Singh,Vivek Varma\n\nHon'ble Sunil Ambwani,J.\n<\/pre>\n<p id=\"p_1\">Hon&#8217;ble Kashi Nath Pandey,J.\n<\/p>\n<p id=\"p_1\">The petitioner is serving as Associate Professor in Department of<br \/>\nCommerce, Bareilly College, Bareilly. By this writ petition, he has<br \/>\nprayed for a direction quashing the order dated 28.4.2010 by the<br \/>\nRegistrar, Mahatma Jyotiba Phule Rohilkhand University, Bareilly<br \/>\nto debar him for three years from any examination work on the<br \/>\nrecommendation of the Examination Committee in its meeting<br \/>\ndated 27.4.2010.\n<\/p>\n<p id=\"p_2\">We have heard Shri P.K. Singh, learned counsel for the petitioner.<br \/>\nShri Vivek Varma appears for the University.\n<\/p>\n<p id=\"p_3\">On 9.6.2010 Shri Vivek Varma was required to seek instructions<br \/>\nin the matter and to indicate as to whether any opportunity of<br \/>\nhearing was afforded to the petitioner before making the order.\n<\/p>\n<p id=\"p_4\">Shri Vivek Varma has taken instructions and informs the Court<br \/>\nthat on 24.4.2010 a flying squad inspected the several colleges<br \/>\nincluding Baba Ramdas Degree College, Bholapur of which the<br \/>\npetitioner was the observer. It was found that only 23 girl students<br \/>\nwere taking examination in the college. The inspecting party found<br \/>\nthree girl students copying in the examination. They also found<br \/>\nsome material connected with the examination in the agricultural<br \/>\nfield behind the room of the building where the examinations<br \/>\nwere being taken.\n<\/p>\n<p id=\"p_5\">A report was submitted by the Flying Squad to the Examination<br \/>\nCommittee on 09.4.2010, stating therein that Dr. Bhartendu<br \/>\nSharma of Bareilly College appointed as observer by the<br \/>\nUniversity, was present at the Examination Centre, and expressed<br \/>\nhis inability to search the female candidates taking examination.\n<\/p>\n<p id=\"p_6\">The Examination Committee in its meeting dated 27.4.2010<br \/>\nresolved to debar the centre for examination for two years and also<br \/>\ndebarred the petitioner from any examination work for three years.<br \/>\nThe Examination Committee also decided that a female observer<br \/>\n shall be sent in future to the Centre.\n<\/p>\n<p id=\"p_7\">It is not denied that the petitioner was given any opportunity of<br \/>\nhearing by the Examination Committee before taking a decision to<br \/>\ndebar him from the Examination Work.\n<\/p>\n<p id=\"p_8\">The examination work is an essential part of service of teacher.<br \/>\nAny decision taken to debar him by way of punishment on the<br \/>\nfindings recorded by the flying squad amounts to a blot on his<br \/>\ncareer. Even if a teacher may not get any remuneration for the<br \/>\nexamination work, the observations made against him and the<br \/>\ndecision taken to debar him from examination work, affect his<br \/>\nreputation and career prospects. Such a decision, therefore, should<br \/>\nbe taken unless a person is given to an opportunity of hearing to<br \/>\nserve principles of natural justice.\n<\/p>\n<p id=\"p_9\">The writ petition is allowed. The decision taken by the<br \/>\nExamination Centre dated 27.4.2010 and the order of Registrar of<br \/>\nthe University dated 28.4.2010 communicating the decision to the<br \/>\npetitioner are set aside. The Examination Committee of the<br \/>\nUniversity will given an opportunity to show cause and will afford<br \/>\npersonal hearing if it is demanded by the petitioner before taking<br \/>\nany decision in the matter.
