GOVIND MATHUR, J.\n<\/pre>\n<p id=\"p_1\">Mr. Sachin Acharya for the petitioner.<br \/>\nMr. A.K. Rajvanshy, AAG, for the respondents.\n<\/p>\n<p id=\"p_1\">             The candidature of the petitioner for the purpose of<\/p>\n<p>appointment as Prabodhak under Rajasthan Panchayati Raj<\/p>\n<p>Prabodhak Service Rules, 2008 has been rejected on the count<\/p>\n<p>that   she   is    having      Senior       Secondary        School   Certificate<\/p>\n<p>(Vocational).     It is urged by learned counsel for the petitioner<\/p>\n<p>that the controversy involved in this petition for writ is no more<\/p>\n<p>res integra in view of the judgment of this Court in the case of<\/p>\n<p>Ramraj Tada vs. State and others (SBCWP No.4005\/2008)<\/p>\n<p>decided on 08.08.2008. In the case aforesaid, this Court held as<\/p>\n<p>under:\n<\/p>\n<blockquote id=\"blockquote_1\"><p>             &#8220;In the facts of instant case, this Court is of<br \/>\n             the opinion that since NCTE alone holds<br \/>\n             competence and in absence of guidelines or<br \/>\n             directives     from      NCTE,       decision    impugned<br \/>\n             taken        by       respondents          in      denying<br \/>\n             consideration       to       such    candidates     holding<br \/>\n                           { 2 }<\/p>\n<p>Senior Secondary (Voc.) as ineligible in no<br \/>\nmanner can be said to be in consonance with<br \/>\nexisting Scheme of Rules, 1996 particularly in<br \/>\nterms of amendment dt.28\/06\/06 and such<br \/>\naction of the respondent deserves to be set<br \/>\naside.\n<\/p><\/blockquote>\n<blockquote id=\"blockquote_1\"><\/blockquote>\n<p id=\"p_2\">Consequently, all the petitions succeed and<br \/>\nare hereby allowed.           The decision taken by<br \/>\nrespondents holding petitioners ineligible on<br \/>\nthe premise in their qualification of Senior<br \/>\nSecondary         (Vocational)         without     Bridge<br \/>\nCourse, is hereby quashed and set aside.<br \/>\nRespondents         are      directed      to    consider<br \/>\npetitioners who hold qualification of Senior<br \/>\nSecondary (Vocational) as eligible for the post<br \/>\nof Primary \/ Upper Primary School Teachers<br \/>\nand      consider         their    candidatures          for<br \/>\nappointment       based      on    their    participation<br \/>\nhaving      taken     place       in      pursuance       of<br \/>\nadvertisement dated 30.10.2006 and if their<br \/>\nnames      find   place     in    order    of    merit    in<br \/>\nrespective category, they may be considered<br \/>\nand if found suitable, be appointed, however,<br \/>\nthey will be entitled for seniority, notional<br \/>\nfixation    etc., and all other service benefits<br \/>\nbut will not be entitled for salary for the<br \/>\nintervening period during which they did not<br \/>\nactually work.&#8221;\n<\/p>\n<blockquote id=\"blockquote_2\"><p>                                            { 3 }<\/p>\n<p>                    In the instant matter also, the respondents are<\/p>\n<p>        making appointment to the post of Prabodhak i.e. a post relating<\/p>\n<p>        to   teaching    and    while   making     appointments to       the    post<\/p>\n<p>        aforesaid, the respondents are required to adhere the norms<\/p>\n<p>        prescribed by National Council of Teachers Education.<\/p>\n<\/blockquote>\n<blockquote id=\"blockquote_3\"><p>                    In view of it, the judgment given in Ramraj Tada&#8217;s<\/p>\n<p>        case   (supra)     is    having    absolute   application   in    present<\/p>\n<p>        controversy too.\n<\/p><\/blockquote>\n<blockquote id=\"blockquote_4\">\n<\/blockquote>\n<blockquote id=\"blockquote_5\"><p>                    Accordingly, this petition for writ is allowed.             The<\/p>\n<p>        respondents      are    directed   to   consider   candidature     of   the<\/p>\n<p>        petitioner for the purpose of appointment to the post of<\/p>\n<p>        Prabodhak as per the provisions of Rajasthan Panchayati Raj<\/p>\n<p>        Prabodhak Service Rules, 2008.
