JUSTICE ABHILASHA KUMARI\n\t\t\n\t\n\n \n\n \n \n\n\n \n\nDate\n: 16\/11\/2011  \nORAL ORDER<\/pre>\n<p id=\"p_1\">1.\tThis<br \/>\npetition under <a href=\"\/doc\/1712542\/\" id=\"a_1\">Article-226<\/a> of the Constitution of India has been<br \/>\nfiled, with the following prayers :\n<\/p>\n<p id=\"p_1\">&#8220;(a)\tYour<br \/>\nLordship may be pleased to issue a writ of certiorari or a writ in<br \/>\nthe nature of certiorari or any other appropriate writ order or<br \/>\ndirection and be pleased to quash and set aside the impugned<br \/>\ndetention list dated 14.09.2011 (Annexure-Q) qua the petitioner or<br \/>\nYour Lordships may be pleased to issue a writ of mandamus or writ in<br \/>\nthe nature of mandamus or any other appropriate writ, order or<br \/>\ndirection and be pleased to direct the GTU to delete the name of the<br \/>\npetitioner from the detention list dated 14.09.2011 produced at<br \/>\nAnnexure-Q and be pleased to direct GTU to issue Exam Form to the<br \/>\npetitioner through Smt.N.M.Padalia Pharmacy College forthwith and be<br \/>\npleased to direct GTU to allow the petitioner to appear in 5th<br \/>\nSemester Regular External Exam of B.Pharm which commences from<br \/>\n19.11.2011 in the interest of justice.\n<\/p>\n<p id=\"p_2\">(b)\tThe<br \/>\npetitioner has cleared Midterm Internal Remedial Exam of 3rd<br \/>\nSemester B. Pharm from Smt.N.M.Padalia College (Marks are produced at<br \/>\nAnnexure-L). There after GTU has wrongly declared the petitioner<br \/>\nfailed in 6 Theory subjects in the Markshit of 3rd<br \/>\nSemester External Exam of B.Pharm.\n<\/p>\n<p id=\"p_3\">\tTherefore,<br \/>\nYour Lordship may be pleased to issue a writ of mandamus or writ in<br \/>\nthe nature of mandamus or any other appropriate writ, order of<br \/>\ndirection and be pleased to direct the GTU to correct the above said<br \/>\nmistake and may be directed to issue New Markship of 3rd<br \/>\nSemester External Exam of B. Pharm with correction to the petitioner.\n<\/p>\n<p id=\"p_4\">(c)\tYour<br \/>\nLordship may be pleased stay the implementation, execution and<br \/>\noperation of the impugned detention list dated 14.09.2011<br \/>\n(Annexure-Q) qua the petitioner be pleased to direct GTU to issue<br \/>\nExam Form to the petitioner through Smt.N.M.Padalia Pharmacy College<br \/>\nforthwith and be pleased to direct GTU to allow the petitioner to<br \/>\nappear in 5th Semester Regular External Exam of B.Pharm<br \/>\nwhich commences from 19.11.2011 pending admission, hearing and final<br \/>\ndisposal of this petition, in the interest of justice.\n<\/p>\n<p id=\"p_5\">(d)\tYour<br \/>\nLordship may be pleased to grant ad-interim relief and interim relief<br \/>\nin terms of para 7(a), 7(b) and para 7(c), in the interest of<br \/>\njustice.\n<\/p>\n<p id=\"p_6\">(e)\tYour<br \/>\nLordship may be pleased grant such other and further relief as is<br \/>\ndeemed fit in the interest of justice.&#8221;\n<\/p>\n<p id=\"p_7\">2.\tIt<br \/>\nis submitted by Mr.Mahesh Bhavsar, learned advocate for the<br \/>\npetitioner, that though the petitioner has passed the Mid Semester<br \/>\nInternal Remedial Examination for the 3rd Semester from<br \/>\nSmt.N.M.Padalia Pharmacy College, he has been wrongly declared as<br \/>\nhaving failed by respondent No.2 &#8211; Gujarat Technological<br \/>\nUniversity, vide marksheet dated 09.07.2011 (Annexure-O). It is<br \/>\nfurther submitted that the respondent University has committed a<br \/>\nmistake by declaring the petitioner to have failed in six theory<br \/>\nsubjects, and because of the said mistake, the petitioner is not<br \/>\nbeing permitted to appear in the 5th Semester (B.Pharmacy)<br \/>\nRegular External Examinations, which are to commence, with effect<br \/>\nfrom 19.11.2011. The learned advocate for the petitioner submits that<br \/>\nthe interest of justice would be met, if the petitioner is permitted<br \/>\nto approach the Registrar of respondent No.2 &#8211; University, by<br \/>\nfiling a representation, who may be directed to consider the same,<br \/>\nwithin a time-bound period, after granting an opportunity of personal<br \/>\nhearing to the petitioner, considering that the examinations are to<br \/>\ncommence with effect from 19.11.2011.\n<\/p>\n<p id=\"p_8\">3.\tUpon<br \/>\nthe above statement being made by the learned advocate for the<br \/>\npetitioner, the following order is passed :\n<\/p>\n<p id=\"p_9\">\tIf<br \/>\nthe petitioner approaches the Registrar of respondent No.2 &#8211;<br \/>\nUniversity by way of a representation, latest by 17.11.2011, the<br \/>\nRegistrar shall consider and decide the same, in accordance with the<br \/>\nStatutes\/Rules\/Regulations of the University, and in accordance with<br \/>\nlaw, after granting an opportunity of hearing to the petitioner.
