Justice R.BASANT\n\n Dated :05\/12\/2006\n\n O R D E R\n                                      R.BASANT, J\n\n                                   ----------------------\n\n\n                              W.P.C.No.25525 of 2006\n\n                             ----------------------------------------\n\n                   Dated this the 5th day of December   2006\n\n\n\n\n                                        O R D E R\n<\/pre>\n<p id=\"p_1\">       The petitioner has come to this court, aggrieved by Ext.P3 order<\/p>\n<p>dated   30\/08\/2006,   which   on   the   face   of   it   states   that   it   is   an   order<\/p>\n<p>under Chapter 10B of <a href=\"\/doc\/983382\/\" id=\"a_1\">Section 133<\/a> Cr.P.C.  The petitioner has come to<\/p>\n<p>this court alleging that the order is grossly illegal and does not comply<\/p>\n<p>with the terms of Chapter 10B.  The petitioner came to know after the<\/p>\n<p>writ   petition   was   filed   that   the   District   Collector   has   subsequently<\/p>\n<p>withdrawn Ext.P3  order but have chosen to issue a fresh  conditional<\/p>\n<p>order   under   <a href=\"\/doc\/983382\/\" id=\"a_1\">Section   133<\/a>   Cr.P.C.     A   copy   of   that   order   dated<\/p>\n<p>25\/09\/2006 is produced as Ext.R4(a) by the respondent and as Ext.P7<\/p>\n<p>by   the   petitioner.     The   respondent,   District   Collector   proceeded<\/p>\n<p>simultaneously   to   pass   a   further   order   under   <a href=\"\/doc\/529017\/\" id=\"a_2\">Section   142<\/a>   Cr.P.C   (a<\/p>\n<p>copy of which is produced as Ext.R4(b)).\n<\/p>\n<p id=\"p_1\">       2.      The   dispute   is   about   the   conduct   of   a   workshop   by   the<\/p>\n<p>petitioner.     A   neighbour,   respondent   No.4   is   running   an   Ayurvedic<\/p>\n<p>Hospital adjacent to the said workshop.   She complained of nuisance<\/p>\n<p>and approached the District Collector.   It is thereupon that Ext.P3 as<\/p>\n<p>well as Exts.R4(a) and R4(b) orders have been passed by the District<\/p>\n<p>Collector.\n<\/p>\n<p><span class=\"hidden_text\" id=\"span_1\">W.P.C.No.25525\/06                           2<\/span><\/p>\n<p id=\"p_2\">       3.     The   learned   counsel   for   the   petitioner   submits   that   the<\/p>\n<p>petitioner   is   willing   to   appear   before   the   District   Collector,   in<\/p>\n<p>accordance   with   the   provisions   of   Chapter   10B.     He   only   prays   that<\/p>\n<p>the   order   of   injunction   under   <a href=\"\/doc\/529017\/\" id=\"a_3\">Section   142<\/a>   Cr.P.C   (copy   of   which   is<\/p>\n<p>produced   as   Ext.R4(b)   may   be   suspended   and   the   District   Collector<\/p>\n<p>may be directed to pass a fresh order under <a href=\"\/doc\/529017\/\" id=\"a_4\">Section 142<\/a> Cr.P.C, after<\/p>\n<p>hearing both parties.\n<\/p>\n<p id=\"p_3\">       4.     The learned counsel for the petitioner  submits that Ext.R4<\/p>\n<p id=\"p_4\">(b) order and the application filed by the petitioner before the District<\/p>\n<p>Collector are vitiated in as much as they do not make any mention of<\/p>\n<p>Ext.P2   order   passed   by   the   Ombudsman   for   Local   Self   Government<\/p>\n<p>Institutions.  That clearly shows that the Ombudsman had called for a<\/p>\n<p>report of the Pollution Control Board and the report was placed before<\/p>\n<p>the   Ombudsman   who   did   not   pass   any   orders   restraining   the<\/p>\n<p>petitioner   from   continuing   with   the   running   of   his   workshop.     That<\/p>\n<p>order is seen passed on 17\/05\/2006.   But when the petitioner moved,<\/p>\n<p>the District Collector with Ext.P8 petition on 01\/08\/2006, significantly<\/p>\n<p>and   surprisingly,   no   mention   whatsoever   was   made   of   the   earlier<\/p>\n<p>proceedings   which   culminated   in   Ext.P2   order   in   which   proceedings<\/p>\n<p>the   report   of   the   Pollution   Control   Board   had   been   obtained.     I   find<\/p>\n<p>merit in the submission of the learned counsel for the petitioner that<\/p>\n<p><span class=\"hidden_text\" id=\"span_1\">W.P.C.No.25525\/06                             3<\/span><\/p>\n<p>bonafides   is   not   an   attribute   that   one   can   discover   or   invent   in   the<\/p>\n<p>hands   of   the   petitioner.     In   having   suppressed   information   about<\/p>\n<p>Ext.P2   order   in   the   subsequent   application   filed   by   the   fourth<\/p>\n<p>respondent before the District Collector, it is eloquent that the fourth<\/p>\n<p>respondent   wanted   to   steal   an   order   from   the   District   Collector<\/p>\n<p>without revealing the crucial and vital facts.\n<\/p>\n<p id=\"p_5\">       5.      Be   that   as   it   may,   I   do   not   intend   to   express   any   final<\/p>\n<p>opinion   on   any   other   disputed  question.     I   am   satisfied   that   there   is<\/p>\n<p>merit in the submission of the learned counsel for the petitioner that<\/p>\n<p>Ext.R4(b) order dated 25\/09\/2006 under <a href=\"\/doc\/529017\/\" id=\"a_5\">Section 142<\/a> Cr.P.C deserves<\/p>\n<p>to be set aside now.   The District Collector, that is respondent No.1,<\/p>\n<p>needless   to   say,   shall   be   entitled   to   proceed   further   with   the<\/p>\n<p>proceedings initiated under <a href=\"\/doc\/983382\/\" id=\"a_6\">Section 133<\/a> Cr.P.C.  If it be necessary, he<\/p>\n<p>shall   of   course   be   entitled   to   pass   appropriate   further   orders   under<\/p>\n<p><a href=\"\/doc\/529017\/\" id=\"a_7\">Section 142<\/a> Cr.P.C also.  But such order can be passed now only after<\/p>\n<p>hearing   the   petitioner   and   giving   him   an   opportunity   to   raise   all   his<\/p>\n<p>contentions.\n<\/p>\n<p id=\"p_6\">       6.      In the result, this writ petition is allowed.  Ext.R4(b) order<\/p>\n<p>dated   25\/09\/2006   passed   by   the   first   respondent   under   <a href=\"\/doc\/529017\/\" id=\"a_8\">Section   142<\/a><\/p>\n<p>Cr.P.C   is hereby set aside.   If circumstances warranting such course<\/p>\n<p>exist,   the   District   Collector   (first   respondent)   shall   be   at   liberty   to<\/p>\n<p><span class=\"hidden_text\" id=\"span_2\">W.P.C.No.25525\/06                        4<\/span><\/p>\n<p>pass   appropriate   further   orders   under   <a href=\"\/doc\/529017\/\" id=\"a_9\">Section   142<\/a>   Cr.P.C   but   only<\/p>\n<p>after   hearing   the   petitioner   and   considering   his   contentions.     The<\/p>\n<p>parties   shall   appear   before   the   District   Collector   on   15\/12\/2006   to<\/p>\n<p>continue the proceedings.\n<\/p>\n<p id=\"p_7\">       7.    The   learned   counsel   for   the   fourth   respondent     submits<\/p>\n<p>that   there   is   no   specific   request   to   quash   Annexure   R4(b).     That<\/p>\n<p>technicality   cannot   certainly   restrain   this   court   from   passing   the<\/p>\n<p>above   order   invoking   the   constitutional   jurisdiction   under   <a href=\"\/doc\/1712542\/\" id=\"a_10\">Article<\/p>\n<p>226<\/a><a href=\"\/doc\/1331149\/\" id=\"a_11\">\/227<\/a> <a href=\"\/doc\/445276\/\" id=\"a_12\">Cr.P.C<\/a> in as much as the writ petition when it was filed was<\/p>\n<p>filed assailing an identical order under <a href=\"\/doc\/529017\/\" id=\"a_13\">Section 142<\/a> Cr.P.C passed by<\/p>\n<p>the District  Collector.
