DAVE\n\t\t\n\t\n\n \n\n \n \n\n\n \n\nDate\n: 27\/12\/2010 \n\n \n\nORAL\nORDER<\/pre>\n<p id=\"p_1\">This<br \/>\n\tapplication is filed under <a href=\"\/doc\/1290514\/\" id=\"a_1\">Section 439<\/a> of the Code of Criminal<br \/>\n\tProcedure in connection with First Information Report registered at<br \/>\n\tC.R.No.I &#8211; 26 of 2010 with Okha Police Station, Jamnagar for<br \/>\n\tthe offences punishable under <a href=\"\/doc\/647828\/\" id=\"a_1\">Sections 307<\/a>, <a href=\"\/doc\/1328656\/\" id=\"a_2\">325<\/a>, <a href=\"\/doc\/445276\/\" id=\"a_3\">504<\/a>, <a href=\"\/doc\/445276\/\" id=\"a_4\">506(2)<\/a>, <a href=\"\/doc\/872363\/\" id=\"a_5\">143<\/a>,<br \/>\n\t<a href=\"\/doc\/1154131\/\" id=\"a_6\">147<\/a> and <a href=\"\/doc\/791362\/\" id=\"a_7\">148<\/a> etc. of<a href=\"\/doc\/1569253\/\" id=\"a_8\"> the Indian Penal Code<\/a> and Section 135(1) Bombay<br \/>\n\tPolice Act.\n<\/p>\n<p id=\"p_1\">Learned<br \/>\n\tcounsel appearing for the applicants submits that the charge-sheet<br \/>\n\tis filed and there are allegations of inflicting stick blow and<br \/>\n\tthereby causing injuries on hands and knees, which resulted into<br \/>\n\tfracture, therefore, it cannot be said that the applicant had<br \/>\n\tintention to kill the deceased.  It is further submitted that<br \/>\n\tco-accused is enlarged on bail and considering the facts and<br \/>\n\tcircumstances of the case, the applicants may be enlarged on bail.\n<\/p>\n<p id=\"p_2\">Learned<br \/>\n\tAPP for the respondent &#8211; State submits that the role of the<br \/>\n\tapplicant in inflicting the injuries has surfaced on record by<br \/>\n\tfiling of charge-sheet and the injured was hospitalized for about 24<br \/>\n\tdays and after treatment, he was discharged and, therefore, the<br \/>\n\tapplicant may not be enlarged on bail.\n<\/p>\n<p id=\"p_3\">Having<br \/>\n\theard learned counsel for the parties and perused the record of the<br \/>\n\tcase and considering the facts and circumstances of the case and<br \/>\n\tnature of allegations levelled against the applicants and usage of<br \/>\n\tstick mostly on hands and knees and a fracture is noticed, at this<br \/>\n\tstage when the charge-sheet is filed,  I am inclined to enlarge the<br \/>\n\tapplicants on bail.\n<\/p>\n<p id=\"p_4\">In<br \/>\n\tthe facts and circumstances of the case, the application is allowed<br \/>\n\tand the applicants are  ordered to be released on bail in connection<br \/>\n\twith First Information Report registered at C.R.No.I &#8211; 26 of<br \/>\n\t2010 with Okha Police Station, Jamnagar, on executing bond of<br \/>\n\tRs.5,000\/- [Rupees Five Thousand Only]  each with one surety of the<br \/>\n\tlike amount to the satisfaction of the trial Court and subject to<br \/>\n\tthe conditions that they shall;\n<\/p>\n<p id=\"p_5\">\t(a)\tnot<br \/>\ntake undue advantage of liberty or misuse liberty;\n<\/p>\n<p id=\"p_6\">(b)\tnot act in<br \/>\na manner injurious to the interest of the prosecution;\n<\/p>\n<p id=\"p_7\">(c)\tsurrender<br \/>\ntheir passports, if any, to the lower Court within a week;\n<\/p>\n<p id=\"p_8\">(d)\tnot leave<br \/>\nthe State of Gujarat without prior permission of the Sessions Judge<br \/>\nconcerned;\n<\/p>\n<p id=\"p_9\">(e)\tmark their<br \/>\npresence at the concerned Police Station on the first Sunday of every<br \/>\nmonth between 10.00 a.m and 3.00 p.m for three months only;\n<\/p>\n<p id=\"p_10\">(f)\tfurnish the<br \/>\npresent address of residence to the Investigating Officer and also to<br \/>\nthe Court at the time of execution of the bond and shall not change<br \/>\nthe residence without prior permission of this Court;\n<\/p>\n<p id=\"p_11\">The<br \/>\n\tAuthorities will release the applicants only if they are not<br \/>\n\trequired in connection with any other offence for the time being.\n<\/p>\n<p id=\"p_12\">If<br \/>\n\tbreach of any of the above conditions is committed, the Sessions<br \/>\n\tJudge concerned will be free to issue warrant or take appropriate<br \/>\n\taction in the matter.\n<\/p>\n<p id=\"p_13\">Bail<br \/>\n\tbond to be executed before the lower Court having jurisdiction to<br \/>\n\ttry the case.\n<\/p>\n<p id=\"p_14\">At<br \/>\n\tthe trial, the trial Court shall not be influenced by the<br \/>\n\tobservations of preliminary nature, qua the evidence at this stage,<br \/>\n\tmade by this Court while enlarging the applicant on bail.\n<\/p>\n<p id=\"p_15\">Rule<br \/>\n\tis made absolute to the aforesaid extend.
