Interlocutory Application No. 5081 of 2011:\n<\/p>\n<blockquote id=\"blockquote_1\"><p>                               The delay of 65 days occurred in filing the Letters<br \/>\n                Patent Appeal is condoned.\n<\/p><\/blockquote>\n<blockquote id=\"blockquote_1\"><p>                               Interlocutory Application stands disposed of.<br \/>\n                Re. Letters Patent Appeal No. 1098 of 2011:\n<\/p><\/blockquote>\n<blockquote id=\"blockquote_2\"><p>                               This Appeal under Clause 10 of the Letters Patent is<br \/>\n                preferred by the writ petitioner against the order dated 4 th February<br \/>\n                2011 made by the learned single Judge in above CWJC No. 8760<br \/>\n                of 2010.\n<\/p><\/blockquote>\n<blockquote id=\"blockquote_3\"><p>                               The appellant, a Staff Nurse in the Government<br \/>\n<span class=\"hidden_text\" id=\"span_1\">           Patna High Court LPA No.1098 of 2011 (2) dt.29-07-2011<\/span><\/p>\n<p><span class=\"hidden_text\" id=\"span_1\">                                                     2<\/span><\/p>\n<p>                       Medical College is aggrieved on account of non-payment of her<br \/>\n                       salary for the period from 1st September 1998 to 11th April 1999.<br \/>\n                       For redressal of the said grievance after rejection of her claim by<br \/>\n                       the respondent authorities on 25th September 2006, she approached<br \/>\n                       this court as late as in the month of May 2010.\n<\/p><\/blockquote>\n<blockquote id=\"blockquote_4\"><p>                                        The learned single Judge has rejected the claim as<br \/>\n                       barred by delay and laches. Therefore, the present Appeal.\n<\/p><\/blockquote>\n<blockquote id=\"blockquote_5\"><p>                                        Learned advocate Mr. Sanjay Kumar Verma has<br \/>\n                       appeared for the appellant. He has strenuously urged that the<br \/>\n                       appellant pursued her legitimate claim for salary continuously. Her<br \/>\n                       claim could not have been rejected as barred by delay and laches.\n<\/p><\/blockquote>\n<blockquote id=\"blockquote_6\"><p>                                        We see no substance in the submission made by Mr.<br \/>\n                       Sanjay Verma. A petition under <a href=\"\/doc\/1712542\/\" id=\"a_1\">Article 226<\/a> of the Constitution in<br \/>\n                       respect of a stale claim need not be entertained. The learned single<br \/>\n                       Judge has rightly rejected the claim as barred by delay and laches.\n<\/p><\/blockquote>\n<blockquote id=\"blockquote_7\"><p>                                        No case for interference is made out. The Appeal is<br \/>\n                       dismissed in limine.<\/p><\/blockquote>\n<pre id=\"pre_1\">\n\n\n\n                                                      (R.M.
