RESPONDENTS.\n                                 -----------\n<\/pre>\n<p id=\"p_1\">02\/   19.11.2010            Heard counsel for the appellant.<\/p>\n<p id=\"p_1\">                            The appellant is the complainant of complaint<\/p>\n<p>                   case, on the basis of which Dumara P.S. Case No.<\/p>\n<p>                   195 of 2000 was instituted against respondent no. 2<\/p>\n<p>                   alleging offence under <a href=\"\/doc\/695990\/\" id=\"a_1\">Section 364<\/a> of the Indian Penal<\/p>\n<p>                   Code. The case of prosecution as disclosed in the<\/p>\n<p>                   complaint is that his 13 years son Md. Mannaur, a<\/p>\n<p>                   student of Class VIII, was kidnapped by the accused-<\/p>\n<p>                   respondent. Initially the complainant was asked by the<\/p>\n<p>                   accused persons to allow his son to go to Bombay, for<\/p>\n<p>                   engagement in Zari embroidery work, for 1,000\/-<\/p>\n<p>                   rupees    per   month    as   remuneration,   but   the<\/p>\n<p>                   complainant was not willing to send his son, being<\/p>\n<p>                   apprehensive at this feet that his son&#8217;s kidney may be<\/p>\n<p>                   sold by the accused persons or he may be sold to<\/p>\n<p>                   some foreigners. The accused persons, thereafter,<\/p>\n<p>                   without consent of the complainant, took his son in his<br \/>\n<span class=\"hidden_text\" id=\"span_1\">                   2<\/span><\/p>\n<p>absence. When the complainant came to know about<\/p>\n<p>that fact, he made a search at several places and also<\/p>\n<p>at places of some of the relatives. Persons, who had<\/p>\n<p>seen taking away of his son by the accused persons,<\/p>\n<p>disclosed that Mannaur has been taken by the<\/p>\n<p>accused persons for selling his kidney or for his<\/p>\n<p>murder or to sell him to some foreigners. The<\/p>\n<p>complaint case was filed before the C.J.M., Sitamarhi,<\/p>\n<p>who sent the complaint for instituting a police case<\/p>\n<p>under <a href=\"\/doc\/99487\/\" id=\"a_1\">Section 156(3)<\/a> of the Cr.P.C. and Dumara P.S.<\/p>\n<p>Case No. 195 of 2000 was registered for offence<\/p>\n<p>under <a href=\"\/doc\/1892519\/\" id=\"a_2\">Section 363A<\/a>\/<a href=\"\/doc\/37788\/\" id=\"a_3\">34<\/a> of the IPC. The charge sheet<\/p>\n<p>was submitted under <a href=\"\/doc\/1892519\/\" id=\"a_4\">Section 363A<\/a>\/<a href=\"\/doc\/37788\/\" id=\"a_5\">34<\/a> of the IPC,<\/p>\n<p>cognizance was taken and thereafter the case was<\/p>\n<p>committed to the Court of Sessions for trial.<\/p>\n<p id=\"p_2\">        The   prosecution    examined     altogether   8<\/p>\n<p>witnesses, who are the complainant himself and the<\/p>\n<p>victim boy. Other witnesses were also examined but<\/p>\n<p>their evidence is not much of value. So for evidence of<\/p>\n<p>victim boy Md. Mannaur as P.W. 5 is concerned, is<\/p>\n<p>discussed in para 18 of the judgment. He has given<\/p>\n<p>details of his kidnapping by the accused persons, but<br \/>\n<span class=\"hidden_text\" id=\"span_1\">                  3<\/span><\/p>\n<p>his   evidence   discloses   that   he   himself   had<\/p>\n<p>accompanied the accused persons from Patna to<\/p>\n<p>Bombay and subsequently himself came back to his<\/p>\n<p>village. There is nothing on record to show that when<\/p>\n<p>he came back from Bombay to his village any<\/p>\n<p>information was given to the police and he was<\/p>\n<p>produced before the Magistrate.     The Investigating<\/p>\n<p>Officer of this case Murari Sharma has been examined<\/p>\n<p>as C.W. 1. He has stated that during investigation he<\/p>\n<p>came to know that the kidnapped boy is residing at his<\/p>\n<p>home and he recovered the victim boy from Idgah<\/p>\n<p>where he was grazing she buffalo. The recovery was<\/p>\n<p>made in presence of Iliyas and Awadh Kishsore. He<\/p>\n<p>also gave evidence before the Magistrate that the<\/p>\n<p>kidnapped boy was recovered while he was grazing<\/p>\n<p>she buffalo.\n<\/p>\n<p id=\"p_3\">        The entire evidence as discussed in the<\/p>\n<p>impugned judgment indicates that the informant and<\/p>\n<p>the accused persons are on inimical terms and several<\/p>\n<p>criminal cases had been instituted by them against<\/p>\n<p>each other. In the background of this admitted enmity<\/p>\n<p>the case regarding kidnapping of his son was filed by<br \/>\n<span class=\"hidden_text\" id=\"span_2\">                          4<\/span><\/p>\n<p>       the informant for putting pressure on the accused<\/p>\n<p>       persons, so far previous criminal cases are concerned.<\/p>\n<p>       In the detailed judgment each and every evidence has<\/p>\n<p>       been considered and discussed by the trial court and<\/p>\n<p>       we find that there is no perversity in the judgment.
