Devnani, learned advocate for the petitioner and Mr.Janak<br \/>\nRaval, learned AGP for the respondents. Rule. Mr.Janak Raval,<br \/>\nlearned AGP, waives service of notice of Rule on behalf of the<br \/>\nrespondents.\n<\/p>\n<p id=\"p_1\">2.\tAt<br \/>\nthe request of the learned advocate appearing for the petitioner and<br \/>\nwith the consent of the advocates appearing for the contesting<br \/>\nparties, the matter is taken up for final hearing and decision today.\n<\/p>\n<p id=\"p_2\">3.\tPresent<br \/>\npetition is taken out by the petitioner seeking below mentioned<br \/>\nrelief(s):-\n<\/p>\n<p id=\"p_3\">&#8220;12(B)<br \/>\nAllow this Special Civil Application by issuing a writ of mandamus or<br \/>\nwrit in the nature of mandamus or any other appropriate writ, order<br \/>\nor direction, directing the respondent School authority to correct<br \/>\nthe Date of birth of the petitioner in the School leaving certificate<br \/>\non the basis of the Certificate of Birth showing his date of birth as<br \/>\n21.06.1985.&#8221;\n<\/p>\n<p id=\"p_4\">4.\tThe<br \/>\npetitioner claimed that the date of birth mentioned in the School<br \/>\nLeaving Certificate issued by the School Authorities is 21.06.1986<br \/>\nwhereas actually his date of birth is 21.06.1985. In support of his<br \/>\nsubmission, the petitioner has annexed (at Page-10\/A) copy of Birth<br \/>\nCertificate issued on 15.12.2000 which shows that the date of birth<br \/>\nis 21.06.1985, however, what is pertinent is that in the said<br \/>\ncertificate, any name of the person is not mentioned. Therefore, it<br \/>\nis not possible to ascertain as to whether the certificate pertains<br \/>\nto the petitioner or not. It is true that in the column which<br \/>\npertains to father&#8217;s name, the name which is mentioned is similar to<br \/>\nthat of the petitioner&#8217;s father, however, without anything<br \/>\nmore\/further, the co-relation between the person and the certificate.\n<\/p>\n<p id=\"p_5\">5.\tIt<br \/>\nis not in dispute that the petitioner passed out from the school in<br \/>\nMay-2002. Since then until now i.e. for almost 9 years, the<br \/>\npetitioner has not taken any steps to get the said so-called mistake<br \/>\nin the certificate, corrected.\n<\/p>\n<p id=\"p_6\">6.\tThe<br \/>\npetitioner, now after passage of almost 9 years, wants that the<br \/>\nso-called mistake in the School Leaving Certificate may be corrected.<br \/>\nIt appears that the authority has declined to correct the same as<br \/>\nrequested by the petitioner.\n<\/p>\n<p id=\"p_7\">7.\tThe<br \/>\nrelief prayed for by the petitioner in present petition reveals that<br \/>\nafter almost 9 years, the petitioner wants his date of birth, as<br \/>\nreflected in the School Leaving Certificate, corrected from<br \/>\n21.06.1986 to 21.06.1985. The petitioner seeks to rely upon documents<br \/>\npurporting to be his birth certificate, to support his said request.\n<\/p>\n<p id=\"p_8\">8.\tObviously,<br \/>\nthe School Authorities would not be in a position to take any<br \/>\ndecision with regard to the said birth certificate.\n<\/p>\n<p id=\"p_9\">9.\tFurthermore,<br \/>\nonce the petitioner has left the school and has been issued School<br \/>\nLeaving Certificate, then School Authorities would not be in a<br \/>\nposition to make any correction in the certificate and\/or amend the<br \/>\nschool registers.\n<\/p>\n<p id=\"p_10\">10.\tThe<br \/>\nissue had come up for consideration before the Division Bench and by<br \/>\norder dated 24.06.2009 in SCA No.4423 of 2001 and other allied<br \/>\nmatters, the Division Bench, while agreeing with the view earlier<br \/>\ntaken by the Division Bench vide order dated 11.08.2003 in LPA No.699<br \/>\nof 2003, held that once a student leaves the school, correction in<br \/>\nschool records of a student can be carried out only by a Magistrate,<br \/>\nFirst Class, having jurisdiction.\n<\/p>\n<p id=\"p_11\">11.\tIn<br \/>\nlight of the said view taken by the Division Bench, present petition<br \/>\ndoes not deserve to be entertained.\n<\/p>\n<p id=\"p_12\">12.\tTherefore,<br \/>\nMr.Devnani learned advocate for the petitioner has submitted that the<br \/>\npetitioner will approach the Magistrate, First Class, having<br \/>\njurisdiction, with appropriate application. However, the petitioner&#8217;s<br \/>\nonly concern is that the said proceedings may be expeditiously heard<br \/>\nand decided.\n<\/p>\n<p id=\"p_13\">13.\tIn<br \/>\nview of the aforesaid submission and request by the learned advocate<br \/>\nfor the petitioner, the petition is disposed of as withdrawn so as to<br \/>\nenable the petitioner to approach the learned Magistrate having<br \/>\njurisdiction with a request for appropriate orders with regard to the<br \/>\nsubject matter and her grievance.\n<\/p>\n<p id=\"p_14\">14.\tIt<br \/>\nis needless to state that when the appropriate application is<br \/>\npreferred, the learned Magistrate, considering the justification and<br \/>\nupon considering the need for early decision, would endeavor to hear<br \/>\nand decide the application as expeditiously as possible.\n<\/p>\n<p id=\"p_15\">15.\tWith<br \/>\nthe aforesaid observations, the petition is disposed of as withdrawn.<br \/>\nDirect service is permitted.\n<\/p>\n<p id=\"p_16\">(K.M.\n<\/p>\n<p id=\"p_17\">Thaker, J.) <\/p>\n<p>rakesh\/<\/p>\n<p>\t\t   \u00a0\u00a0\u00a0<\/p>\n<p>\t\t   Top<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Gujarat High Court Pansuria vs Secretary on 28 March, 2011 Author: K.M.Thaker,&amp;Nbsp;
