Justice ANTONY DOMINIC\n\n Dated :22\/08\/2007\n\n O R D E R\n                    ANTONY DOMINIC, J.\n                  ===============\n               W.P.(C) NO. 22236 OF 2005\n              ====================\n\n          Dated this the 22nd day of August, 2007\n\n                       J U D G M E N T\n<\/pre>\n<p id=\"p_1\">     This writ petition has been filed by the employees of<\/p>\n<p>the 3rd respondent, seeking to quash Exhibits P8, P10 and<\/p>\n<p>P12 and to declare that the rejection of approval by the first<\/p>\n<p>respondent for enhancing the age of superannuation to be<\/p>\n<p>illegal and   arbitrary.    Petitioners  are  also   seeking<\/p>\n<p>consequential reliefs.\n<\/p>\n<p id=\"p_1\">     2.   On facts, it is seen that presently, the age of<\/p>\n<p>superannuation of the employees of the Corporation is 55<\/p>\n<p>years. Enhancement of the age of retirement from 55 to 60<\/p>\n<p>was a long pending demand of the union, which was<\/p>\n<p>ultimately placed before the Board of Directors of the 3rd<\/p>\n<p>respondent for its   consideration.  In the meeting of the<\/p>\n<p>Board of Directors held on 14\/5\/98, after considering the<\/p>\n<p>various aspects of the matter, the Board resolved to raise<\/p>\n<p>WPC 22236\/05<br \/>\n<span class=\"hidden_text\" id=\"span_1\">                            : 2 :<\/span><\/p>\n<p>the age of retirement of the employees from the existing 55<\/p>\n<p>years to 60 years subject to approval of the Government<\/p>\n<p>and to make suitable amendment to the Service Rules. It<\/p>\n<p>was taken up with the Government and the same was<\/p>\n<p>rejected by Ext.P8. Although the corporation took up the<\/p>\n<p>matter again with the Government, the Government<\/p>\n<p>rejected the requests as per Exhibits P10 and P12. It is in<\/p>\n<p>the aforesaid background, this writ petition has been filed by<\/p>\n<p>the petitioners.\n<\/p>\n<p id=\"p_2\">     3.   This Court had occasion to consider a similar case<\/p>\n<p>in the case of Kavirajan v. KSBC Ltd (2007(2) KLT 917)<\/p>\n<p>concerning the employees of Kerala State Beverages<\/p>\n<p>Corporation Ltd. Considering the entire facts including the<\/p>\n<p>enhancement of age of retirement granted in respect of<\/p>\n<p>other Public Sector Undertakings of the Government of<\/p>\n<p>Kerala, this Court held that the regular employees of the<\/p>\n<p>Kerala State Beverages Corporation are entitled to continue<\/p>\n<p>WPC 22236\/05<br \/>\n<span class=\"hidden_text\" id=\"span_1\">                              : 3 :<\/span><\/p>\n<p>till the age of 58 as decided by the Board of Directors of the<\/p>\n<p>corporation and the rejection of the request in this behalf by<\/p>\n<p>the Government is violative of <a href=\"\/doc\/367586\/\" id=\"a_1\">Article 14<\/a> of the Constitution<\/p>\n<p>of India. The ratio of the said decision applies fully to the<\/p>\n<p>facts of this case and applying the same, I quash Exhibits<\/p>\n<p>P8, P10 and P12 and I hold that the regular employees of<\/p>\n<p>the 3rd respondent will be entitled to continue in service till<\/p>\n<p>60 years as resolved by the Board of Directors in their<\/p>\n<p>meeting held on 14\/5\/98.\n<\/p>\n<p id=\"p_3\">      4.   In this case an interim order was passed on<\/p>\n<p>30\/11\/05 that the retirement of the petitioners 2 to 83 will<\/p>\n<p>be subject to the result of the writ petition. In view of the<\/p>\n<p>said order, it is directed that if any one of the petitioners<\/p>\n<p>have retired after the filing of this writ petition, they shall be<\/p>\n<p>reinducted and allowed to continue till they attain the age of<\/p>\n<p>60 years.      It is also clarified that the benefit of this<\/p>\n<p>judgment will apply to all employees of the 3rd respondent,<\/p>\n<p>WPC 22236\/05<br \/>\n<span class=\"hidden_text\" id=\"span_2\">                             : 4 :<\/span><\/p>\n<p>who are in service as on today, but the limited<\/p>\n<p>retrospectivity given, will apply only to the writ petitioners<\/p>\n<p>in this case.
