Opposite parties\n\n                                    ******\nHon'ble Rajiv Sharma, J.\n<\/pre>\n<p id=\"p_1\">      Heard learned Counsel for the petitioner and learned<br \/>\nStanding Counsel.\n<\/p>\n<p id=\"p_1\">      Through the instant writ petition under <a href=\"\/doc\/1712542\/\" id=\"a_1\">Article 226<\/a> of the<br \/>\nConstitution of India, the petitioner has assailed the order of<br \/>\ntransfer dated 13.1.2010 passed by the opposite party No.3-<br \/>\nDirector General of Police, Uttar Pradesh, Lucknow, whereby the<br \/>\npetitioner has been transferred from Gonda to Shrawasti on the<br \/>\nground of public interest.\n<\/p>\n<p id=\"p_2\">      Learned    Counsel      for     the     petitioner     submits      that   the<br \/>\npetitioner, while working as Constable, has been transferred from<br \/>\nGonda to Shrawasti by the impugned order dated 13.1.2010<br \/>\npassed by the opposite party No. 3-Director General of Police,<br \/>\nUttar Pradesh, Lucknow, without following the guidelines laid<br \/>\ndown by the Hon&#8217;ble Apex Court in Prakash Singh and others<br \/>\nversus Union of India and others [(2006) 8 SCC 1], wherein<br \/>\nthe Hon&#8217;ble Apex Court had directed that the transfer orders shall<br \/>\nbe passed by the Police Establishment Board itself meaning<br \/>\nthereby, the Board should apply mind with regard to transfer of<br \/>\nincumbent from one place to other but in the present case,<br \/>\noriginally, the order of transfer was passed by the Deputy<br \/>\nInspector General of Police.\n<\/p>\n<p id=\"p_3\">      Learned counsel for the petitioner has invited attention<br \/>\ntowards para 31 (5) of the judgment of Hon&#8217;ble Supreme Court in<br \/>\nthe case of Prakash Singh (supra). For convenience, relevant<br \/>\nportion of the said judgment is reproduced as under:\n<\/p>\n<blockquote id=\"blockquote_1\"><p>              &#8220;Police Establishment Board:\n<\/p><\/blockquote>\n<blockquote id=\"blockquote_1\"><p>              (5)     There         shall      be      a      Police<br \/>\n              Establishment Board in each State which<br \/>\n              shall   decide        all   transfers,       postings,<br \/>\n              promotions and other service related<br \/>\n<span class=\"hidden_text\" id=\"span_1\">                                     2<\/span><\/p>\n<p>             matters of officers of and below the rank<br \/>\n             of Deputy Superintendent of Police. The<br \/>\n             Establishment        Board       shall   be    a<br \/>\n             departmental        body     comprising       the<br \/>\n             Director General of Police and four other<br \/>\n             senior officers of the Department. The<br \/>\n             State Government may interfere with<br \/>\n             decision of the Board in exceptional<br \/>\n             cases only after recording its reasons for<br \/>\n             doing so. The Board shall also be<br \/>\n             authorized      to      make        appropriate<br \/>\n             recommendations             to     the    State<br \/>\n             Government regarding the posting and<br \/>\n             transfers of officers of and above the<br \/>\n             rank of Superintendent of Police, and<br \/>\n             the Government is expected to give due<br \/>\n             weight to these recommendations and<br \/>\n             shall normally accept it. It shall also<br \/>\n             function as a forum of appeal                 for<br \/>\n             disposing      of     representations     from<br \/>\n             officers of the rank of Superintendent of<br \/>\n             Police   and        above    regarding     their<br \/>\n             promotion\/          transfer\/       disciplinary<br \/>\n             proceedings or their being subjected to<br \/>\n             illegal or irregular orders and generally<br \/>\n             reviewing the functioning of the police in<br \/>\n             the State.&#8221;<\/p><\/blockquote>\n<p id=\"p_4\">      On the other hand, learned Standing Counsel does not<br \/>\ndispute that the impugned order of transfer has been passed by<br \/>\nthe Police Establishment Board but it has been passed by the<br \/>\nDirector General of Police, Uttar Pradesh, Lucknow on public<br \/>\ninterest.\n<\/p>\n<p id=\"p_5\">      A plain reading of the aforesaid provision indicates that their<br \/>\nlordships at Hon&#8217;ble Supreme Court, have provided that the Board<br \/>\nin each State shall decide all transfers, postings, promotions and<br \/>\nother service related matters of officers of and below the rank of<br \/>\nthe Deputy Superintendent of Police. There is lot of difference<br \/>\nbetween action taken by the decision making body and to place<br \/>\n<span class=\"hidden_text\" id=\"span_1\">                                    3<\/span><\/p>\n<p>decision already taken before the said body for approval. The<br \/>\nletter and spirit of Hon&#8217;ble Supreme Court&#8217;s judgment is that the<br \/>\ndecision should be taken by the Board itself. Meaning thereby, in<br \/>\ncase the Government wants to transfer a police officer, then it<br \/>\nshould refer the matter to the Board and the Board has to apply<br \/>\nits mind for transfer of the police officer from one place to other<br \/>\nkeeping in view the fact and circumstances of a particular case. In<br \/>\nview of the above, the impugned order seems to be violative of<br \/>\nthe judgment in the case of Prakash Singh&#8217;s case (supra). The<br \/>\nwrit petition deserves to be allowed.\n<\/p>\n<p id=\"p_6\">         In view of above, the writ petition is allowed. A writ in the<br \/>\nnature of certiorari is issued quashing the impugned order dated .<br \/>\n13.1.2010 (Annexure-1).
