Singh\n\nHon'ble Pankaj Mithal,J.\n<\/pre>\n<p id=\"p_1\">      This first appeal from order was decided by me vide judgment<br \/>\nand order dated 31.8.2009.\n<\/p>\n<p id=\"p_1\">      The owners of the land i.e. Satya Narain Rai and another have<br \/>\nmoved application no.255782 of 2009 for review of the aforesaid<br \/>\njudgment and order under Order 47 Rule 1 C.P.C.\n<\/p>\n<p id=\"p_2\">      The builder\/respondent has moved application no.333999 of<br \/>\n2009 for modification of the above judgment and order.\n<\/p>\n<p id=\"p_3\">      The dispute involved in the above appeal had arisen out of an<br \/>\nagreement between the parties dated 10.8.2004 which contained an<br \/>\narbitration clause and where under the property was to be developed<br \/>\nby the builder. On account of dispute under the said agreement the<br \/>\nbuilder applied under <a href=\"\/doc\/1120409\/\" id=\"a_1\">Section 9<\/a> of the Arbitration and <a href=\"\/doc\/1306164\/\" id=\"a_1\">Conciliation Act<\/a><br \/>\nfor interim protection. The said application after due contest was<br \/>\nallowed by the District Judge vide judgment and order dated<br \/>\n23.4.2008. It restrained the owners from interfering in the completion<br \/>\nof the construction over the land in dispute and both the parties were<br \/>\nrestrained from transferring any flat unless the share of each of them<br \/>\nin the ratio 40:60 as per the agreement is demarcated. In appeal, by<br \/>\njudgment and order under review\/modification, a part of the aforesaid<br \/>\nimpugned judgment and order was set aside in so far as it restrained<br \/>\nthe owners from interfering with the construction work of the builder<br \/>\nbut the other part of the order restraining transfer of any flat by the<br \/>\n<span class=\"hidden_text\" id=\"span_1\">                                                                            2<\/span><\/p>\n<p>parties till the determination of the share of each of them was<br \/>\nmaintained.\n<\/p>\n<p id=\"p_4\">       I have heard Sri A.K.Singh, learned counsel for the owners<br \/>\nand Sri Naveen Sinha, Senior Advocate for the builder on the above<br \/>\napplications.\n<\/p>\n<p id=\"p_5\">       Sri A.K.Singh placing reliance upon the application of the<br \/>\nbuilder moved under <a href=\"\/doc\/1120409\/\" id=\"a_2\">Section 9<\/a> of the Arbitration and <a href=\"\/doc\/1306164\/\" id=\"a_3\">Conciliation Act<\/a><br \/>\nsubmitted that the prayer made therein was only to restrain the<br \/>\nowners from creating hindrance in construction work of the builder<br \/>\nuntil they do not pay or return the money along with interest which<br \/>\nthey had taken as advance and not to transfer ground floor flat no.2<br \/>\nand 3 of the Awadh Apartment, Varanasi. Therefore, the order of this<br \/>\nCourt dated 31.8.2009 restraining the parties from transferring any<br \/>\nflat or part of the developed property till the determination of the<br \/>\nshare of each of them as per the agreement is beyond the scope of<br \/>\nthe prayer for interim protection made in the application.\n<\/p>\n<p id=\"p_6\">       The submission in the first flash appears to have some force<br \/>\nbut on a little scrutiny I find that it has no legs to stand, particularly on<br \/>\na review application where the scope is extremely limited and<br \/>\nconfined to an error apparent on the face of the record.\n<\/p>\n<p id=\"p_7\">       The Court of first instance in its judgment and order has<br \/>\nreturned a finding that the builder under the agreement was required<br \/>\nto develop and raise constructions over the land in question in three<br \/>\nblocks within a specified time but he only constructed one block of the<br \/>\nbuilding and the other two blocks were left out. The share of the<br \/>\nparties in the whole of the developed property is in the ratio of 40:60,<br \/>\nas per the agreement, determination of which is only possible after<br \/>\ncompletion of the development\/construction of the entire property.<br \/>\nSince the development\/construction of the entire property is not<br \/>\ncomplete so as to clearly determine and demarcate the share of each<br \/>\nof them, it is just and proper to restrain both the parties from making<br \/>\nany transfer of any flat so constructed.\n<\/p>\n<p><span class=\"hidden_text\" id=\"span_1\">                                                                      3<\/span><\/p>\n<p id=\"p_8\">       In appeal, this part of the order was not specifically assailed<br \/>\nand no error in respect of this part of the restrain order was pointed<br \/>\nout, probably for the reason that the restrain order was applicable to<br \/>\nboth the parties. Accordingly, this part of the order was not touched<br \/>\nby me while deciding the appeal and was maintained as such.\n<\/p>\n<p id=\"p_9\">       It is for the first time through this review application that a<br \/>\ntechnical objection as aforesaid has been raised which I do not<br \/>\nconsider to be of any substance particularly when no argument on the<br \/>\naforesaid point were advanced during the course of hearing of the<br \/>\nappeal.\n<\/p>\n<p id=\"p_10\">       The builder claimed restrain order against the owners in<br \/>\nrespect of flats no.2 and 3 on the ground floor as admittedly only<br \/>\nthese two flats were said to have fallen to the share of the owners.<br \/>\nThe owners had not disputed the above and had not laid any specific<br \/>\nclaim on any other flat or part of the developed property in the<br \/>\npleadings. Thus, the owners in no way acquire any right to transfer<br \/>\nany other flat and could not legally transfer even flats no.2 and 3 as<br \/>\ntheir shares were not finally determined. Therefore, the restrain order<br \/>\nupon the owners from transferring any flat\/part of the developed<br \/>\nproperty does not in any way cause any prejudice to them, as they<br \/>\nare otherwise not legally entitle to transfer the other flats.\n<\/p>\n<p id=\"p_11\">       The builder is not aggrieved by the said restrain order.\n<\/p>\n<p id=\"p_12\">       In view of aforesaid facts and circumstances, I do not find any<br \/>\nforce in the review application.\n<\/p>\n<p id=\"p_13\">       The modification application is to the effect that the owners<br \/>\nmay also be restrained from carrying out construction work on the<br \/>\nland in dispute.\n<\/p>\n<p id=\"p_14\">       The agreement under which the property was to be developed<br \/>\nhas come to an end. The findings of the court of the first instance are<br \/>\nto the effect that the conduct of the developer had not been fair and<br \/>\nhe had prima facie breached the terms of the agreement and had<br \/>\n<span class=\"hidden_text\" id=\"span_2\">                                                                      4<\/span><\/p>\n<p>failed to complete the development work within the time stipulated or<br \/>\nthe extended time including the period during which the matter<br \/>\nremained pending for permission\/sanction of the map before the<br \/>\nVaranasi Development Authority, Varanasi. Once the agreement has<br \/>\ncome to an end no embargo on the rights of the owners of the<br \/>\nproperty can be placed.\n<\/p>\n<p id=\"p_15\">      Above all, the builder has not sought review.\n<\/p>\n<p id=\"p_16\">      The application for modification in terms of the prayer is not<br \/>\neven maintainable when the appeal has been decided. The prayer for<br \/>\nmodification as made does not fall within the power of making any<br \/>\ncorrection.\n<\/p>\n<p id=\"p_17\">      In view of above, the modification application is misconceived<br \/>\nand is devoid of merit.
