Aiyub &amp; Anr.\n<\/p>\n<p id=\"p_1\">                                              Versus<br \/>\n                                       The State Of Bihar<\/p>\n<p id=\"p_2\">2.   13.10.2011.                Heard     learned     counsels       for     the<\/p>\n<p>                   petitioners and the State.\n<\/p>\n<p id=\"p_3\">                                The     petitioners       are     apprehending<\/p>\n<p>                   their arrest in connection with Jokihat P.S.<\/p>\n<p>                   Case No. 31 of 2002 corresponding to G.R.<\/p>\n<p>                   No. 393 of 2002 arising                out of     complaint<\/p>\n<p>                   case     no.    2153C    of    2000    registered        under<\/p>\n<p>                   <a href=\"\/doc\/1436241\/\" id=\"a_1\">Sections 420<\/a>\/<a href=\"\/doc\/37788\/\" id=\"a_1\">34<\/a> of the Indian Penal Code.<\/p>\n<p id=\"p_4\">                                It is alleged that the informant had<\/p>\n<p>                   executed a deed of interest by mortgaging<\/p>\n<p>                   her land for taking Rs. 25,000\/- from the<\/p>\n<p>                   petitioners on 17.07.1991 and on 09.06.2000<\/p>\n<p>                   when the informant went to return the money<\/p>\n<p>                   it     was     found    that     the     sale    deed     was<\/p>\n<p>                   executed in favour of the petitioner no.1<\/p>\n<p>                   and his brother.\n<\/p>\n<p id=\"p_5\">                                It is submitted by learned counsel<\/p>\n<p>                   for     petitioners       that     the       informant    has<\/p>\n<p>                   retracted from her initial version and to<\/p>\n<p>                   that effect a compromise petition has been<\/p>\n<p>                   filed before the learned court below.<\/p>\n<p id=\"p_6\">                                On merits, it appears that for cause<\/p>\n<p>                   of action of 1991 i.e., after nine years,<\/p>\n<p>                   the complaint was filed which got registered<br \/>\n<span class=\"hidden_text\" id=\"span_1\">                             2<\/span><\/p>\n<p>        as police case in 2002 which clouds bonafide<\/p>\n<p>        of accusation.\n<\/p>\n<p id=\"p_7\">                  This      court          is      not       inclined      to<\/p>\n<p>        interfere       only          because          the      case    was<\/p>\n<p>        instituted in 2002. On merits, it appears<\/p>\n<p>        that it is a fit case for grant of regular<\/p>\n<p>        bail.\n<\/p>\n<p id=\"p_8\">                  Let the learned court below consider<\/p>\n<p>        the     regular         bail       application            of    the<\/p>\n<p>        petitioners and try to dispose off the same<\/p>\n<p>        preferably        on         the      same       day      if     the<\/p>\n<p>        petitioners surrender and pray for regular<\/p>\n<p>        bail    within    a      period         of     six    weeks     from<\/p>\n<p>        today.\n<\/p>\n<p id=\"p_9\">                  With      the        above          observation,       the<\/p>\n<p>        anticipatory            bail       application           of      the<\/p>\n<p>        petitioners is disposed off.<\/p>\n<pre id=\"pre_1\">                  Let     the         order       be     faxed    to     the\n\n        learned   C.J.M.,            Araria      in     connection      with\n\n        Jokihat      P.S.         case          No.      31      of     2002\n\n        corresponding           to     G.R.       No.     393    of     2002\n\n<\/pre>\n<p id=\"p_10\">        arising out of complaint case no. 2153C of<\/p>\n<p>        2000 at the cost of the petitioners.<\/p>\n<p>U.
