JUSTICE ABHILASHA KUMARI\n\t\t\n\t\n\n \n\nDate\n: 10\/02\/2011 \n\n \n\n \nORAL\nORDER<\/pre>\n<p id=\"p_1\">\tThis<br \/>\npetition, under <a href=\"\/doc\/1712542\/\" id=\"a_1\">Article 226<\/a> of the Constitution of India, has been<br \/>\nfiled with the following prayers:\n<\/p>\n<p id=\"p_1\">(A)\tadmit<br \/>\nthis petition;\n<\/p>\n<p id=\"p_2\">(B)\tissue<br \/>\nappropriate writ, order or direction directing the concerned<br \/>\nrespondent authorities to decide the representation dated 13\/7\/2010<br \/>\nwith regard to rectification of erroneous dates considered by the<br \/>\nconcerned respondent authorities while extending 1st and<br \/>\n2nd Higher Pay Scales to the petitioner, pursuant to the<br \/>\norder passed by this Hon&#8217;ble Court dt.22\/3\/2010 in Special Civil<br \/>\nApplication No.1197\/2010 as expeditiously as possible in the<br \/>\naforesaid peculiar facts and circumstances of the case;\n<\/p>\n<p id=\"p_3\">(C)\tpending<br \/>\nadmission and final disposal of this petition, be pleased to issue<br \/>\nappropriate writ, order or direction directing the concerned<br \/>\nrespondent authorities to decide the representation dated 13\/7\/2010<br \/>\nwith regard to rectification of erroneous dates considered by the<br \/>\nconcerned respondent authorities while extending 1st and<br \/>\n2nd Higher Pay Scales to the petitioner, pursuant to the<br \/>\norder passed by this Hon&#8217;ble Court dt.22\/3\/2010 in Special Civil<br \/>\nApplication No.1197\/2010 as expeditiously as possible;&#8221;\n<\/p>\n<p id=\"p_4\">\tMr.N.K.Majmudar,<br \/>\nlearned advocate for the petitioner, has submitted that pursuant to<br \/>\norder dated 22.03.2010 passed in Special Civil Application No.1197 of<br \/>\n2010, the petitioner had made a representation to the competent<br \/>\nauthorities to decide the representation of the petitioner, in<br \/>\naccordance with law. However, this representation has not been<br \/>\ndecided till date. It is stated by Mr.N.K.Majmudar, learned counsel<br \/>\nfor the petitioner, that the interest of justice would be met, if<br \/>\nrespondent No.2 is directed to consider and decide representation<br \/>\ndated 13.07.2010 made by the petitioner, expeditiously.\n<\/p>\n<p id=\"p_5\">\tUpon<br \/>\nthe above statement being made by the learned<br \/>\nadvocate for the petitioner, the following order is passed:\n<\/p>\n<p id=\"p_6\">\tRespondent<br \/>\nNo.2 is directed to consider and decide representation dated<br \/>\n13.07.2010 made by the petitioner, in accordance with law, and within<br \/>\na period of three months from the date of receipt of a copy of this<br \/>\norder.\n<\/p>\n<p id=\"p_7\">\tIt<br \/>\nis clarified that while passing this order, the Court has not entered<br \/>\ninto the merits of the case.\n<\/p>\n<p id=\"p_8\">\tThe<br \/>\npetition is disposed of in the above terms.\n<\/p>\n<p id=\"p_9\">\tDirect<br \/>\nService of this order is permitted.\n<\/p>\n<p id=\"p_10\">\t\t\t\t\t\t(Smt.Abhilasha<br \/>\nKumari, J.)<\/p>\n<p>(sunil)<\/p>\n<p>\t\t   \u00a0\u00a0\u00a0<\/p>\n<p>\t\t   Top<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Gujarat High Court Jyotikaben vs State on 10 February, 2011 Author: Abhilasha Kumari,&amp;Nbsp;
