Justice KURIAN JOSEPH\n\n Dated :03\/06\/2009\n\n O R D E R\n             S.R.Bannurmath, C.J. &amp; Kurian Joseph, J.\n                 ------------------------------------------\n                     W.P.(C) No.4125 of 2009\n                 ------------------------------------------\n               Dated, this the 3rd day of June, 2009\n\n                            JUDGMENT\n<\/pre>\n<p id=\"p_1\">Kurian Joseph, J.\n<\/p>\n<p id=\"p_1\">           This public interest litigation is filed mainly with the<\/p>\n<p>following prayer:\n<\/p>\n<blockquote id=\"blockquote_1\"><p>                &#8220;issue a writ of mandamus or any other<\/p>\n<p>           appropriate writ, order or direction directing the<\/p>\n<p>           respondents to forthwith pass immediate orders<\/p>\n<p>           prohibiting overtaking by stage carriages within<\/p>\n<p>           the Ernakulam city limits and also to pass<\/p>\n<p>           necessary orders as well as to take obligatory<\/p>\n<p>           measures to see that such orders are strictly<\/p>\n<p>           complied with.&#8221;<\/p><\/blockquote>\n<p id=\"p_2\">\n<p id=\"p_3\">           2. On behalf of the third respondent a counter affidavit<\/p>\n<p>has been filed. In paragraph 4 of the counter affidavit it is stated as<\/p>\n<p>follows:\n<\/p>\n<p id=\"p_4\">W.P.(C) No.4125 of 2009\n<\/p>\n<p id=\"p_5\">                              &#8211; 2 &#8211;\n<\/p>\n<p id=\"p_6\">         &#8220;There are various categories of stage carriage<\/p>\n<p>         operating in the city limit like Express, Ordinary,<\/p>\n<p>         Limited Stop, Super Fast, etc. If the request of<\/p>\n<p>         the petitioner to prohibit overtaking by stage<\/p>\n<p>         carriages within the city is enforced, then there<\/p>\n<p>         will not be any difference between the long<\/p>\n<p>         distance stage carriages and short distance line<\/p>\n<p>         services. As a result passengers of long distance<\/p>\n<p>         stage carriages will not get the benefit of such<\/p>\n<p>         services.  Besides, the destination of different<\/p>\n<p>         stage carriages are different.     Hence a total<\/p>\n<p>         prohibition of overtaking of stage carriages may<\/p>\n<p>         not be practical as the buses will have to wait till<\/p>\n<p>         bus moving in front moves off even if it is<\/p>\n<p>         proceeding to a different destination which will<\/p>\n<p>         cause traffic congestion in the city. However<\/p>\n<p>         rash and negligent driving has been checked by<\/p>\n<p>         the respondents with the available infrastructure<\/p>\n<p>         and personals.     Government also have taken<\/p>\n<p>         several measures like setting up Kerala Road<\/p>\n<p>         Safety Authority exclusively for checking road<\/p>\n<p>         accidents.&#8221;\n<\/p>\n<p id=\"p_7\">W.P.(C) No.4125 of 2009\n<\/p>\n<p id=\"p_8\">                               &#8211; 3 &#8211;\n<\/p>\n<p id=\"p_9\">           3.
