Justice V.GIRI\n\n Dated :04\/<a href=\"\/doc\/1390448\/\" id=\"a_1\">08\/2009\n\n O R D E R\n                       V.GIRI, J.\n         ----------------------------------------\n               W.P.(C).No<\/a>.22022 of 2009\n         ----------------------------------------\n         Dated this the 4th day of August, 2009.\n\n\n                      JUDGMENT\n<\/pre>\n<p id=\"p_1\">         The petitioners are aggrieved by Ext.P7<\/p>\n<p>building permit granted in favour of the 8th<\/p>\n<p>respondent.     They sought for revocation of the<\/p>\n<p>permit granted by moving an application before the<\/p>\n<p>original authority.   The said application has been<\/p>\n<p>rejected under Ext.P12, passed after hearing the<\/p>\n<p>petitioners as also the 8th respondent.<\/p>\n<p id=\"p_1\">         2. The petitioners have also moved the<\/p>\n<p>District Collector, Thiruvananthapuram, seeking to<\/p>\n<p>cancel the mutation, which according to them, has<\/p>\n<p>been effected at the instance of the 8th respondent.<\/p>\n<p>This writ petition has been filed challenging Exts.P7<\/p>\n<p>and P12 and also praying for a direction that Ext.P13<\/p>\n<p>representation filed before the District Collector<\/p>\n<p>shall be looked into.\n<\/p>\n<p id=\"p_2\">W.P.(C).No.22022 of 2009<\/p>\n<p>                         :: 2 ::\n<\/p>\n<p id=\"p_3\">\n<p id=\"p_4\">         3. I am not inclined to consider the<\/p>\n<p>petitioners&#8217;  contention      on merits,   since  the<\/p>\n<p>petitioner have an efficacious alternate remedy.<\/p>\n<p id=\"p_5\">         4. Accordingly, if the petitioners file an<\/p>\n<p>appeal challenging Ext.P7 within three weeks from<\/p>\n<p>today before the appellate tribunal, then the<\/p>\n<p>Tribunal shall consider the said appeal, as presented<\/p>\n<p>in time and proceed to pass appropriate orders, after<\/p>\n<p>hearing both the parties, within three months<\/p>\n<p>thereafter. The petitioners      may challenge the<\/p>\n<p>correctness of Ext.P12 also in the said appeal.<\/p>\n<p id=\"p_6\">         5. In the meanwhile, the District Collector<\/p>\n<p>the 3rd respondent shall look into Ext.P13 and take<\/p>\n<p>an appropriate decision thereon within two months<\/p>\n<p>from the date of production of a copy of this<\/p>\n<p>judgment, along with a copy of the writ petition. If<\/p>\n<p>the District Collector    feels that any subordinate<\/p>\n<p>officer to him has to pass orders on Ext.P13, then it<\/p>\n<p>is open to the District Collector to forward Ext.P13<\/p>\n<p>W.P.(C).No.22022 of 2009<\/p>\n<p>                           :: 3 ::\n<\/p>\n<p id=\"p_7\">\n<p>to such subordinate authority.
