Considering<br \/>\nthe facts and circumstances of the case and more particularly the<br \/>\nsubmissions, so also the impugned judgment and decree, it transpires<br \/>\nthat arguable issues are involved in this matter, which warrant<br \/>\nadmission of the appeal.
