In that Reference, right to file<br \/>\nReply of the Management was closed on 19th July 2007.  The<br \/>\nlearned advocate for the Management filed an application on  18 th<br \/>\nJune 2009 for reopening, which was reopened on a condition<br \/>\nthat the Management shall pay Rs.200\/- to the workman.  In the order,<br \/>\nit is mentioned that the application is filed after one year from the<br \/>\ndate of closure of right to file Written Statement (19\/07\/2007 &#8211;<br \/>\n18\/06\/2009 is calculated to be one year by the learned Judge).\n<\/p>\n<p id=\"p_2\">3.0\tAfter<br \/>\nthis order was passed on 11th February 2010, the present<br \/>\npetitioner found time to complain that amount of Rs.200\/- is not paid<br \/>\nand the workman is not cross-examined.  It was only on 18th<br \/>\nAugust 2011 i.e. well after 1\u00bd years and therefore, on this<br \/>\nlethargy of the petitioner, the petition is not entertained and the<br \/>\nsame is dismissed.\n<\/p>\n<p id=\"p_3\">3.1\tHowever,<br \/>\non a request made by the learned advocate for the petitioner it is<br \/>\nclarified that, non-entertainment of this petition should not be a<br \/>\nground for the learned Judge for not proceeding with the Reference of<br \/>\n2003 as expeditiously as possible.\n<\/p>\n<p id=\"p_4\">[<br \/>\nRavi R.
