SHAH\n\t\t\n\t\n\n \n\nDate\n: 09\/12\/2010 \n\n \n\n \nORAL\nORDER<\/pre>\n<p id=\"p_1\">1.\tRule.\n<\/p>\n<p id=\"p_1\"> Ms. Krina Calla, learned<br \/>\nAdditional Public Prosecutor waives service of notice of Rule on<br \/>\nbehalf of respondent No.1 &#8211; State.  In the facts and<br \/>\ncircumstances of the case and with the consent of learned advocates<br \/>\nappearing on behalf of the respective parties, application is taken<br \/>\nup for final hearing today.\n<\/p>\n<p id=\"p_2\">2.\tPresent<br \/>\napplication has been preferred by the applicant original accused &#8211;<br \/>\nconvict Kiritbhai Kanubhai Desai through jail for an appropriate<br \/>\norder to quash and set aside the action of the respondent No.3 &#8211;<br \/>\nI.G. (Prison) to forfeit his 6\/7 furlough leaves and also to quash<br \/>\nand set aside the order passed by the I.G. (Prison) rejecting his<br \/>\napplication for furlough leave on the ground that he was absconding<br \/>\nfor the period between 2001 to 2010.\n<\/p>\n<p id=\"p_3\">3.\tFrom<br \/>\nthe application it appears that it is the case on behalf of the<br \/>\napplicant that on one hand his 6\/7 furlough leaves which is earned by<br \/>\nhim for the period between 2001 to 2010 is taken away and on the<br \/>\nother hand on the aforesaid<br \/>\nground his subsequent furlough application has been<br \/>\nrejected.  The aforesaid has no substance.  While the applicant was<br \/>\nabsconding for the period between 2001 to 2010, he was not in<br \/>\nimprisonment and therefore, it cannot be said that he had earned any<br \/>\nfurlough leaves for the aforesaid period.  He is entitled to furlough<br \/>\nleave provided he is in imprisonment.  It is to be noted that for 10<br \/>\nyears i.e. for the period between 2001 to 2010, he was absconding and<br \/>\ntherefore, it cannot be said that the authority has committed any<br \/>\nerror and\/or illegality in rejecting the application submitted by the<br \/>\napplicant to release him on furlough leave.\n<\/p>\n<p id=\"p_4\">4.\tIn<br \/>\nview of the above and for the reasons stated above, there is no<br \/>\nsubstance in the present application which deserves to be dismissed<br \/>\nand is, accordingly, dismissed.
