Justice THOTTATHIL B.RADHAKRISHNAN\n\n Dated :04\/07\/2006\n\n O R D E R\n               THOTTATHIL B.RADHAKRISHNAN, J\n                       -------------------------------------------\n                            F.A.O.No.228 OF 2004\n                       -------------------------------------------\n                   Dated this the 4th  day of July, 2006\n\n                                   JUDGMENT\n<\/pre>\n<p id=\"p_1\">      Heard   learned   counsel   for   the   appellant   and<\/p>\n<p>Adv.Sri.K.Ramachandran for the 4th respondent.<\/p>\n<p id=\"p_1\">      2. The appellant challenges an interlocutory order passed in<\/p>\n<p>the   appeal,   whereby,   its   application   for   temporary   injunction<\/p>\n<p>pending a first appeal filed by it against the dismissal of the suit,<\/p>\n<p>has been dismissed.     Having heard counsel for parties at this<\/p>\n<p>distance   of   time,   it   may   not   be   necessary   to   entertain   a   first<\/p>\n<p>appeal  against   the   impugned  order   since   the   court   below   can<\/p>\n<p>consider expediting final disposal of A.S.149\/03 and parties can<\/p>\n<p>maintain  status quo as on today until disposal of the first appeal.<\/p>\n<p id=\"p_2\">         3. In the aforesaid circumstances, the F.A.O is dismissed,<\/p>\n<p>however, directing that the Sub Court, Tirur will make an earnest<\/p>\n<p>effort to dispose of A.S.149\/03 at the earliest, at any rate, within<\/p>\n<p>a period of nine months from the date of receipt of a copy of this<\/p>\n<p>FAO.228\/04<\/p>\n<p><span class=\"hidden_text\" id=\"span_1\">                                      2<\/span><\/p>\n<p>judgment.  That shall be done untrammeled by anything stated in<\/p>\n<p>the   order   impugned   in   this   F.A.O.
