Respondents\n\n\n\tHabeas Corpus Petition filed under <a href=\"\/doc\/1712542\/\" id=\"a_1\">Article 226<\/a> of the Constitution of\nIndia calling for the entire records connected with the detention order of\nRespondent No.2 in Detention Order No.18\/2009 dated 30.09.2009 and quash the\nsame and direct the respondents to produce the body and person of the\npetitioner's husband by name K.Murugan, Son of Karuppa Thevar, aged about 50\nyears detained in Madurai Central Prison, before this Court and set him at\nliberty forthwith.\n\n\n!For Petitioner   ... Mr.Isaac Manuel,\n\t\t      Addl.Public Prosecutor\n\n\n:ORDER\n<\/pre>\n<p id=\"p_1\">(Order of the Court was made by P.MURGESEN, J.)<\/p>\n<p>\tThe petitioner is the wife of the detenu.  The detenu has been detained<br \/>\nunder Section 3(1) of the Tamil Nadu Prevention of Dangerous Activities of<br \/>\nBootleggers, Drug-offenders, Forest-offenders, Goondas, Immoral Traffic<br \/>\noffenders, Sand Offenders, Slum-grabbers and Video Pirates Act, 1982 <a href=\"\/doc\/195458\/\" id=\"a_1\">(Tamil Nadu<br \/>\nAct<\/a> 14 of 1982), by order of the 2nd respondent in Detention Order No.18\/2009<br \/>\ndated 30.09.2009, by branding him as a &#8216;DRUG-OFFENDER&#8217;.\n<\/p>\n<p id=\"p_1\">\t2. There are three adverse cases and one ground case as against the<br \/>\ndetenu. The details of the adverse cases are as under:-\n<\/p>\n<pre id=\"pre_1\">Sl.No.              Police Station                    Section of Law\n                     and Crime No.\n\n1. Dindigul               8(c) r\/w 20(b) (ii) <a href=\"\/doc\/1727139\/\" id=\"a_4\">(A) NDPS Act<\/a>.\n                       NIB CID\n                 Crime No.68 of 2009\n\n\n<\/pre>\n<p id=\"p_2\">The ground case was registered under <a href=\"\/doc\/1330288\/\" id=\"a_5\">Section 8(c)<\/a> r\/w 20(b)(ii)<a href=\"\/doc\/1727139\/\" id=\"a_6\">(B) NDPS Act<\/a>,<br \/>\n1985 on the file of Dindigul NIB CID in Crime No.133 of 2009. In the ground<br \/>\ncase, the detenu was arrested on 29.07.2009 and produced before the Judicial<br \/>\nMagistrate No.3, Dindigul on the same day and remanded up to 12.08.2009.<br \/>\nThereafter, his remand has been periodically extended up to 01.10.2009. The<br \/>\ndetention order was clamped on the detenu on 30.09.2009.\n<\/p>\n<p id=\"p_3\">\t3. Learned counsel for the petitioner has submitted that the order of<br \/>\ndetention passed by the second respondent is vitiated on three grounds; firstly<br \/>\nthe Detaining Authority had not satisfied itself as to the real possibility of<br \/>\nthe detenu coming out on bail; secondly, the Detaining Authority had passed the<br \/>\norder without application of mind; and thirdly, there was delay in considering<br \/>\nthe representation of the detenu, by the Detaining Authority.\n<\/p>\n<p id=\"p_4\">\t4. The first ground raised by the learned counsel for the petitioner is<br \/>\nthat the Detaining Authority had not satisfied itself as to the real possibility<br \/>\nof the detenu coming out on bail. In this case, the detenu was arrested on<br \/>\n29.07.2009 and the detention order was passed on 30.09.2009. He has not filed<br \/>\nany bail application so far. But the Detaining Authority has observed that there<br \/>\nwas a real possibility of the detenu coming out on bail by filing a bail<br \/>\napplication in future, since in similar cases accused were enlarged on bail. It<br \/>\nis only a presumption.  The Detaining Authority passed the order only on<br \/>\npresumptions and it is not based upon any material. In the absence of any<br \/>\nmaterial, it cannot be said that there was a likelihood of the detenu coming out<br \/>\non bail.  Hence on this ground, the detention order is liable to be set aside.\n<\/p>\n<p id=\"p_5\">\t5. With regard to the second ground, the learned counsel for the<br \/>\npetitioner has submitted that in the Counter Affidavit filed by the second<br \/>\nrespondent, it is stated that 5.500 Kilograms of ganga was seized, whereas in<br \/>\nthe Arrest Report, available in Page No.39 of the booklet, it is stated that<br \/>\n5.600 Kilograms of ganga was seized, which amounts to non-application of mind on<br \/>\nthe part of the Detaining Authority.  We have also analysed the same and are of<br \/>\nthe opinion that the Detaining Authority had passed the order without<br \/>\nconsidering the defect. On this ground also, the Detention Order is liable to be<br \/>\nset aside.\n<\/p>\n<p id=\"p_6\">\t6. The third ground relied upon by the counsel for the petitioner is there<br \/>\nwas a delay in considering the representation of the detenu.  In this<br \/>\nconnection, the learned Additional Public Prosecutor appearing on behalf of the<br \/>\nrespondents, has submitted a Proforma. It is stated in the Proforma as under:-\n<\/p>\n<p id=\"p_7\">\tRepresentation received on\t: 12.01.2010<br \/>\n\tRemarks called for on\t\t: 13.01.2010<br \/>\n\tReminder dated\t\t\t: 20.01.2010<br \/>\n\tRemarks received on\t\t: 21.01.2010<br \/>\n\tFile submitted on \t\t: 21.01.2010<br \/>\n\tUnder Secretary dealt with<br \/>\n\ton\t\t\t\t: 21.01.2010<\/p>\n<p>\tDeputy Secretary dealt<br \/>\n\twith on\t\t\t\t: 22.01.2010<\/p>\n<p>\tFile circulated to<br \/>\n   \tHon&#8217;ble Minister (Law)\t\t: 22.01.2010<\/p>\n<p>\tMinister for Law dealt<br \/>\n\twith on\t\t\t\t: 25.01.2010<\/p>\n<p>\tRejection letter prepared<br \/>\n\ton\t\t\t\t: 28.01.2010<\/p>\n<p>\tRejection letter sent to<br \/>\n\tthe detenu\t\t\t: 28.01.2010<\/p>\n<p>\tRejection letter served<br \/>\n\ton to the detenu\t\t: 30.01.2010<\/p>\n<p>Though the Hon&#8217;ble Minister for Law dealt with the representation on 25.01.2010,<br \/>\nthe rejection letter was sent to the detenu only on 28.01.2010 and it was served<br \/>\non to the detenu only on 30.01.2010. These delays are not properly explained<br \/>\nwith reasons. Therefore, we are of the considered view that on this ground also,<br \/>\nthe detention order is liable to be set aside.\n<\/p>\n<p id=\"p_8\">\t7. Accordingly, the Habeas Corpus Petition is allowed and the order of<br \/>\ndetention in Order No. 18 of 2009 dated 30.09.2009 passed by the second<br \/>\nrespondent is set aside.
