Justice THOMAS P.JOSEPH\n\n Dated :30\/11\/2010\n\n O R D E R\n                   THOMAS P JOSEPH, J.\n\n                  ----------------------------------------\n\n                      O.P(C).No.927 of 2010\n\n                  ---------------------------------------\n\n             Dated this 30th day of November, 2010\n\n                            JUDGMENT\n<\/pre>\n<p id=\"p_1\">      Plaintiff in O.S.No.229 of 2002 of the court of learned<\/p>\n<p>Additional Sub Judge-I, Thiruvananthapuram is the petitioner<\/p>\n<p>before me challenging Ext.P8, common order to the extent it<\/p>\n<p>concerned dismissal of I.A.No.4583 of 2006. Petitioner is an<\/p>\n<p>Advocate practising in the courts at Thiruvananthapuram and<\/p>\n<p>sued the defendants for realisation of his professional fee and for<\/p>\n<p>damages. Respondent was impleaded as defendant No.12. In the<\/p>\n<p>course of the suit petitioner filed application to serve<\/p>\n<p>interrogatories on the respondent and that application was<\/p>\n<p>allowed. Pursuant to that order, respondent filed Exts.P2 and P3,<\/p>\n<p>counter affidavits. Petitioner was not satisfied with the said<\/p>\n<p>affidavits and thereon requested the court to direct respondent to<\/p>\n<p>file proper affidavit and produce documents. Petitioner says that<\/p>\n<p>accordingly, court directed respondent to file proper affidavit and<\/p>\n<p>produce documents but in spite of repeated directions and giving<\/p>\n<p>sufficient opportunity respondent did not comply with the said<\/p>\n<p>orders. Thereon, petitioner filed Ext.P5, I.A.No.4583 of 2006 for<\/p>\n<p>examination of respondent\/defendant No.12 on Exts.P2 and P3,<\/p>\n<p>O.P(C).No.927 of 2010<br \/>\n<span class=\"hidden_text\" id=\"span_1\">                                : 2 :<\/span><\/p>\n<p>counter affidavits filed on its behalf. Petitioner also filed<\/p>\n<p>I.A.No.1451 of 2010 for examination of defendant No.1. Yet<\/p>\n<p>another application filed is Ext.P7, intended to strike off defence<\/p>\n<p>of respondent\/defendant No.12 for alleged non compliance of the<\/p>\n<p>order to file proper affidavit and produce documents. Learned<\/p>\n<p>counsel contends that in the meantime petitioner was examined<\/p>\n<p>as PW1 on 28-01-2009 and the case was posted on 09-02-2009<\/p>\n<p>for further evidence. Now, before examination of witnesses on<\/p>\n<p>the side of petitioner is completed the court has posted the case<\/p>\n<p>for evidence of defendants. Challenge is to Ext.P8, order to the<\/p>\n<p>extent it concerned Ext.P5, I.A.No.4583 of 2006. Learned counsel<\/p>\n<p>has contended that under Rule 2 of Order XIX and Rules 11 and<\/p>\n<p>21 of Order XI of the Code of Civil Procedure (for short, &#8220;the<\/p>\n<p>Code&#8221;) court ought to have exercised the discretion in favour of<\/p>\n<p>petitioner to permit him cross examine respondent regarding<\/p>\n<p>Exts.P2 and P3, counter affidavits. Learned counsel has also<\/p>\n<p>placed reliance on the decision in Jortin Antony Vs. Sree<\/p>\n<p>Padmanabha D. Marthanda Varma (2001(1) KLT 511) and<\/p>\n<p>Suresh Babu Vs. Food Corporation of India (2007(4) KLT<\/p>\n<p id=\"p_1\">135).\n<\/p>\n<p id=\"p_2\">O.P(C).No.927 of 2010<br \/>\n<span class=\"hidden_text\" id=\"span_1\">                                : 3 :<\/span><\/p>\n<p id=\"p_3\">      2.    Ext.P8, order to the extent I.A.No.1451 of 2010 for<\/p>\n<p>examination of defendant No.1 was dismissed, is not under<\/p>\n<p>challenge. Challenge is to the dismissal of Ext.P5, I.A.No.4583 of<\/p>\n<p>2006. No doubt, it is not as if under no circumstances a party<\/p>\n<p>has no right to cross examine the opposite party but normally a<\/p>\n<p>party is not allowed to examine the opposite party as his witness.<\/p>\n<p>It depends on the facts and circumstances of each case whether<\/p>\n<p>such a power should be exercised and court should permit the<\/p>\n<p>party to examine the opposite party as witness of his side. Under<\/p>\n<p>Rule 2 of Order XIX of the code where the court is authorised to<\/p>\n<p>take evidence by affidavit, the court has the discretion to permit<\/p>\n<p>a party to cross examine the opposite party on the affidavit he<\/p>\n<p>has sworn. It is not as if the party has a right for examination of<\/p>\n<p>the deponent but, it is a case where the court is vested with the<\/p>\n<p>power to summon deponent for examination. It is not disputed<\/p>\n<p>that a reply to the interrogatories can be in the form of affidavit<\/p>\n<p>as stated in Rule 11 of Order XI of the Code. If that be so, it is not<\/p>\n<p>a case where petitioner has any right for examination of<\/p>\n<p>respondent on the counter affidavit.\n<\/p>\n<p id=\"p_4\">      3.    Learned Sub Judge has stated reasons why cross<\/p>\n<p>examination of respondent is not to be permitted. That discretion<\/p>\n<p>O.P(C).No.927 of 2010<br \/>\n<span class=\"hidden_text\" id=\"span_2\">                               : 4 :<\/span><\/p>\n<p>having been exercised by the court below in the proper manner, I<\/p>\n<p>do not think that it is case where this court should exercise<\/p>\n<p>supervisory jurisdiction under <a href=\"\/doc\/1331149\/\" id=\"a_1\">Article 227<\/a> of the Constitution.<\/p>\n<p>The challenge to the common order to the extent it concerned<\/p>\n<p>dismissal of I.A.No.4583 of 2006 has to fail.\n<\/p>\n<p id=\"p_5\">      4.    Learned counsel submits that Ext.P7, application to<\/p>\n<p>strike off defence of respondents as provided under Rule 21 of<\/p>\n<p>Order XI of the Code is pending consideration before the learned<\/p>\n<p>Sub Judge. If any such application is pending necessarily learned<\/p>\n<p>Sub Judge has to dispose of that application as provided under<\/p>\n<p>law and I direct learned Sub Judge to do so.\n<\/p>\n<p id=\"p_6\">      5.    Yet another grievance aired by learned counsel is that<\/p>\n<p>even before evidence of petitioner was completed the case is<\/p>\n<p>posted for evidence of defendants. Learned counsel contends that<\/p>\n<p>the case is posted for evidence of defendants this day. Learned<\/p>\n<p>counsel has invited my attention to Ext.P4, witness list where<\/p>\n<p>sixteen witnesses are seen cited on the side of petitioner.<\/p>\n<p>Learned counsel requested that petitioner may be given<\/p>\n<p>opportunity to adduce evidence. I direct learned Sub Judge to<\/p>\n<p>give opportunity to the petitioner to adduce his evidence.      If<\/p>\n<p>necessary, it will be open to the petitioner to seek review of any<\/p>\n<p>O.P(C).No.927 of 2010<br \/>\n<span class=\"hidden_text\" id=\"span_3\">                                : 5 :<\/span><\/p>\n<p>order posting the case for evidence of defendants and seek<\/p>\n<p>opportunity for examination of his witness.
