The petitioner has received a charge sheet dated<br \/>\n03.09.1994 holding the petitioner of misbehaviour in public and<br \/>\nthreatening one Mr. Keshwani with his service rifle. Thereafter, a<br \/>\nDepartmental Inquiry was initiated against the petitioner, which<br \/>\nconcluded on 02.05.1995. The petitioner received a Show Cause Notice<br \/>\ndated 17.05.1995 from  respondent No. 1 asking the petitioner to show<br \/>\ncause as to why the petitioner should not be dismissed from service.<br \/>\nThe petitioner has replied to the said show cause notice and vide<br \/>\norder dated 29.09.1995, petitioner was dismissed from service relying<br \/>\nupon the report submitted by the Disciplinary Authority. The<br \/>\npetitioner has filed appeal against the order of  respondent No.1.<br \/>\nDuring the pendency of the appeal, the petitioner has preferred<br \/>\npetition before this Court  which came to be withdrawn.  Thereafter,<br \/>\nrespondent No. 1 vide order dated 12.04.1996 has passed order in<br \/>\nappeal dismissing the same. Being aggrieved by and dissatisfied with<br \/>\nthe order passed in appeal, the petitioner has preferred present<br \/>\npetition.\n<\/p>\n<p id=\"p_2\">3.0\tLearned<br \/>\nadvocate for the petitioner further contended that the only role<br \/>\nattributed to the petitioner was that he had  asked the said Keshwani<br \/>\nto close down his shop since the situation was tense and still curfew<br \/>\nwas being imposed due to tense situation. However, the said<br \/>\nMr.Keshwani, rushed to the Police station and registered a complaint<br \/>\nagainst the petitioner. On the said false complaint, the inquiry took<br \/>\nplace and the petitioner has been dismissed from service without any<br \/>\nfault on the part of the petitioner.\n<\/p>\n<p id=\"p_3\">3.1\tLearned<br \/>\nadvocate for the petitioner has further contended that Mr. Keshwani<br \/>\nhad admitted before the Disciplinary Authority that no such incident<br \/>\nhad taken place and he filed the complaint in the spurt of the<br \/>\nmoment. He has further submitted that charge-sheet issued to the<br \/>\npetitioner alleges misconduct and threatening with service rifle<br \/>\nwhereas the Disciplinary Proceedings have proceeded on the footing<br \/>\nthat the petitioner has demanded Rs. 25\/- from the said Mr. Keshwani.<br \/>\nLearned advocate for the petitioner has contended that in examination<br \/>\nof Keshwani, it is stated that in the reply dated 08.01.1993 and<br \/>\n07.02.1993, the facts are not true. Mr.Keshwani has only singed on<br \/>\nthe reply. He was not aware about the fact mentioned in the reply. He<br \/>\nhas turned hostile. Hence, Mr. Keshwani has not supported the case of<br \/>\nthe prosecution. Learned advocate submitted that there is no evidence<br \/>\non record against the petitioner. In that view, the orders passed by<br \/>\nthe respondents are required to be quashed and set aside.\n<\/p>\n<p id=\"p_4\">4.0\tLearned<br \/>\nAssistant Government Pleader for the respondent has submitted that<br \/>\nthe order passed by both the authorities are just and proper. He<br \/>\nsubmitted that the scope of judicial review is very limited and being<br \/>\ndisciplinary authorities, the said misconduct of the petitioner<br \/>\ncannot be allowed for law and order situation. It is required to be<br \/>\nnoted that disciplinary force creates consideration of lawlessness<br \/>\ninasmuch as using revolver for said revolver, crime will lead to very<br \/>\nserious consideration. It will not be open for this Court to<br \/>\nsubstitute the order of the appellate authority to maintain the law<br \/>\nand order situation and disciplinary force.\n<\/p>\n<p id=\"p_5\">5.0\tI<br \/>\nhave heard Mr. Pandya, learned advocate for the petitioner and Mr.<br \/>\nJ.K. Shah, learned Assistant Government Pleader for the respondent.<br \/>\nThe charges which are levelled against the petitioner are very<br \/>\nserious. In my view, when  gross misbehaviour  of the petitioner is<br \/>\nvery serious, and when the presence of the petitioner at the shop of<br \/>\nMr. Keshwani is proved and the petitioner has threatened to kill to<br \/>\nMr. Keshwani with service rifle, the authority has rightly considered<br \/>\nthe evidence on record and has rightly come to the conclusion that<br \/>\nthe order of dismissal is just and proper. If such a disciplinary<br \/>\nforce itself violates the law, it will be more serious.\n<\/p>\n<p id=\"p_6\">6.0\tIn<br \/>\nview of the above, the orders passed by both the authorities are just<br \/>\nand proper. The petition is dismissed.
