BASANT, J.\n\n                         - - - - - - - - - - - - - - - - - - - - - -\n\n                            B.A.No.  4346 of   2007\n\n                         - - - - - - - - - - - - - - - - - - - - - -\n\n                    Dated this the 19th day of   July, 2007\n\n\n                                      O R D E R\n<\/pre>\n<p id=\"p_1\">       Application for anticipatory bail.  The petitioners are accused 2<\/p>\n<p>and 12.   The alleged incident took place on 8.5.2007.   The incident<\/p>\n<p>was really a clash between employees of the buses and the students.<\/p>\n<p>The   petitioners   face   allegations   for   offence   punishable,   inter   alia,<\/p>\n<p>under   <a href=\"\/doc\/4266\/\" id=\"a_1\">Section   308<\/a>   I.P.C.     There   is   a   case   and   counter   case.<\/p>\n<p>Investigation   is   in   progress.     The   petitioners   apprehend   imminent<\/p>\n<p>arrest.     The   learned   counsel   for   the   petitioners   submits   that   a<\/p>\n<p>conference has been called by the District Collector and the disputes<\/p>\n<p>have been settled.\n<\/p>\n<p id=\"p_1\">\n<p id=\"p_2\">       2.     The   learned   counsel   for   the   petitioners   submits   that   the<\/p>\n<p>petitioners   are   absolutely   innocent.     At   any   rate,   it   is   transparently<\/p>\n<p>evident that the allegation under <a href=\"\/doc\/4266\/\" id=\"a_1\">Section 308<\/a> I.P.C. is not justified at<\/p>\n<p>all.  It is alleged that there was an attempt by one of the accused (not<\/p>\n<p>the petitioners) to inflict an injury on the head of one of the victims<\/p>\n<p>by beating with an iron rod.  Fortunately the iron rod  slipped and the<\/p>\n<p>beating landed on other parts of the body.       This is the crux of the<\/p>\n<p>B.A.No.  4346 of   2007<\/p>\n<p><span class=\"hidden_text\" id=\"span_1\">                                              2<\/span><\/p>\n<p>allegation   under   <a href=\"\/doc\/4266\/\" id=\"a_2\">Section   308<\/a>   I.P.C.       The   learned   counsel   submits   that   a<\/p>\n<p>careful reading of the wound certificate would expose the hollowness of the<\/p>\n<p>allegations.   Convenient   allegations  are  raised   under   <a href=\"\/doc\/4266\/\" id=\"a_3\">Section   308<\/a>   I.P.C.  to<\/p>\n<p>unnecessarily   exaggerate   the   gravity   of   the     allegation.     In   these<\/p>\n<p>circumstances directions under <a href=\"\/doc\/1783708\/\" id=\"a_4\">Section 438<\/a> Cr.P.C. may be issued in favour<\/p>\n<p>of the petitioners, submits the Prosecutor.\n<\/p>\n<p id=\"p_3\">\n<p id=\"p_4\">       3.     The   learned   Prosecutor   opposes   the   application.     But<\/p>\n<p>notwithstanding the opposition I am satisfied in the facts and circumstances<\/p>\n<p>which I have already indicated that anticipatory bail can be granted to the<\/p>\n<p>petitioners.  I say so because all  other  offences are  bailable offences and<\/p>\n<p>there does   not appear to be sufficient substratum   to raise the   allegation<\/p>\n<p>under <a href=\"\/doc\/4266\/\" id=\"a_5\">Section 308<\/a> I.P.C.   The submission that the matter has been settled,<\/p>\n<p>which   is   not   controverted   does   also,   weigh   with   me   in   coming   to   this<\/p>\n<p>conclusion that  anticipatory bail  can be granted to the petitioners, subject<\/p>\n<p>to  appropriate  conditions.\n<\/p>\n<p id=\"p_5\">\n<p id=\"p_6\">       4.    In the result:\n<\/p>\n<p id=\"p_7\">\n       (1)  This application is allowed.\n<\/p>\n<p id=\"p_8\">\n       (2)  The following directions are issued under <a href=\"\/doc\/1783708\/\" id=\"a_6\">Section 438<\/a> Cr.P.C.<\/p>\n<p id=\"p_9\">       (a)   The petitioners shall surrender before the learned Magistrate on<\/p>\n<p>26.7.2007 at 11 a.m.  The learned Magistrate shall release the petitioners on<\/p>\n<p>B.A.No.  4346 of   2007<\/p>\n<p><span class=\"hidden_text\" id=\"span_1\">                                                  3<\/span><\/p>\n<p>regular bail    on    condition    that    they   execute        bonds   for   Rs.25,000\/-<\/p>\n<p>(Rupees  twenty five thousand only) each with two solvent sureties each for<\/p>\n<p>the like sum to the satisfaction of the learned Magistrate.<\/p>\n<p id=\"p_10\">        (b)  The petitioners shall make themselves available for interrogation<\/p>\n<p>before the Investigating Officer between 10 a.m. and 4 p.m. on 27.7.07 and<\/p>\n<p>28.7.2007 and thereafter on all Mondays and Fridays between 10 a.m. and<\/p>\n<p>12 noon for a period of two months.  Subsequently they shall appear before<\/p>\n<p>the Investigating Officer as and when directed by the Investigating Officer<\/p>\n<p>in writing to do so.\n<\/p>\n<p id=\"p_11\">\n<p id=\"p_12\">        (d)   If the petitioners do not appear before the learned Magistrate as<\/p>\n<p>directed in clause (1) above, these directions shall lapse on 26.7.06 and the<\/p>\n<p>police   shall   be   at   liberty   thereafter   to   arrest   the   petitioners   and   deal   with<\/p>\n<p>them  in accordance with law.\n<\/p>\n<p id=\"p_13\">\n<p id=\"p_14\">        (b)   If   the   petitioners   were   arrested   prior   to   their   surrender   on<\/p>\n<p>26.7.2006   as   directed   in     clause   (1)   above,   they   shall   be   released   from<\/p>\n<p>custody  on their executing  bonds for Rs.25,000\/- each  without any surety<\/p>\n<p>undertaking to appear before the learned Magistrate on 26.7.2007.<\/p>\n<pre id=\"pre_1\">\n\n\n\n\n\n                                                                (R.
