No.31074 of 2011\n                             Gurudeo Rai, son of Gaya Prasad Rai\n                                             Versus\n                                     The State Of Bihar\n                                           -----------\n<\/pre>\n<p id=\"p_1\">2.   21.09.2011                  Heard learned counsel for the petitioner and the<\/p>\n<p>                  State.\n<\/p>\n<p id=\"p_1\">                                 The petitioner seeks bail in a case instituted for<\/p>\n<p>                  the offence under <a href=\"\/doc\/110162683\/\" id=\"a_1\">Section 47(a)<\/a> of the Excise Act.<\/p>\n<p id=\"p_2\">                               Considering that the petitioner is in custody since<\/p>\n<p>                  19.7.2011 and he is first offender, let the petitioner above<\/p>\n<p>                  named, be released on bail on furnishing bail bond of Rs.<\/p>\n<p>                  5,000\/- (Five thousand) with two sureties of the like amount<\/p>\n<p>                  each or any other surety to be fixed by the court concerned to<\/p>\n<p>                  the satisfaction of Chief Judicial Magistrate, Samastipur, in<\/p>\n<p>                  connection with Excise Case No. 41 of 2011 subject to the<\/p>\n<p>                  following conditions: (i) That one of the bailors will be a close<\/p>\n<p>                  relative of the petitioner, who will give an affidavit giving<\/p>\n<p>                  genealogy as to how he is related with the petitioner and the<\/p>\n<p>                  other shall be the father of the petitioner. The bailor will<\/p>\n<p>                  undertake to furnish information to the court about any change<\/p>\n<p>                  in the address of the petitioner. (ii) That the affidavit shall clearly<\/p>\n<p>                  state that the petitioner is not an accused in any other case<\/p>\n<p>                  and, if he is, he shall not be released on bail. (iii) That the bailor<\/p>\n<p>                  shall also state on affidavit that he will inform the court<\/p>\n<p>                  concerned if the petitioner is implicated in any other case of<br \/>\n<span class=\"hidden_text\" id=\"span_1\">                               2<\/span><\/p>\n<p>        similar nature after his release in the present case and<\/p>\n<p>        thereafter the court below will be at liberty to initiate the<\/p>\n<p>        proceeding for cancellation of bail on the ground of misuse. (iv)<\/p>\n<p>        That the petitioner will give an undertaking that he will receive<\/p>\n<p>        the police papers on the given date and be present on date<\/p>\n<p>        fixed for charge and if he fails to do so on two given dates and<\/p>\n<p>        delays the trial in any manner, his bail will be liable to be<\/p>\n<p>        cancelled for reasons of misuse.
