SHAH\n\t\t\n\t\n\n \n\n \n \n\n\n \n\nDate\n: 03\/05\/2010 \n\n \n\n \n \nORAL\nORDER<\/pre>\n<p id=\"p_1\">Present<br \/>\n\tJudges Summons has been taken out by the applicant claiming to be<br \/>\n\tthe owner of Shop No.A-5, Muktanand Park, Jamfalwadi, Ramol,<br \/>\n\tAhmedabad for an appropriate order directing the Official Liquidator<br \/>\n\tto remove the seals and handover the possession of the said premises<br \/>\n\tto the applicant.\n<\/p>\n<p id=\"p_1\">It<br \/>\n\tis the case on behalf of the applicant that shop in question was<br \/>\n\tgiven on rent to the Company in liquidation on a monthly rent of<br \/>\n\tRs.1,000\/- (Rupees One Thousand only). The applicant has produced on<br \/>\n\trecord the relevant entries in the passbook of the bank account of<br \/>\n\tthe petitioner crediting Rs.1,000\/- (Rupees One Thousand only) per<br \/>\n\tmonth in his account. It is submitted that as such, the premises in<br \/>\n\tquestion, was never of the ownership of the Company in liquidation<br \/>\n\tand therefore, it is requested to remove the seals and handover the<br \/>\n\tpossession to the applicant.\n<\/p>\n<p id=\"p_2\">Having<br \/>\n\theard Shri Bundela, learned advocate appearing on behalf of the<br \/>\n\tapplicant and Shri J.S.Yadav, learned advocate for Official<br \/>\n\tLiquidator of the Company in liquidation and even considering the<br \/>\n\tstatement of affairs and documents on record, Shri Yadav, learned<br \/>\n\tadvocate for the Official Liquidator is not in a position to satisfy<br \/>\n\tthe Court that the Company in liquidation was the owner of the<br \/>\n\tpremises in question. On the other hand, there are documents on<br \/>\n\trecord to show that applicant and his family members were the owner<br \/>\n\tof the premises in question and as well as the land on which the<br \/>\n\tpremises in question was erected. It appears that at the relevant<br \/>\n\ttime and\/or prior thereto, there was a registered office of the<br \/>\n\tCompany in liquidation in the premises in question and the same was<br \/>\n\ta rented premises. Under the circumstances, when the Official<br \/>\n\tLiquidator has failed to satisfy the Court that the Company in<br \/>\n\tliquidation was the owner of the premises in question and when the<br \/>\n\tapplicant has been able to successfully established that he and his<br \/>\n\tfamily members were the owner of the premises in question, the<br \/>\n\tpresent application deserves to be allowed.\n<\/p>\n<p id=\"p_3\">In<br \/>\n\tview of the above and for the reasons stated above, the Official<br \/>\n\tLiquidator is hereby directed to remove the seals and handover the<br \/>\n\tpossession of the premises in question being Shop No.A-5, Muktanand<br \/>\n\tPark, Jamfalwadi, Ramol, Ahmedabad to the applicant within a period<br \/>\n\tof 8 (eight) weeks from today.\n<\/p>\n<p id=\"p_4\">It<br \/>\n\twill be open for the Official Liquidator to remove and take whatever<br \/>\n\tthe records of the company in liquidation lying in the said premises<br \/>\n\twithin the aforesaid time and the Official Liquidator to handover<br \/>\n\tthe peaceful and vacant possession to the applicant within<br \/>\n\tstipulated time stated herein above.\n<\/p>\n<p id=\"p_5\">With<br \/>\n\tthis, present application is disposed of.\n<\/p>\n<p id=\"p_6\">(M.R.SHAH,<br \/>\nJ.)<\/p>\n<p>(ashish)<\/p>\n<p>\t\t   \u00a0\u00a0\u00a0<\/p>\n<p>\t\t   Top<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Gujarat High Court Dineshbhai vs Official on 3 May, 2010 Author: M.R.
