JUSTICE A.N.JINDAL\n\nPresent:     Mr.N.D.Achint, Advocate\n             with Mr.Deepak Kaushal, Advocate,\n             for the petitioners.\n\n         Mr.Vishal Garg, Advocate,\n         for the respondents.\n                      *****\n<\/pre>\n<p>A.N.JINDAL, J(ORAL):\n<\/p>\n<p>             The petitioners have filed this petition under Article 227 of the<br \/>\nConstitution of India for setting aside the orders dated 20.11.2007 and<br \/>\n04.01.2008, passed by Civil Judge (Junior Division), Rajpura.\n<\/p>\n<p>             After hearing learned counsel for the parties at length, it<br \/>\nappears that the following issues necessarily arise out of the pleadings of the<br \/>\nparties:-\n<\/p>\n<blockquote><p>             1. Whether the plaintiffs have no cause of action in view of the<br \/>\n               previously decided litigation ? OPP\n<\/p><\/blockquote>\n<blockquote><p>             2. Whether the suit is properly valued for the purpose of Court<br \/>\n               fee and jurisdiction ?<\/p><\/blockquote>\n<p>             It has been submitted that the petitioners want to amend the<br \/>\nwritten statement in order to take the specific pleas with regard to the<br \/>\nresjudicata and estoppel etc.<br \/>\n             In these circumstances, this petition is disposed of with the<br \/>\ndirection to the trial Court to frame the issues with regard to cause of action<br \/>\nas well as the Court fee.
