Side)\n\n\n:O R D E R \n<\/pre>\n<p id=\"p_1\">(Order of the Court was made by P.SATHASIVAM, J.)<br \/>\n        The petitioner, who is the mother of  the  detenu  by  name  Sathik  @<br \/>\nSathik  Basha,  who was detained as a &#8220;Goonda&#8221; as contemplated under the Tamil<br \/>\nNadu Prevention of Dangerous Activities of Bootleggers, Drug Offenders, Forest<br \/>\nOffenders, Goondas, Immoral Traffic Offenders, Slum Grabbers and Video Pirates<br \/>\nAct, 1982 <a href=\"\/doc\/195458\/\" id=\"a_1\">(Tamil Nadu Act<\/a> 14 of 1982), by the impugned detention  order  dated<br \/>\n17.8.2005, challenges the same in this Petition.\n<\/p>\n<p id=\"p_1\">        2.   Heard  learned  counsel  for  the  petitioner  as well as learned<br \/>\nGovernment Advocate for the respondents.\n<\/p>\n<p id=\"p_2\">        3.  At the foremost, learned counsel for the  petitioner,  by  drawing<br \/>\nour  attention  to the fact, submitted that though the detenu was arrested and<br \/>\nremanded for the offence under <a href=\"\/doc\/1560742\/\" id=\"a_2\">Section 302<\/a> IPC in Crime No.  34 6 of  2005  on<br \/>\nthe  file  of B2 Vishnukanchi Police Station in respect of occurrence that had<br \/>\ntaken place on 16.7.2005, the detaining authority, while passing the order  of<br \/>\ndetention  has  not  considered  the  same  and  merely stated that the ground<br \/>\noccurrence in Crime No.361 of 2005, which is for an offence under <a href=\"\/doc\/455468\/\" id=\"a_3\">Section  307<\/a><br \/>\nIPC, arrived a conclusion that there is imminent possibility of his coming out<br \/>\non bail  by filing bail application.  In other words, according to the learned<br \/>\ncounsel, when the detenu was already arrested and remanded in graver  offence,<br \/>\nnamely,  offence under <a href=\"\/doc\/1560742\/\" id=\"a_4\">Section 302<\/a> IPC, in respect of 8th adverse case, in the<br \/>\nabsence of such awareness relating to the same, the passing of  the  detention<br \/>\norder based on the ground case which is for an offence under <a href=\"\/doc\/455468\/\" id=\"a_5\">Section 307<\/a> IPC.,<br \/>\nthe ultimate conclusion of the detaining authority is vitiated.\n<\/p>\n<p id=\"p_3\">        4.We  verified  the  awareness  shown  by  the  detaining authority in<br \/>\nrespect of the imminent possibility, which is available in Paragraph 5 ( i) of<br \/>\nthe grounds of detention.  As rightly pointed out by the learned  counsel  for<br \/>\nthe  petitioner,  it  is  seen  from  the  grounds  of detention in respect of<br \/>\noccurrence that took place on  16.7.2005,  the  detenu  was  arrested  for  an<br \/>\noffence in  Crime No.  346 of 2005 and on the date of passing of the detention<br \/>\norder he is in prison and he has not come out on bail.  While considering  the<br \/>\nimminent  possibility  of  his coming out on bail, the detaining authority has<br \/>\nmerely taken note of the ground case, namely, Crime No.361 of 2005,  which  is<br \/>\nfor lessor offence, namely, 307 <a href=\"\/doc\/1569253\/\" id=\"a_6\">IPC<\/a>.\n<\/p>\n<p id=\"p_4\">        5.  In such circumstances, in the absence of awareness relating to the<br \/>\nCrime No.346 of 2005, which is for a graver offence of <a href=\"\/doc\/1560742\/\" id=\"a_7\">Section 302<\/a> IPC, we are<br \/>\nof  the  view that the detaining authority has failed to take note of relevant<br \/>\naspect while passing the order of detention.  On this ground, we  are  of  the<br \/>\nview  that  the  detention  order  is liable to be quashed and accordingly, we<br \/>\nquash the same.\n<\/p>\n<p id=\"p_5\">        6.  Accordingly,  the  Habeas  Corpus  Petition  is  allowed  and  the<br \/>\nimpugned order of detention is set aside.  The detenu is directed to be set at<br \/>\nliberty forthwith from the custody unless he is required in some other case or<br \/>\ncause.\n<\/p>\n<p id=\"p_6\">ga<\/p>\n<p>To<\/p>\n<p id=\"p_7\">1.
