(FC) NO. 226 OF 2006\n\n                     -----------------------------------\n\n            Dated this the 26th day of February, 2007.\n\n\n                                     O R D E R\n<\/pre>\n<p id=\"p_1\">       The   first   revision   petitioner-wife   filed   an   application   under<\/p>\n<p><a href=\"\/doc\/1056396\/\" id=\"a_1\">Section   125<\/a>   of   the   Code   of   Criminal   Procedure   alleging   that   the<\/p>\n<p>respondent   herein   married   her   and   a   child   (second   petitioner)   was<\/p>\n<p>born in the wedlock.  The matrimonial life was happy in the beginning,<\/p>\n<p>but   it   allegedly   became   miserable   due   to   the   ill-treatment   by<\/p>\n<p>respondent.     He   was   a   drunkard,   who   had   no   love   and   affection<\/p>\n<p>towards her and he treated her with cruelty.  She was forced to leave<\/p>\n<p>his   house   for   fear   of   death   on   17.10.2002   and     thereafter,   she   is<\/p>\n<p>residing   with   her   parents.   The   respondent   having   sufficient   means,<\/p>\n<p>neglected to maintain petitioners and he is willfully evading payment of<\/p>\n<p>maintenance.     She   claimed   maintenance   allowance   at   the   rate   of<\/p>\n<p>Rs.   3,000\/-   and   Rs.   1,500\/-   to   the   first   and   second   petitioner<\/p>\n<p>respectively from respondent.\n<\/p>\n<p id=\"p_1\">\n<p id=\"p_2\">       2.     The   respondent   filed   a   counter   statement   denying   all   the<\/p>\n<p>allegations   including   cruelty.   At   present   he   is   not   having   sufficient<\/p>\n<p>income to pay monthly maintenance.   The petitioner is a partner in a<\/p>\n<p>business   firm   having   huge   income   to   maintain   herself.     In   such<\/p>\n<p>circumstances,   he   is   not   liable   to   maintain   petitioner.   To   prove   the<\/p>\n<p>case, the first petitioner examined herself as PW1.<\/p>\n<p><span class=\"hidden_text\" id=\"span_1\">R.P. (FC)226\/2006                             2<\/span><\/p>\n<p id=\"p_3\">       3.     The   court   below   found   that   the   revision   petitioner   did   not<\/p>\n<p>prove   cruelty.     It   was   also   held   that   first   petitioner   was   residing<\/p>\n<p>separately   for   no   justifiable   reason   and   hence,   not   entitled   for<\/p>\n<p>maintenance.     It   was   also   held   that   the   husband   offered   to   accept<\/p>\n<p>petitioner   as   well   as   child,   even   during   trial.     But,   such   offer   was<\/p>\n<p>refused   by   the   wife.     These   are   the   main   reasons   for   rejecting   the<\/p>\n<p>claim made by the wife.\n<\/p>\n<p id=\"p_4\">\n<p id=\"p_5\">       4.   Though arguments were raised regarding impropriety of the<\/p>\n<p>finding   with   respect   to   the   alleged   cruelty,   on   going   through   the<\/p>\n<p>records and the order under challenge, I find that the court below has<\/p>\n<p>not applied its mind to any of the factors which are to be considered<\/p>\n<p>before   granting   or   rejecting   monthly   allowance   for   maintenance.     A<\/p>\n<p>reading   of   <a href=\"\/doc\/1695755\/\" id=\"a_1\">Section   125(1)<\/a>   of   the   Code   would   show   that   in   an<\/p>\n<p>application for maintenance under the said Section by the wife or child,<\/p>\n<p>court   must   be   satisfied   that   husband\/father   having   sufficient   means<\/p>\n<p>has neglected or refused to maintain the wife or child, who are unable<\/p>\n<p>to   maintain   themselves.   The   sufficiency   of   means,   the   neglect   or<\/p>\n<p>refusal   to   maintain   and   the   inability   of   the   wife   or   child   to   maintain<\/p>\n<p>herself   or   itself   are   the   three   inevitable   factors   which   are   to   be<\/p>\n<p>established   for   getting   an   order   of   maintenance   allowance   under<\/p>\n<p><a href=\"\/doc\/1695755\/\" id=\"a_2\">Section 125(1)<\/a> of the Code. The trial court, as the fact-finding court, is<\/p>\n<p>bound to consider those factors, based on the pleadings, evidence and<\/p>\n<p><span class=\"hidden_text\" id=\"span_1\">R.P. (FC)226\/2006                              3<\/span><\/p>\n<p>other   materials   available   in   court.   Without   entering   finding   whether<\/p>\n<p>husband\/father   having   sufficient   means,   neglected   or   refused   to<\/p>\n<p>maintain   the   wife   or   child,   as   the   case   may   be,   who   are   unable   to<\/p>\n<p>maintain themselves, no order shall be passed under <a href=\"\/doc\/1695755\/\" id=\"a_3\">Section 125(1)<\/a> of<\/p>\n<p>the Code in an application filed by wife or child.<\/p>\n<p id=\"p_6\">       5.  But, a plain reading of the order under challenge would show<\/p>\n<p>that   none   of   the   factors   relevant   under   <a href=\"\/doc\/1695755\/\" id=\"a_4\">Section   125(1)<\/a>   of   the   Code<\/p>\n<p>were considered  by the trial court.   The  trial court  is the fact-finding<\/p>\n<p>court and it is bound to enter specific findings on these three relevant<\/p>\n<p>aspects, before granting or refusing maintenance.  Since the revisional<\/p>\n<p>court cannot enter into any fact-finding for the first time in revision, it<\/p>\n<p>is   the   duty   of   the   trial   court   to   enter   specific   findings   on   the   three<\/p>\n<p>factors which are referred above.\n<\/p>\n<p id=\"p_7\">\n<p id=\"p_8\">       6.     Needless   to   say,   even   in   considering   whether   the   child   is<\/p>\n<p>entitled for maintenance,   the trial court has to enter finding that the<\/p>\n<p>father   having   sufficient   means   has   neglected   or   refused   to   maintain<\/p>\n<p>the child, who is unable to maintain itself.  Such a finding is not there<\/p>\n<p>in the order of the court below.\n<\/p>\n<p id=\"p_9\">\n<p id=\"p_10\">       7.     The   court   below   has   not   considered   the   rival   contentions<\/p>\n<p>regarding the sufficiency of means of the husband\/father, the alleged<\/p>\n<p>inability of wife or child to maintain herself or itself or even the alleged<\/p>\n<p>neglect or refusal to maintain the wife\/child.  It is also curious to note<\/p>\n<p><span class=\"hidden_text\" id=\"span_2\">R.P. (FC)226\/2006                             4<\/span><\/p>\n<p>that, though <a href=\"\/doc\/1695755\/\" id=\"a_5\">Section 125(1)<\/a> of the Code specifically provides that the<\/p>\n<p>court   may   pass   order   under   the   subsection   only   if   there   is   proof   of<\/p>\n<p>neglect   or   refusal   to   maintain,   there   is   absolutely   no   finding   in   the<\/p>\n<p>order  whether there was any proof  of neglect or  refusal to maintain.<\/p>\n<p>Since the order is bereft of specific findings of fact on the three crucial<\/p>\n<p>aspects,   namely,   i)   sufficiency   of   means   of   the   husband\/father<\/p>\n<p id=\"p_11\">ii)   neglect   or   refusal   to   maintain   the   wife   or   the   child   and   iii)   the<\/p>\n<p>inability   of   the   wife   or   child   to   maintain   herself   or   itself,   the   order<\/p>\n<p>under challenge is clearly illegal.   The order deserves to be set aside<\/p>\n<p>and I do so.\n<\/p>\n<p id=\"p_12\">\n<p id=\"p_13\">       8.  I am not expressing any view regarding the rival contentions<\/p>\n<p>raised in this revision on the question of cruelty, sufficiency of means<\/p>\n<p>etc.,   since   the   case   has   to   be   remanded   for   fresh   consideration   and<\/p>\n<p>disposal.   The parties are at liberty to raise those contentions before<\/p>\n<p>court below.\n<\/p>\n<p id=\"p_14\">\n<p id=\"p_15\">       9.     However,   learned   counsel   for   the   revision   petitioner<\/p>\n<p>submitted that the order of maintenance passed in favour of the child<\/p>\n<p>may   not   be   disturbed,   especially   since   the   respondent   has   not<\/p>\n<p>challenged the said order.   In the peculiar facts and circumstances of<\/p>\n<p>this   case,   I   find   that   respondent   shall   pay   Rs.   600\/-   as   monthly<\/p>\n<p>maintenance, which can be treated as an order of interim maintenance<\/p>\n<p>to be passed during pendency of the proceedings before the trial court.<\/p>\n<p><span class=\"hidden_text\" id=\"span_3\">R.P. (FC)226\/2006                            5<\/span><\/p>\n<p>The   quantum   of   such   maintenance   however,   will   be   subject   to   fresh<\/p>\n<p>decision of the trial court.\n<\/p>\n<p id=\"p_16\">\n<p id=\"p_17\">       10.     In   the   result,   the   order   under   challenge   is   set   aside,   but<\/p>\n<p>respondent   shall   pay   monthly   allowance   to   the   child   at   the   rate   of<\/p>\n<p>Rs.   600\/-   as   ordered   by   lower   court   as   interim   maintenance   during<\/p>\n<p>pendency   of   the   proceedings   before   the   court   below.     The   case   is<\/p>\n<p>remanded   to   court   below   for   fresh   consideration   and   disposal   in<\/p>\n<p>accordance with law.\n<\/p>\n<p id=\"p_18\">\n<p id=\"p_19\">       It   is   made   clear   that   the   court   shall   enter   specific   findings<\/p>\n<p>regarding   the   three   crucial   aspects,   which   are   essentially   to   be<\/p>\n<p>considered under <a href=\"\/doc\/1695755\/\" id=\"a_6\">Section 125(1)<\/a> of the Code and such other matters<\/p>\n<p>which may be relevant for consideration, to grant or refuse the claim<\/p>\n<p>for maintenance.\n<\/p>\n<p id=\"p_20\">\n<p id=\"p_21\">       Parties   shall   appear   before   the   trial   court   on   19.03.2007.     The<\/p>\n<p>trial court shall dispose of the matter before 19.04.2007.<\/p>\n<p id=\"p_22\">       This revision petition is allowed.\n<\/p>\n<p id=\"p_23\">\n<p id=\"p_24\">                                                              K.
