No.15671 of 2010\n                      KAILASH PASWAN, SON OF KANHAIYA PASWAN\n                                           Versus\n                                    STATE OF BIHAR\n                                         -----------\n<\/pre>\n<p id=\"p_1\">3.   29.06.2010               Heard learned counsel for the petitioner and the<\/p>\n<p>                  State.\n<\/p>\n<p id=\"p_1\">                              The petitioner seeks bail in a case instituted for the<\/p>\n<p>                  offence under <a href=\"\/doc\/1560742\/\" id=\"a_1\">Section 302<\/a> of the Indian Penal Code and<\/p>\n<p>                  <a href=\"\/doc\/244673\/\" id=\"a_1\">Section 27<\/a> of the Arms Act.\n<\/p>\n<p id=\"p_2\">                              From the narrative of the First Information Report, it<\/p>\n<p>                  is clear that the Informant is not an eye witness but she has<\/p>\n<p>                  narrated about the occurrence as having been told by Santosh<\/p>\n<p>                  Paswan who disclosed the active complicity of the petitioner in<\/p>\n<p>                  committing this act.\n<\/p>\n<p id=\"p_3\">                              Submission is that there is no allegation against the<\/p>\n<p>                  petitioner of having fired at the deceased since Santosh<\/p>\n<p>                  Paswan himself is not an eye witness to the occurrence. Further<\/p>\n<p>                  submission is that the co-accused Ram Pravesh has been<\/p>\n<p>                  granted bail. However, I find the case of the petitioner is not<\/p>\n<p>                  similar to the case of Ram Pravesh Kumar Diwakar who has<\/p>\n<p>                  been released on bail by this Court on 19.4.2010 passed in Cr.<\/p>\n<p>                  Misc. 11836 of 2010 since he has no criminal antecedents.<\/p>\n<p id=\"p_4\">                              Considering the complicity of the petitioner, this court<\/p>\n<p>                  is not inclined to grant bail to the petitioner, at this stage.<\/p>\n<p id=\"p_5\">                              The prayer for bail is rejected.\n<\/p>\n<p id=\"p_6\">                              However, he may renew his prayer for bail after<br \/>\n<span class=\"hidden_text\" id=\"span_1\">                              2<\/span><\/p>\n<p>        framing of charge.\n<\/p>\n<p id=\"p_7\">                   It is made clear that the case of the petitioner will not<\/p>\n<p>        be bifurcated for purposes of bail.\n<\/p>\n<p id=\"p_8\">\n<p id=\"p_9\">                                 ( Anjana Prakash, J.)<br \/>\nS.Ali\n <\/p>\n","protected":false},"excerpt":{"rendered":"<p>Patna High Court &#8211; Orders Kailash Paswan vs State Of Bihar on 29 June, 2010 IN THE HIGH COURT OF JUDICATURE AT PATNA Cr.Misc.
