That impugned order dated 07.02.2007 is<br \/>\nissued by Police Commissioner, Ahmedabad in exercise of his powers<br \/>\nconferred under the provisions of section 3 of the Gujarat Prevention<br \/>\nof Anti-Social Activities Act, 1985 (&#8220;PASA&#8221; for short)  on<br \/>\nthe basis that the petitioner was found to be repeatedly indulging in<br \/>\nanti-social activity of bootlegging and an offence being<br \/>\nIII-C.R.No.5010 of 2006 under  the <a href=\"\/doc\/790355\/\" id=\"a_1\">Prohibition Act<\/a> was registered on<br \/>\n29.12.2006 against the petitioner in D.C.B. Police Station of<br \/>\nAhmedabad.  According to the grounds of detention supplied with the<br \/>\nimpugned order, even as the aforesaid offence was being investigated,<br \/>\nother actions under the <a href=\"\/doc\/790355\/\" id=\"a_2\">Prohibition Act<\/a> were not possible and alcohol<br \/>\nbeing injurious to health, there was likelihood of danger to public<br \/>\nhealth on account of consumption of illicit liquor in which the<br \/>\npetitioner was dealing.  It is further stated that possibility of the<br \/>\npetitioner continuing in anti-social activities could not be denied<br \/>\nand hence it was found to be necessary to detain the petitioner after<br \/>\nconsidering the documents and statements which were relied upon and<br \/>\nsupplied to the petitioner.\n<\/p>\n<p id=\"p_2\">2.\t\tEven<br \/>\nas the present petition was admitted on 01.03.2007 and Rule was made<br \/>\nreturnable on 11.05.2007 and an affidavit-in-reply of the detaining<br \/>\nauthority was ready and executed on 24.07.2007, it was submitted to<br \/>\nthis court and copy thereof supplied to the petitioner only on<br \/>\n30.8.2007.  It is stated in that affidavit, inter alia, that<br \/>\nprima facie involvement of the petitioner was established in<br \/>\nthe offence registered against him.  It is further stated: &#8220;I<br \/>\nhad carefully examined the documents relating to the one case<br \/>\nregistered against the detenu and from those materials, it is clear<br \/>\nthat the detenu falls within the definition of &#8220;bootlegger&#8221;<br \/>\nas defined under <a href=\"\/doc\/40808\/\" id=\"a_3\">section 2<\/a> (b) of the PASA Act. Therefore, on<br \/>\ncarefully scrutinizing, studying, examining and considering the<br \/>\nmaterials placed before me including the papers pertaining to the<br \/>\nabove case and after applying my mind to the facts of the case, I<br \/>\ncame to the conclusion that the detenu is dealing in illegal liquor<br \/>\nbusiness and he is disturbing the public order, public peace and<br \/>\npublic health and it is likely that continuance of his anti-social<br \/>\nand boot-legging activities may cause grave or widespread danger to<br \/>\nlife, property and public health. Therefore, after subjectively<br \/>\nsatisfying myself that the anti-social and boot-legging activities of<br \/>\nthe detenu cannot be curbed or prevented immediately by resorting to<br \/>\nless drastic remedy of taking action under the ordinary law, as a<br \/>\npreventive measure, I had passed the order of detention against the<br \/>\ndetenu under the PASA Act with a view to immediately prevent him from<br \/>\ncontinuing such illegal, anti-social and bootlegging activities which<br \/>\nare prejudicial to the maintenance of public order and the said order<br \/>\nis passed with full application of mind and in compliance and in<br \/>\nconsonance with the provisions of the PASA Act as well as the<br \/>\nConstitution of India and the said order is legal, valid and proper.&#8221;\n<\/p>\n<p id=\"p_3\">3.\t\tIn the above facts,<br \/>\nit was sought to be argued on behalf of the respondents that danger<br \/>\nto public health caused by the activity of bootlegging by the<br \/>\npetitioner substantiated the assumption of likelihood of public order<br \/>\nbeing adversely affected and, for that reason, the subjective<br \/>\nsatisfaction about the necessity of preventing the petitioner from<br \/>\nacting in any manner prejudicial to the maintenance of public order<br \/>\nand the impugned order directing his detention were legal and<br \/>\njustified.\n<\/p>\n<p id=\"p_4\">4.\t\tAs<br \/>\nheld by this court in Amarbhai Kanjibhai Nayak v. Commissioner<br \/>\nof Police, Ahmedabad City &amp; Ors. [1993 (3) G.L.R. 2703]<br \/>\nand in <a href=\"\/doc\/702717\/\" id=\"a_4\">Sohanlal Surajaram  Visnoi v. State of Gujarat<\/a>   [2004<br \/>\n(2) G.L.R. 1051], \tsolitary incident of violation of<br \/>\nprohibition law, normally, without anything more, would not be a<br \/>\nproblem to the maintenance of public order and, for such solitary<br \/>\nincident, no person can be detained under the Act.  It was also seen<br \/>\nfrom analysis of the provisions of sub-section (4) of <a href=\"\/doc\/1422776\/\" id=\"a_5\">section 3<\/a> and<br \/>\nthe Explanation appended thereto that the presumption of likelihood<br \/>\nof public order being adversely affected could arise, if danger were<br \/>\ncaused to life or public health, but such danger has to be grave or<br \/>\nwidespread for the mandatory presumption of likelihood of public<br \/>\norder being adversely affected.  In the facts of the present case,<br \/>\nnothing from the material on record could substantiate or justify the<br \/>\npresumption of grave or widespread danger to life or public health<br \/>\nand hence, the presumption of likelihood of public order being<br \/>\nadversely affected could not have been legally availed by the<br \/>\ndetaining authority for the purpose of arriving at a subjective<br \/>\nsatisfaction.\n<\/p>\n<p id=\"p_5\">5.\t\tTherefore,<br \/>\nin the facts and circumstances, the impugned order dated 07.02.2007<br \/>\nof preventive detention is found and held to be unsustainable in law<br \/>\nand set aside with the direction that the petitioner shall be set at<br \/>\nliberty forthwith unless required to be detained in connection with<br \/>\nany other case.  Rule is made absolute accordingly.
