Rule returnable forthwith,  Mr.Dani i\/b   waives service for the<br \/>\n     respondent.  By consent heard forthwith.\n<\/p>\n<p id=\"p_4\">     2.      By   this   petition,   petitioner   challenges   the   order   dated   6<br \/>\n     December   passed   by   the   District   Judge-1,   Khed,   District   Pune <\/p>\n<p>     rejecting   his   application   under   section   47   of   the   Code   of   Civil<br \/>\n     Procedure.\n<\/p>\n<p id=\"p_5\">     3.      Petitioner   is   the   judgment   debtor.     An   award   was   passed<br \/>\n     against   the   petitioner   in   an   arbitration   proceedings   under   the <\/p>\n<p><span class=\"hidden_text\" id=\"span_1\">                                                         ::: Downloaded on &#8211; 09\/06\/2013 17:19:25 :::<\/span><br \/>\n<span class=\"hidden_text\" id=\"span_1\">                                          2                        CRA No.396\/11<\/span><\/p>\n<p>     Arbitration   and   <a href=\"\/doc\/1306164\/\" id=\"a_1\">Conciliation   Act<\/a>   1996   (for   short   &#8220;the   <a href=\"\/doc\/1052228\/\" id=\"a_1\">Arbitration<br \/>\n     Act<\/a>&#8220;).  As the award was not satisfied, respondent put the award in <\/p>\n<p>     execution.  At the first instance, the petitioner made an application<br \/>\n     at Exhibit 12 before the executing court contending that award was <\/p>\n<p>     not executable on seven grounds viz:\n<\/p>\n<blockquote id=\"blockquote_1\"><p>              1.    There was no subsisting contractual agreement <\/p>\n<p>              between the parties.\n<\/p><\/blockquote>\n<blockquote id=\"blockquote_1\"><p>              2.      The   arbitration   agreement   was   not   at   all   in<br \/>\n              existence between the parties.\n<\/p><\/blockquote>\n<blockquote id=\"blockquote_2\"><p>              3.      Mr.Aagharkar   was   never   appointed   as   an <\/p>\n<p>              arbitrator.\n<\/p><\/blockquote>\n<blockquote id=\"blockquote_3\"><p>              4.      The   alleged   dispute   was   never   referred   to <\/p>\n<p>              Mr.Vilas Aagharkar.\n<\/p><\/blockquote>\n<blockquote id=\"blockquote_4\"><p>              5.      The   arbitrator   is   self   appointed   arbitrator,<br \/>\n              hence he was prohibited by law to proceed with the <\/p>\n<p>              arbitration proceedings.\n<\/p><\/blockquote>\n<blockquote id=\"blockquote_5\"><p>              6.      The   proceeding   and   award   made   by   the<br \/>\n              alleged arbitrator is illegal and void.\n<\/p><\/blockquote>\n<blockquote id=\"blockquote_6\"><p>              7.      The   decree   passed   by   arbitrator   without <\/p>\n<p>              jurisdiction was nullity and void.<\/p><\/blockquote>\n<p id=\"p_6\">            By its order dated 7 August 2009, the executing court rejected<br \/>\n     the application.\n<\/p>\n<p id=\"p_7\">     4.     Petitioner   filed   writ   petition   no.2600   of   2011   against   the<br \/>\n     order of the executing court dated 7 August 2009.  The writ petition <\/p>\n<p><span class=\"hidden_text\" id=\"span_2\">                                                         ::: Downloaded on &#8211; 09\/06\/2013 17:19:25 :::<\/span><br \/>\n<span class=\"hidden_text\" id=\"span_3\">                                          3                        CRA No.396\/11<\/span><\/p>\n<p>     came up for hearing before this court on 7 July 2010.  At that time,<br \/>\n     counsel for the petitioner made a statement that petitioner had filed <\/p>\n<p>     a   substantive   suit   raising   the   issues   which   were   the   very   issues<br \/>\n     raised   in   the   writ   petition   and   therefore,   the   petitioner   may   be <\/p>\n<p>     allowed   to   withdraw   the   writ   petition   with   liberty   to   pursue   the<br \/>\n     alternative   remedy.     By   an   order   dated   7   July   2010,   this   court<br \/>\n     permitted the petitioner to withdraw the writ petition with liberty to <\/p>\n<p>     pursue alternative remedy without expressing any opinion as to the<br \/>\n     maintainability   of   the   alternative   remedy.     It   appears   that   the<br \/>\n     alternative remedy was not pursued by the petitioner and the suit <\/p>\n<p>     filed by it is still pending in the trial court.  In the mean while, the <\/p>\n<p>     petitioner   made   a   fresh  application  before  the   executing   court  at<br \/>\n     Exhibit 25 on 8 January 2010 again contending that the decree was <\/p>\n<p>     not executable.  The ground raised in Exhibit-25 were similar to the<br \/>\n     grounds raised earlier with one additional ground   that the award<br \/>\n     was obtained by fraud and therefore was void and not executable.\n<\/p>\n<p id=\"p_8\">     By   an   order   dated   6   April   2011   (wrongly   typed   as   &#8220;6   December <\/p>\n<p>     2011&#8221;), the application was rejected.  That order is impugned in the<br \/>\n     present petition.\n<\/p>\n<p id=\"p_9\">     5.     In   my   view,   the   application   (exhibit-25)   is   totally<br \/>\n     misconceived.   The petitioner cannot be allowed to raise the very<br \/>\n     same contentions over and over again merely by adding one more <\/p>\n<p>     ground of   fraud.   He cannot object to the execution of the very<br \/>\n     award on the ground that it is under principles of res judicata as<br \/>\n     well as constructive res judicata applies to the different stages of the<br \/>\n     same proceedings.   A ground of challenge which could have been<br \/>\n     raised at the first instance at an interim stage of the suit and has not <\/p>\n<p><span class=\"hidden_text\" id=\"span_4\">                                                         ::: Downloaded on &#8211; 09\/06\/2013 17:19:25 :::<\/span><br \/>\n<span class=\"hidden_text\" id=\"span_5\">                                              4                          CRA No.396\/11<\/span><\/p>\n<p>     been   raised,   cannot     be   allowed   to   be   raised   at   any   subsequent<br \/>\n     interim stage in the very proceedings.  The ground that the award is <\/p>\n<p>     a nullity as it was obtained by fraud could  have been raised by the<br \/>\n     petitioner when he made an application at Exhibit-12.   He did not <\/p>\n<p>     raise   it.     Even   in   the   writ   petition   filed   against   the   order   of   the<br \/>\n     executing   court   rejecting   Exhibit   12,   he   did   not   raise   the   said<br \/>\n     ground   but   withdrew   the   writ   petition.     He   cannot   file   another <\/p>\n<p>     application again contending that the award is void as it is obtained<br \/>\n     by fraud.   In my view, the second application was an abuse of the<br \/>\n     process of the court.   Learned District Judge has therefore rightly <\/p>\n<p>     rejected   it.
