           This appeal arises from the order of acquittal passed<\/p>\n
under Section 256(1)<\/a> of the Code of Criminal Procedure.<\/p>\n
           2.   The appellant is the complainant.          He filed a<\/p>\n
complaint against first respondent, alleging offence under Section<\/p>\n
138<\/a> of the Negotiable Instruments Act. The case was taken on file<\/p>\n
and summons was issued to the accused. Thereafter, the case<\/p>\n
was posted for evidence.       On 3.12.2009, when the case was<\/p>\n
posted for evidence, the complainant was not present and hence,<\/p>\n
the following order is passed :\n<\/p>\n
          “The above complaint has been filed by the complainant u\/s.<\/p>\n
          138 of the Negotiable Instruments Act<\/a>. Complainant is not<\/p>\n
          present for oral evidence in spite of directions. Absence of<\/p>\n
          the complainant not condoned. Accused acquitted u\/s.256<\/p>\n
          Cr.P.C<\/a>.”\n<\/p><\/blockquote>\n
The above order is under challenge.\n<\/p>\n
           3.  At the time when this appeal was taken up for<\/p>\n
hearing, there was no representation for the appellant. On going<\/p>\n
through the appeal memo and the order under challenge, it is<\/p>\n
Crl.A. NO.740\/2010               2<\/span><\/p>\n
clear that the case was posted for evidence on the day on which<\/p>\n
the accused was acquitted under Section 256(1)<\/a> of the Code. The<\/p>\n
said provision does not permit or empower the court to acquit an<\/p>\n
accused on the day on which the case is posted for evidence. A<\/p>\n
reading of Section 256(1)<\/a> of the Code reveals that if the<\/p>\n
complainant is absent, the Magistrate can acquit the accused on<\/p>\n
the two days specified therein.     Those days are; (1) the day<\/p>\n
appointed for the appearance of the accused, if the summons has<\/p>\n
been issued on complaint and (2) any day subsequent thereto to<\/p>\n
which the hearing may be adjourned.\n<\/p>\n
            4.   Section 256(1)<\/a> of the Code does not permit the<\/p>\n
court to acquit the accused on any day other than the two days<\/p>\n
specified in the section. Necessarily, the court has no power to<\/p>\n
acquit the accused on the day to which the case is posted for<\/p>\n
evidence. I have held in in P.V.Joseph v. State of Kerala and<\/p>\n
another<\/a> (order dated 3.9.2010 in Crl.A.No.485\/2007) that the<\/p>\n
Magistrate shall not acquit the accused on the day to which the<\/p>\n
case is posted for evidence. Hence, the order under challenge is<\/p>\n
not sustainable.\n<\/p>\n
            5. In the above circumstances, the following order is<\/p>\n
Crl.A. NO.740\/2010                 3<\/span><\/p>\n
passed :\n<\/p>\n
        (i) The impugned order is set aside.<\/p>\n<\/blockquote>\n
        (ii) The court below shall take the case on file and dispose<\/p>\n
              of the same in accordance with law.<\/p>\n<\/blockquote>\n
        (iii) The parties shall appear before the trial court on<\/p>\n
              25.10.2010.\n<\/p><\/blockquote>\n
                  The appeal is allowed.\n<\/p><\/blockquote>\n
