Since there was some<br \/>\n\ttypographical error in the address of the respondent &#8211;<br \/>\n\tworkman, leave to correct the address of the respondent was granted<br \/>\n\ton 19.10.2010 and fresh notice was issued making it returnable on<br \/>\n\t26.10.2010. The Board shows that notice still remain unserved<br \/>\n\tbecause of incomplete address as per the Bailiff&#8217;s report.  Even the<br \/>\n\trespondent is not residing at the place shown in the cause-title of<br \/>\n\tthe petition.\n<\/p>\n<p id=\"p_1\">\tMr. Ramanandan<br \/>\n\tSingh, learned advocate appearing for the petitioner states that the<br \/>\n\taddress given in the cause title is the address which the respondent<br \/>\n\thimself has given in his statement of claim before the Industrial<br \/>\n\tTribunal.  He further submitted that  even before the Industrial<br \/>\n\tTribunal, the respondent never remained present after filing the<br \/>\n\tstatement of claim.  The impugned order is passed below Exh.87.<br \/>\n\tHowever, Exh.87 is totally different.\n<\/p>\n<p id=\"p_2\">Be<br \/>\n\tthat as it may, the respondent is required to be served before any<br \/>\n\torder is passed in this petition.  Hence, the petitioner is hereby<br \/>\n\tpermitted for substituted service.  For this purpose, the petitioner<br \/>\n\tshall issue an advertisement in the newspaper indicating the date of<br \/>\n\thearing of this petition on 29.12.2010.  It should also be made<br \/>\n\tclear in the advertisement that if the respondent will not remain<br \/>\n\tpresent on the date of hearing of the petition, the Court will<br \/>\n\tproceed ex-parte and pass appropriate order.  The petitioner shall<br \/>\n\tplace the copy of the advertisement along with the affidavit of<br \/>\n\tpublication.
