The<br \/>\nCourt, therefore, proceeded with the matter and heard the Learned<br \/>\nAdditional Public Prosecutor and decided to dispose of the matter<br \/>\nafter perusing the certified copy of the testimony.\n<\/p>\n<p id=\"p_2\">(3)\tFacts<br \/>\nin brief leading to filing of this appeal deserve to be set out as<br \/>\nunder:\n<\/p>\n<p id=\"p_3\">(4)\tThe<br \/>\noriginal complainant Food Inspector in discharge<br \/>\nof his duties as such on 7.8.1991 at around 3:00 O&#8217; clock visited the<br \/>\nshop of the accused, where accused no.1 was found to be present.  In<br \/>\npresence of Panch Witness and after introducing himself as such, he<br \/>\nfound that in a tin, containing about 10 K.G. of Oil, which was said<br \/>\nto be Ground Nut Oil was preserved for selling. After indicating his<br \/>\nintention to collect the sample food article of Ground Nut Oil from<br \/>\nthe said tin, he purchased 500 gms. of Ground Nut Oil and took it in<br \/>\nthe clean steel vessel and, thereafter, transferred into three<br \/>\nodour-less glass bottles.\n<\/p>\n<p id=\"p_4\">After<br \/>\nsealing it with a wooden cork<br \/>\nand<br \/>\naffixing signature etc. thereon, one part of the  sample food article<br \/>\nwas sent to the public analyst and remaining two parts were sent to<br \/>\nthe Local Health Authority.  The accused no.2 is the owner of the<br \/>\nshop.  The public analyst opined the oil to be not in conformity with<br \/>\nthe standard laid down in the Prevention of Food Adulteration Rules<br \/>\nand, therefore, adulterated. On receipt of the report of the public<br \/>\nanalyst, the competent authority&#8217;s sanction was obtained for lodging<br \/>\nprosecution and the prosecution was lodged.  The requisite notice was<br \/>\nissued, the Trial Court after recording evidence, came to the<br \/>\nconclusion<br \/>\nthat the offence is not said to have been proved and hence acquitted<br \/>\nthe accused vide its order dated 17.2.2003, which is impugned in this<br \/>\nappeal under <a href=\"\/doc\/487026\/\" id=\"a_1\">Section 378<\/a> of the Code of Criminal Procedure.\n<\/p>\n<p id=\"p_5\">(5)\tThe<br \/>\nFood Inspector in his testimony has admitted that the sanctioning<br \/>\nauthority for lodging prosecution was one Shri D.T. Brahmbhatt, who<br \/>\nwas at the relevant time holding charge of the Local Health<br \/>\nAuthority.  Now as per the judgment of this Court, it is established<br \/>\nprinciple of law that the prosecution cannot be sanctioned by a<br \/>\nperson holding charge of the post of incumbent, whereas in this case<br \/>\nthe in-charge person has sanctioned prosecution.  Though the Court<br \/>\nhas proceeded on the footing for recording acquittal that there was<br \/>\nno clear evidence with regard to compliance with Rule 14 of the<br \/>\nPrevention of Food Adulteration Rules.  The  testimony of the Food<br \/>\nInspector as could be seen from the certified copy thereof can be<br \/>\nsaid that the Trial Court was correct in coming to the conclusion<br \/>\nthat there was no evidence with regard to compliance with Rule 14 of<br \/>\nthe Prevention of Food Adulteration Rules.  Moreover, the<br \/>\nTrial Court has also recorded finding with regard to non-compliance<br \/>\nwith <a href=\"\/doc\/128134290\/\" id=\"a_2\">Section 13<\/a> (2) notice to the accused no.2.\n<\/p>\n<p id=\"p_6\">(6)\tIn<br \/>\nview of the aforesaid facts and circumstances, this Court is of the<br \/>\nview that the order of acquittal cannot be said to be so perverse so<br \/>\nas to call for any interference under <a href=\"\/doc\/487026\/\" id=\"a_3\">Section 378<\/a> of the Code of<br \/>\nCriminal Procedure.
