Srivastava,W.H.Khan\n\nHon'ble Devendra Pratap Singh,J.\n<\/pre>\n<p id=\"p_1\">       Heard learned counsel for the parties.\n<\/p>\n<p id=\"p_1\">       This petition by the landlord is directed against an<br \/>\nappellate order dated 21.7.2000 by which the appeal of the<br \/>\nrespondent     tenant    against     an   order   enhancing     rent   under<br \/>\n<a href=\"\/doc\/1490821\/\" id=\"a_1\">Section 21(8)<\/a> of the U.P. Act No. 13 of 1972 (hereinafter<br \/>\nreferred to as the Act) has been allowed and the application<br \/>\nhas been rejected.\n<\/p>\n<p id=\"p_2\">       It   appears     that   the    petitioner     landlord    filed     an<br \/>\napplication no. 5 of 1991 under <a href=\"\/doc\/1490821\/\" id=\"a_1\">Section 21(8)<\/a> of the Act<br \/>\nagainst the respondent tenant inter alia with the allegation<br \/>\nthat    they   had    purchased    the    disputed   property    through   a<br \/>\nregistered sale deed dated 6.2.1989 wherein the contesting<br \/>\nrespondent was a tenant at the rate of Rs. 390\/- per month<br \/>\nand as the market value of the premises was very high and the<br \/>\ntenant did not agree to enhance the rent, the necessity for<br \/>\nfiling the application.\n<\/p>\n<p id=\"p_3\">       The respondent contested the application inter alia with<br \/>\nthe    allegation     that U.P. State Electricity Board was              the<br \/>\ntenant and he was a servant and therefore, the application<br \/>\nwas not maintainable. Further objection was that the market<br \/>\nvalue as suggested was exorbitant and the rent being paid was<br \/>\njustified. The Rent Controller, after considering all the<br \/>\nevidence on record, allowed the application and fixed the<br \/>\nrent at Rs. 5567\/- per month apart from taxes. The respondent<br \/>\npreferred an appeal no. 3 of 1998 and the Additional District<br \/>\nJudge by the impugned order has allowed the appeal on the<br \/>\nground that the U.P. State Electricity Board was the tenant<br \/>\nwhich had not been impleaded and therefore, the application<br \/>\nwas not maintainable.\n<\/p>\n<p><span class=\"hidden_text\" id=\"span_1\">                                                                                   2<\/span><\/p>\n<p id=\"p_4\">       It is urged that the U.P. State Electricity Board had<br \/>\nbeen impleaded through the Executive Engineer, the local head<br \/>\nof the office and duly participated in the proceedings and<br \/>\nalso preferred appeal, it cannot be said that the Board was<br \/>\nnot duly represented.\n<\/p>\n<p id=\"p_5\">       From the record, it is clear that the respondent was<br \/>\nrepresented as &#8221; The Executive Engineer, Electricity Circle<br \/>\nConstruction Division, U.P. State Electricity Board, 3\/1987<br \/>\nLaxmi Bai Marg, Aligarh.&#8221; He participated in the proceedings<br \/>\non behalf of the Board and he also filed the appeal against<br \/>\nenhancement order. Proceedings under the Act are summary in<br \/>\nnature and all provisions of the Code of Civil Procedure do<br \/>\nnot strictly apply. No doubt, the Board is a Body Corporate<br \/>\nwhich can sue and be sued in its name but the counsel for the<br \/>\nrespondent has failed to demonstrate that the interest of the<br \/>\nBoard was not common or secured with that of its Executive<br \/>\nEngineer. Admittedly, the Board acts through its officers and<br \/>\nin the present case the office of the Executive Engineer was<br \/>\nsituated    in    the     disputed         premises.        In     an    identical<br \/>\ncircumstance where a release application was rejected by the<br \/>\nHigh Court on the ground that the Union of India was not<br \/>\nimpleaded, the Apex Court in the case of Raja Dharam Pal<br \/>\nSingh Vs. Director Small Industries Services Institutes and<br \/>\nother    [1980   ARC     365]     held    that       such    an    objection    was<br \/>\nhypertechnical     and     that     the    interest         of    the   Union   was<br \/>\nsufficiently represented by its officers already impleaded<br \/>\nand it went on to hold that if the argument were to be<br \/>\naccepted, its challenge before the High Court could not have<br \/>\nbeen    entertained.     Similarly        in   the    present      case,   if   the<br \/>\nargument of the counsel for the respondent is accepted, the<br \/>\nappellate order becomes void for the same reasons given in<br \/>\nthe appellate order.\n<\/p>\n<p id=\"p_6\">       Thus, for the reasons above, this petition succeeds and<br \/>\nis allowed and the appellate order dated 21.7.2000 is hereby<br \/>\nquashed and the matter is remanded to the appellate court to<br \/>\ndecide the appeal on merits after hearing the parties within<br \/>\n<span class=\"hidden_text\" id=\"span_1\">                                                               3<\/span><\/p>\n<p>a period of three months from the date of submission of a<br \/>\ncertified copy of this order.\n<\/p>\n<p id=\"p_7\">    However, keeping in mind the technical objection raised,<br \/>\nlet the Board, by whichever name it is called today, be<br \/>\nimpleaded as one of the parties.\n<\/p>\n<p id=\"p_8\">    In the circumstances of the case, no order as to costs.\n<\/p>\n<p id=\"p_9\">Order Date :- 12.8.2010<br \/>\nAK\n <\/p>\n","protected":false},"excerpt":{"rendered":"<p>Allahabad High Court Arvind Kumar Varshney &amp; Others vs Adj V &amp; Another on 12 August, 2010 Court No. &#8211; 1 Case :- WRIT &#8211; A No. &#8211; 44762 of 2000 Petitioner :- Arvind Kumar Varshney &amp; Others Respondent :- Adj V &amp; Another Petitioner Counsel :- V.P.
