Justice M.SASIDHARAN NAMBIAR\n\n Dated :29\/10\/2009\n\n O R D E R\n              M.SASIDHARAN NAMBIAR,J.\n            ===========================\n            W.P.(C)No.26476       OF 2009\n            ===========================\n\n     Dated this the 29th day of October,2009\n\n                      JUDGMENT\n<\/pre>\n<p id=\"p_1\">    Petitioner  the  de   facto  complainant  in  Crime<\/p>\n<p>744\/2007 of Kottayam West Police Station had earlier<\/p>\n<p>approached this court by filing Crl.M.C.4197\/2008 for a<\/p>\n<p>direction to handover the investigation to another<\/p>\n<p>agency.   By Ext.P3 order this court     found that a<\/p>\n<p>perusal  of  the  records  revealed  that  no  serious,<\/p>\n<p>pointed or efficient efforts have been employed by the<\/p>\n<p>second  respondent  to  seize  the  original  power  of<\/p>\n<p>attorney,  inspite   of   directions  issued   by   the<\/p>\n<p>Magistrate  by  more  than  one  year  and  the  proper<\/p>\n<p>investigation is not being conducted, directed the<\/p>\n<p>first respondent Dy.SP to conduct the investigation<\/p>\n<p>personally and submit periodical report every month to<\/p>\n<p>the Magistrate with a direction   that the   Magistrate<\/p>\n<p>is to monitor the investigation.     This petition is<\/p>\n<p>filed under <a href=\"\/doc\/1712542\/\" id=\"a_1\">Article 226<\/a> of the Constitution of India<\/p>\n<p>complaining that no effective investigation is being<\/p>\n<p>carried out and therefore a writ of mandamus is to be<\/p>\n<p>issued commanding   second respondent to handover the<\/p>\n<p><span class=\"hidden_text\" id=\"span_1\">W.P(C)26476\/2009               2<\/span><\/p>\n<p>investigation to a senior and efficient officer of the<\/p>\n<p>Crime Branch.\n<\/p>\n<p id=\"p_1\">     2. A statement is filed by the Deputy Superintendent of<\/p>\n<p>Police, Kottayam who was directed to investigate the case<\/p>\n<p>by Ext.P3 order expressing his failure to obtain possession<\/p>\n<p>of the original power of attorney and stating that though a<\/p>\n<p>copy of the power of attorney is available, with that copy<\/p>\n<p>the signature cannot be compared.   Though it is stated that<\/p>\n<p>investigation is being continued, the statement does not<\/p>\n<p>inspire    confidence that the investigation would yield the<\/p>\n<p>desired result.\n<\/p>\n<p id=\"p_2\">     3.    On hearing the learned counsel appearing for the<\/p>\n<p>petitioner and the learned Government pleader and Ext.P3<\/p>\n<p>order passed earlier and the statement filed by the Deputy<\/p>\n<p>Superintendent of Police, Kottayam, it is clear that the<\/p>\n<p>investigation is not properly carried out.    Inspite of the<\/p>\n<p>direction to the Magistrate to monitor the investigation it<\/p>\n<p>is clear    that the stage of the investigation is  where it<\/p>\n<p>was when    Ext.P3 order was passed.
