                    Application No.6799 of 2007.\n<\/p>\n
                            This Interlocutory application has been filed by<\/p>\n
                    the respondent No.1 on 10.12.2007 praying therein for<\/p>\n
                    recalling the order dated 04.10.2007.<\/p>\n
                            For the purpose of deciding this application the<\/p>\n
                    short facts may be stated that the plaintiff-respondent<\/p>\n
                    filed the partition suit being partition suit No.83 of<\/p>\n
                    1982. The said partition suit has been decreed and the<\/p>\n
                    defendant No.3, Smt. Krishna Kumari Devi has filed this<\/p>\n
                    First Appeal against the said preliminary decree. During<\/p>\n
                    the pendency of this Appeal, I.A. No.4164 of 2007 was<\/p>\n
                    filed by the appellant seeking permission to sell one<\/p>\n
                    biggha land of Khata No.1705, Plot No.5633 and 10<\/p>\n
                    kattha land of R.S. Plot No.372, 5 decimals of R.S. Plot<\/p>\n
                    No.377 and 12 decimals of R.S. Plot No.735 because<\/p>\n
                    the appellant was earlier restrained from selling any<\/p>\n
                    property.   By terms of order dated 04.10.2007, this<\/p>\n
                    Court   allowed    the   I.A.   with    respect   to   property<\/p>\n
                    mentioned in paragraph 22 of the petition, i.e., 1<\/p>\n
                    biggha out of Khata No.1705, R.S. Plot No.5633.
\n                      2<\/span><\/p>\n
Subsequently,   to       recall   this    order,     the   plaintiff-<\/p>\n
respondents have filed this I.A. No.6799 of 2007 on the<\/p>\n
ground that by surprising facts, the appellant has<\/p>\n
obtained this order.\n<\/p>\n
       The learned counsel for the plaintiff-respondent<\/p>\n
submitted that for obtaining permission to sell medical<\/p>\n
prescriptions have been annexed which are from the<\/p>\n
year 2002-2005 and during this period, the appellant<\/p>\n
has sold the following properties :\n<\/p>\n
       (a)        4 decimals out of Plot No.823 on\n\n                  06.10.2004 for Rs.30,000\/-.\n\n       (b)        8       decimals       in   sale   deed     dated\n\n                  25.01.2000 for one lakh.\n\n       (c)        4 decimal plot No.5632 and 5633 by\n\n                  3 sale deed dated 25.01.2006 for\n\n                  Rs.1.5 lakh.\n\n       (d)        4 decimal          of the above plot for\n\n                  Rs.1,62,000\/-.\n\n       (e)        8 decimal plot No.823 sale deed\n\n                  dated 18.06.2006 for Rs.3 lakhs.\n\n       (f)        6 decimal out of above plot No.823\n\n<\/pre>\n
                  dated 18.06.2006 for Rs.1,25,000\/-.\n<\/p>\n
       (g)        2 decimal of the said plot on the\n\n                  same date to another persons for\n\n                  Rs.75,000\/-\n\n       (h)        6 decimal of that plot on the same\n                     3<\/span>\n\n\n\n\n                    date    to    Ramjhari      Devi    for\n\n                    Rs.2,13,750\/-.\n\n<\/pre>\n
        The learned counsel further submitted that in<\/p>\n
fact the appellant has received more than 27 lakhs for<\/p>\n
the lands sold by her during this period, but in the sale<\/p>\n
deeds   only   13   lakhs   and   odd   has   been   shown.<\/p>\n
According to the learned counsel, a substantial amount<\/p>\n
has been received by her but on the ground of ailment,<\/p>\n
she is selling the property and for that earlier, she<\/p>\n
violated the order of injunction, she was punished by<\/p>\n
the trial Court which was upheld by this Court.        The<\/p>\n
learned counsel further submitted that considering all<\/p>\n
these facts which are suppressed by the appellant, this<\/p>\n
Court by terms of order dated 24.01.2008 directed the<\/p>\n
parties to maintain status quo regarding remaining<\/p>\n
portion of plot No.5633. It appears that while passing<\/p>\n
the said orders, the appellant had already sold 12<\/p>\n
kattha land.    It was prayed by the respondents to<\/p>\n
modify the order dated 04.10.2007 to the extent that<\/p>\n
she is permitted to sell only 12 kattha instead of 1<\/p>\n
biggha of plot No.5633 because she had already sold 12<\/p>\n
kattha land. It further appears that while hearing this<\/p>\n
I.A. this Court by terms of order dated 16.01.2009<\/p>\n
further restrained the appellant from negotiating for<\/p>\n
sale.\n<\/p>\n
        Counter affidavit, reply to counter affidavit and
\n                        4<\/span><\/p>\n
rejoinder etc. have been filed by the parties.                 The<\/p>\n
learned counsel for the appellant submitted that the<\/p>\n
monthly expense of the appellant is about Rs.52,000\/-<\/p>\n
and she is suffering from cancer.           However as stated<\/p>\n
above,     Hon’ble     Bench     passed     the     order    dated<\/p>\n
04.10.2007 considering the facts and circumstances of<\/p>\n
the case, restrained the appellant from selling any<\/p>\n
further.       The    same    order   was   passed     again   on<\/p>\n
16.01.2009 by another Bench of this Court. It further<\/p>\n
appears that since 2007 for last 2\u00bd years, the appellant<\/p>\n
has been restrained by this Court from selling any<\/p>\n
property and now, therefore, after such a long period, it<\/p>\n
will not be proper to vacate the same.                  In such<\/p>\n
circumstances, the order dated 4th October, 2007 is<\/p>\n
modified to the extent that the appellant is permitted to<\/p>\n
sell only 12 kattha land of plot No.5633.<\/p>\n
         The learned counsel for the appellant submitted<\/p>\n
that in fact after getting permission dated 04.10.2007,<\/p>\n
the appellant has sold other 8 kattha land also and sale<\/p>\n
deed has been executed but because of restrained order<\/p>\n
dated 24.01.2008, the sale deed could not be presented<\/p>\n
for registration. The learned counsel further submitted<\/p>\n
that after taking the money, the appellant has spent the<\/p>\n
same.\n<\/p>\n
         Even if the appellants version is accepted that<\/p>\n
sale    deed    has    been     executed     then     also   from
\n                    5<\/span><\/p>\n
24.01.2008, still today i.e., for about 2 \u00bd years, the<\/p>\n
same has not been registered.\n<\/p>\n
       From the above discussion of the materials<\/p>\n
available on record, the statements made in the<\/p>\n
Interlocutory application, counter affidavit and reply<\/p>\n
and rejoinder etc., it appears that during the period of<\/p>\n
2003-2006, property of more than 13 lakhs has already<\/p>\n
sold by the appellant and the only ground is that the<\/p>\n
appellant is ailing old lady. It may be mentioned that<\/p>\n
she has one son and one daughter also. No statements<\/p>\n
have been made by her that they are not helping her.<\/p>\n
       Considering the above facts and circumstances<\/p>\n
of the case, I direct that the order dated 24.01.2008<\/p>\n
and 16.01.2009 shall continue till the disposal of the<\/p>\n
First Appeal. In other words, the appellant is restrained<\/p>\n
from selling any further property by registering any<\/p>\n
document either sell or gift.\n<\/p>\n
       In view of the above contentions of the parties,<\/p>\n
it is desirable that the appeal itself be heard at an early<\/p>\n
date. The learned counsel for the respondent No.1 & 2<\/p>\n
submitted that he will file Vakalatnama on behalf of the<\/p>\n
respondent No.3 to 5 and the learned counsel for the<\/p>\n
appellant submitted that he will see that the appellant’s<\/p>\n
daughter, respondent No.6 and son respondent No.7<\/p>\n
shall appear by filing Vakalatnama within one week.<\/p>\n
The learned counsel for the plaintiff-respondent also
\n                                6<\/span><\/p>\n
            submitted that Vakalatnama will be filed within one<\/p>\n
            week.    If Vakalatnama are field as stated above, the<\/p>\n
            Appeal itself may be listed for final hearing under the<\/p>\n
            heading for Hearing in the first week of September,<\/p>\n
            2010 without paper book.\n<\/p>\n
                    It is stated that the respondent No.8 is stranger<\/p>\n
            to the family and has neither filed written statement nor<\/p>\n
            contested the suit and, therefore, he is not required to<\/p>\n
            be heard in the Appeal.\n<\/p>\n
                    The Interlocutory Application No.6799 of 2007 is<\/p>\n
            disposed of.\n<\/p>\n
