Mr.S.C.Herold Singh\n\t\t      Govt.Advocate\n\n:ORDER\n<\/pre>\n<p id=\"p_1\">\tThis Writ Petition has been filed praying for the issuance of a Writ of<br \/>\nMandamus, to direct the first respondent to order reinvestigation of the case,<br \/>\nin Cr.No.102 of 2008, on the file of the Inspector of Police, Sellur Police<br \/>\nStation, Madurai City, by the C.B.C.I.D and to pass further orders.\n<\/p>\n<p id=\"p_1\">\t2. The petitioner has stated that his son Sivasankar, aged about 30 years,<br \/>\nwas working as  a Manager in the &#8216;Best Petrol Bunk&#8217;, situated  on the Thathaneri<br \/>\nMain Road, Opposite to E.S.I Hospital, Madurai City.  The owner of the petrol<br \/>\nbunk belongs to Sathankulam in Tirunelveli District  and he has been residing in<br \/>\nMalaysia.  In such circumstances, the petitioner&#8217;s son Sivasankar, had been<br \/>\nmanaging the petrol bunk. Due to certain disputes, which had arisen amongst the<br \/>\nfamily members of the owner of the petrol bunk, namely, Mr.Daseerkhan, the<br \/>\npetitioner&#8217;s son had been threatened to settle certain accounts. While so, on<br \/>\n22.01.2008, at about 12.30 a.m., the petitioner&#8217;s son,  who was working in the<br \/>\npetrol bunk  had been murdered on the instigation of certain persons.  A case<br \/>\nhad been registered by the Thallakulam Traffic Investigation  Police Wing-II, in<br \/>\nCr.No.29 of 2008, under <a href=\"\/doc\/1371604\/\" id=\"a_1\">Section 304-A<\/a> of the Indian Penal Code as if the<br \/>\npetitioner&#8217;s son had died due to a motor vehicle accident. Thereafter, since<br \/>\nstab injuries had been found on the body of the deceased, the case had been<br \/>\naltered,  on 23.01.2008, as homicide, under <a href=\"\/doc\/1560742\/\" id=\"a_2\">Section 302<\/a> read with <a href=\"\/doc\/513074\/\" id=\"a_3\">Section 109<\/a> of<br \/>\nthe Indian Penal Code. The petitioner had also filed a case before this Court,<br \/>\nin Crl.O.P.No.3397 of 2008, seeking for a direction to transfer the<br \/>\ninvestigation to C.B.C.I.D and this Court was pleased to direct the  second<br \/>\nrespondent to consider the  representation of the petitioner, dated 18.02.2008<br \/>\nand pass orders, in accordance with law.  Pursuant to the directions issued by<br \/>\nthis Court, the second respondent had directed the Assistant Commissioner of<br \/>\nPolice, Thallakulam, to submit  a report, on the basis of the  petition<br \/>\nsubmitted by the petitioner. The Assistant Commissioner of Police, Thallakulam,<br \/>\nhad submitted a report to the second respondent, stating that investigation by<br \/>\nthe third respondent was proceeding in the right direction.  Challenging the<br \/>\nsaid report, the petitioner had filed a Criminal Original Petition before this<br \/>\nCourt and since, charge-sheet had been filed, this Court was pleased to dispose<br \/>\nof the Criminal Original Petition, on that ground. The petitioner has stated<br \/>\nthat the third respondent had  not investigated the case, impartially and that<br \/>\nhe is colluding with the real accused,  as he has failed to include the name of<br \/>\nthe real accused in the charge-sheet. In such circumstances, the petitioner has<br \/>\nfiled the present Writ Petition before this Court, under <a href=\"\/doc\/1712542\/\" id=\"a_4\">Article 226<\/a> of the<br \/>\nConstitution of India.\n<\/p>\n<p id=\"p_2\">\t3. Mr.S.C.Herold Singh, the learned Government Advocate, appearing on<br \/>\nbehalf of the respondents had submitted  that, on 22.01.2008, a case had been<br \/>\nregistered under <a href=\"\/doc\/1371604\/\" id=\"a_5\">Section 304-A<\/a> of Indian Penal Code and on 23.01.2008, the case<br \/>\nhad been altered and registered under <a href=\"\/doc\/1560742\/\" id=\"a_6\">Section 302<\/a> read wth 109<a href=\"\/doc\/1569253\/\" id=\"a_7\"> of the Indian<br \/>\nPenal Code<\/a>. On 19.05.2008, a charge-sheet had been laid  and on 20.10.2009, the<br \/>\ncase had been taken on file before the concerned Sessions Court, in S.C.No.258<br \/>\nof 2009.\n<\/p>\n<p id=\"p_3\">\t4.  In view of the averments made by the petitioner  in his affidavit<br \/>\nfiled in support of the Writ Petition and on the submissions made by the learned<br \/>\nGovernment Advocate, appearing on behalf of the respondents, this Court does<br \/>\nnot find sufficient cause or reason to grant the relief, as prayed for by the<br \/>\npetitioner, in the present Writ Petition.\n<\/p>\n<p id=\"p_4\">\t5.  From the records available before this Court, it is found that the<br \/>\npetitioner had already moved this Court by way of Crl.O.P.No.3397 of 2008,<br \/>\nseeking for a similar direction, as in the present Writ Petition, to transfer<br \/>\nthe investigation to C.B.C.I.D.  This Court had also directed the second<br \/>\nrespondent to consider the representation of the petitioner, dated 18.02.2009<br \/>\nand pass orders, in accordance with law. Thereafter, the petitioner had filed<br \/>\nanother Criminal Original Petition before this Court, on 03.09.2008, seeking for<br \/>\na direction to transfer the investigation to the file of C.B.C.I.D. However,<br \/>\nthis Court had disposed of the same, since a charge sheet had been laid, at that<br \/>\nstage.  Further, the case had been taken on file, on 20.10.2009, before the<br \/>\nconcerned Sessions Court, in S.C.No.258 of 2009 and it is pending trial.  The<br \/>\nlearned Government Advocate appearing on behalf of the respondent had further<br \/>\nsubmitted that it would be open to the petitioner to approach the concerned<br \/>\ncourt, under <a href=\"\/doc\/274924\/\" id=\"a_8\">Section 173(8)<\/a> of the Criminal Procedure Code, for further<br \/>\ninvestigation, if the petitioner so chooses.\n<\/p>\n<p id=\"p_5\">\t6.  In such circumstances, the present Writ Petition is liable to be<br \/>\ndismissed and hence, it stands dismissed.  Consequently, connected Miscellaneous<br \/>\nPetition is also dismissed.
