\n<p>persons who have encroached                   and action is now being<\/p>\n<p>proceeded with for surveying the land. The statements in the<\/p>\n<p>said   counter    affidavit      dated        27.8.2009       are recorded.<\/p>\n<p>Accordingly, it is ordered that the survey procedures shall be<\/p>\n<p>completed by the competent authority within a period of three<\/p>\n<p>months from the date of receipt of a copy of this judgment and<\/p>\n<p>necessary action, if any, found due on the basis of that survey<\/p>\n<p>shall be concluded within an outer limit of a further period of six<\/p>\n<p>months, without fail. The fifth respondent shall be duty bound to<\/p>\n<p>WPC.21751\/09<\/p>\n<p>                           Page numbers<\/p>\n<p>ensure that the directions in this regard are appropriately<\/p>\n<p>carried out through the competent officers.      Let an official<\/p>\n<p>report regarding the action taken in this regard be made<\/p>\n<p>available to the Registrar General of this Court within a period<\/p>\n<p>of 11 months from now. The petitioners are directed to appear<\/p>\n<p>before the fifth respondent and obtain the date of survey etc.<\/p>\n<p>They will also co-operate, as may be required by the fifth<\/p>\n<p>respondent, in accordance with law.
