MUKHOPADHAYA\n\t\t\n\t\n\t \n\t\t \n\t\t\t \n\n \n\n\t\t\t\n\t\t\n\t\t \n\t\t\t \n\nand\n\t\t\n\t\n\t \n\t\t \n\t\t\t \n\n \n\n\t\t\t\n\t\t\n\t\t \n\t\t\t \n\nHONOURABLE\n\t\t\tMR.JUSTICE J.B.PARDIWALA\n\t\t\n\t\n\n \n\n \n \n\n\n \n\nDate\n: 25\/08\/2011\n \n\nCAV\nJUDGMENT\n<\/pre>\n<p id=\"p_1\">(Per<br \/>\n: HONOURABLE MR.JUSTICE J.B.PARDIWALA)<\/p>\n<p>\tThis<br \/>\n\tis a writ petition filed in Public Interest under <a href=\"\/doc\/1712542\/\" id=\"a_1\">Article 226<\/a> of the<br \/>\n\tConstitution<br \/>\n\tof India seeking appropriate writ, order or<br \/>\n\tdirection against the respondent authorities to take appropriate<br \/>\n\tmeasures to ensure that there is no water logging and drowning of<br \/>\n\tHamlet Anandpura Kampa, Village : Khalikpur.\n<\/p>\n<p id=\"p_1\">\tThis<br \/>\n\tPublic Interest Litigation is preferred by the Khalikpur Gram<br \/>\n\tPanchayat through its Sarpanch. It appears that some work of<br \/>\n\twidening of Halol-Shamlaji highway was undertaken in the year 2004.<br \/>\n\tA small bridge has also been constructed on the river Sankri, as a<br \/>\n\tresult of which, village is facing an acute problem of water logging<br \/>\n\tduring monsoon. It appears that the respondents were informed that<br \/>\n\tbecause of newly constructed road, water which flows above the road<br \/>\n\tgets logged due to height of the road, as a result of which, water<br \/>\n\tis not able to flow across the culvert box and enters hamlet<br \/>\n\tAnandpura. The petitioner has also drawn attention of the Court that<br \/>\n\theight of the road is increased by about 6 feet from the ground<br \/>\n\tlevel and Sakri river is situated at a distance of 700 feet from the<br \/>\n\tvillage. During heavy monsoon, water enters village resulting into<br \/>\n\textensive damage to crops, houses etc. Showing instance of the year<br \/>\n\t2006 when the monsoon was very heavy, compound wall of Primary<br \/>\n\tSchool was also damaged and collapsed. It is also brought to our<br \/>\n\tnotice that school building also got damaged.\n<\/p>\n<p id=\"p_2\">\tIt<br \/>\n\tis also brought to our notice that local MLA of the area, who is<br \/>\n\tMinister in the State Government, was also appraised of this<br \/>\n\tproblem.\n<\/p>\n<p id=\"p_3\">\tTaking<br \/>\n\tinto consideration the nature of the problem and hardships which the<br \/>\n\tvillagers have to face, we passed an order on 08.04.2008, which<br \/>\n\treads as under :-\n<\/p>\n<p id=\"p_4\">\t&#8220;This<br \/>\n\tPublic Interest Litigation has<br \/>\n\tbeen preferred by Khalikpur Gram Panchayat against raising the level<br \/>\n\tof four-lane Highway and construction of a bridge, on the ground<br \/>\n\tthat such raising will create problem of water-logging and drowning<br \/>\n\tof entire hamlet of Anandpura.  In the present case, prima-facie, we<br \/>\n\tdo not find any reason why the Court  should interfere with the<br \/>\n\tconstruction of the highway.  However, if construction at the place<br \/>\n\tcauses water logging, we intend to hear on the question whether<br \/>\n\traising of such highway<br \/>\n\twill cause water-logging and submerging of villages.  If so, then<br \/>\n\twhat steps the respondents intend to take to ensure that the<br \/>\n\tvillages are not submerged.\n<\/p>\n<p id=\"p_5\">\t2\tNotice<br \/>\n\tbe issued on the respondents.  Mr P.K. Jani, learned Government<br \/>\n\tPleader accepts notice on behalf of the first, third and fourth<br \/>\n\trespondents.  Counsel for the petitioner will serve two copies of<br \/>\n\tpaper-book on him by Monday.  Respondents may file reply affidavit<br \/>\n\twithin two weeks.  Direct service is permitted.  Post the petition<br \/>\n\tfor admission on 28th<br \/>\n\tApril 2011.\n<\/p>\n<p id=\"p_6\">\t3\tIn<br \/>\n\tview of the aforesaid order, no further order is required to be<br \/>\n\tpassed in Civil Application No.4569 of 2011.  The same stands<br \/>\n\tdisposed of.&#8221;\n<\/p>\n<p id=\"p_7\">\tAfter<br \/>\n\tthe order was passed asking the respondents as to what steps they<br \/>\n\tintend to take to ensure that villages are not submerged, an<br \/>\n\taffidavit in reply was filed by the respondent no.3-GSRDC taking<br \/>\n\tstand as under :-\n<\/p>\n<p id=\"p_8\">\t&#8220;9.\tIt<br \/>\n\tis submitted that the subject of the petition falls in the project<br \/>\n\tlength of widening the existing two lane to four of Halol-<br \/>\n\tGodhra-Shamlaji State Highway No.5, being carried out by Gujarat<br \/>\n\tState Road Development Corporation Ltd. (a Gujarat Government<br \/>\n\tenteprise) through the concessionaire. The project starts at Halol<br \/>\n\tJunction &amp; traverses in Panchmahal District upto Babalia<br \/>\n\tcrossing &amp; remaining length in Sabarkantha District ends at<br \/>\n\tShamlaji crossing meeting Delhi-Udaipur-Ahmedabad National Highway<br \/>\n\tNo.8. The area stated in the petition falls under the project length<br \/>\n\tin Anandpura Kampa, the hemlet of Khalikpur village of Modasa Taluka<br \/>\n\tin Sabarkantha District. In this village at Km 476.617 of the road,<br \/>\n\tthere is a minor bridge of 4 Nos. of 5.8M. span. In this road<br \/>\n\twidening project on western side of this bridge a similar bridge is<br \/>\n\tbeing built for the traffic of additional two lane. Thus no<br \/>\n\tadditional bridge is constructed as stated by the petitioner. It is<br \/>\n\tfurther submitted that during the work of improvement of road during<br \/>\n\t2003-2005 at Km.476.872, a 3Nosx.0.90m pipe drain was replaced with<br \/>\n\t3.0M.x2.5M. box culvert, due to request of the villagers to increase<br \/>\n\tthe waterway, by the then Executive Engineer, State Road Project<br \/>\n\tDivision, Godhra. Which increased the water way area from 1.90 Sq.M.<br \/>\n\tto 7.50 Sq.M.(almost 4 times).\n<\/p>\n<p id=\"p_9\">\t10.\tWith<br \/>\n\trespect to averments made in para 4 (C) it is submitted that during<br \/>\n\tmonsoon of 2006, heavy rains stormed Gujarat state resulting into<br \/>\n\theavy floods in various districts. The area mentioned in the<br \/>\n\tpetition, situated on Halol-Godhra -Shamlaji road also suffered<br \/>\n\theavy flooding situation. On inspection of the current project of<br \/>\n\twidening of road in year 2009, after visiting the site, studying the<br \/>\n\tsite condition &amp; hearing various representation from local<br \/>\n\tresidents by the authorities. The blockage of water disposal from<br \/>\n\tBox culvert (3.0Mx2.5M) at Km.476.872, (provided earlier in year<br \/>\n\t2005 in lieu of 3 Nosx 0.90M.pipe drain) was cleared by providing<br \/>\n\topen channel.\n<\/p>\n<p id=\"p_10\">\t11.\tWith<br \/>\n\treference to averments made in para 4 (D) of the petition, I state<br \/>\n\tthat the approach road to Anandpura hemlet of Khalikpur vilalge is<br \/>\n\tat Km.476.900 and the minor bridge of 4span of 5.8M. is located at<br \/>\n\tKm. 476.617. The distance between two places if only @ 280M. After<br \/>\n\ttaking into consideration, demands of the lcoal residents,<br \/>\n\tadditional Box culvert of 10.0M.X3.5M. at Km 476.702 for existing as<br \/>\n\twell as additional two lane road was provided which is under<br \/>\n\tconstruction. Thus, the waterway between the affected area is<br \/>\n\tincreased by almost 10 times then the earlier waterway in the road<br \/>\n\tland width in the area of present petition, to avoid any flooding<br \/>\n\tdue to widening or raising of road. This was informed to the local<br \/>\n\tresidents &amp; they were satisfied with this provision.\n<\/p>\n<p id=\"p_11\">\t12.\tWith<br \/>\n\treference to averments made in para 4 (E) of the petition, I state<br \/>\n\tthat as replied in foregoing paragraph, the authorities have taken<br \/>\n\tsufficient care by providing additional waterway to dispose the rain<br \/>\n\twater and avoid any drowning condition for the inhabitants of the<br \/>\n\tpresent petition area. However on downstream of the road, the<br \/>\n\tdisposal of rain water does not fall within the jurisdiction of the<br \/>\n\troad authority.\n<\/p>\n<p id=\"p_12\">\t13.\tWith<br \/>\n\treference to averments made in para 4 (F) to (J), I state that the<br \/>\n\tsame are not substantially correct. I state that reaffirm and<br \/>\n\treiterate what is stated in the foregoing paragraphs. The water way<br \/>\n\tnow provided by the authority is much more then the capacity of the<br \/>\n\tminor river bridge. Hence no further  improvement is necessary.\n<\/p>\n<p id=\"p_13\">\t14.\tWith<br \/>\n\treference to averements made in para 4 (K), I state that the same<br \/>\n\tare not correct. I state that to improve the vertical profile of the<br \/>\n\troad the level are corrected by raising O.O4M. to 0.33M.in the<br \/>\n\tlength from the minor bridge to approach of hemlet Anandpura campa<br \/>\n\tand 100M beyond. In further 2000M length the levels are raised from<br \/>\n\t0.04M. to 0.9M., depending on the profile of the existing road &amp;<br \/>\n\tcorrected vertical profile. But at no location the road is to be<br \/>\n\traised by 4&#8242; or more (i.e.1.2M. or more), as stated in the present<br \/>\n\tpetition. Even during the floods the road was not over toped due to<br \/>\n\tflood water in the near vicinity of the approach road to the hemlet.<br \/>\n\tThus further raising the road level will not affect the rain water<br \/>\n\tdisposal due to heavy rains. No additional obstruction is likely to<br \/>\n\tcause by providing any bridge or other structure. On the contrary<br \/>\n\tthe waterway of box culvert at km 476.672 is cleared by providing<br \/>\n\topen channel on downside of the road.&#8221;\n<\/p>\n<p id=\"p_14\">\tAffidavit<br \/>\n\tin reply has also been filed by one M.G. Patel, Executive Engineer,<br \/>\n\tState Road Project Division, Vadodara, wherein the bank&#8217;s stand has<br \/>\n\tbeen taken as under :-\n<\/p>\n<p id=\"p_15\">\t&#8220;4.\tI<br \/>\n\tstate that we have already informed to the petitioner vide our<br \/>\n\tletter dated 29.12.2006 that the Design of the Halol Godhara,<br \/>\n\tShamraji State High Way No.5 is prepared by the Expert Consultant<br \/>\n\trecognized by the world bank and it was also informed that when the<br \/>\n\tGujarat State Road Development Corporation, Gandhinagar will take<br \/>\n\tthe project on hand for four lanings and upgrading the Road, that<br \/>\n\ttime the provision will be made so that the flow of the water in the<br \/>\n\triver should go faster. For the question raised by the petitioner<br \/>\n\tfor water logging in Sankari River and in the matter we have<br \/>\n\tsuggested the same to the Higher Authority i.e. Superintendent<br \/>\n\tEngineer, National Highway Circle, Vadodara.\n<\/p>\n<p id=\"p_16\">\t5.\tI<br \/>\n\tsubmit that so far as the informing the authority is concerned, I<br \/>\n\tsubmit that we have already informed and suggested higher authority<br \/>\n\tto uggrade the Road Design by some modifications by letter no.<br \/>\n\tPB\/GSHP-7\/66\/07 dated 06.02.2007. Looking to the heavy rainfall in<br \/>\n\tthe monsoon of 2006-07. A copy of the letter dated 06.02.2007 is<br \/>\n\tannexed hereto and marked as Annexure R I to this reply.\n<\/p>\n<p id=\"p_17\">\t6.\tI<br \/>\n\tsay and submit that the three raw 900 mm dia pipe  drain @ chainage<br \/>\n\t476\/862 was replaced by 3 m X 2.5 m box culverts which increased<br \/>\n\twaterway from 1.9 sq.mtrs. (3 raw of 900 mm dia) to 10.00 sq.mtrs.<br \/>\n\t(3.0 X 2.5 mtrs box culverts) increase of around 300%) in 2005,<br \/>\n\twhich was more than demanded. As the water way is increased and the<br \/>\n\tflooded water pass easily and speedily.\n<\/p>\n<p id=\"p_18\">\t7.\tI<br \/>\n\tsay and submit that moreover the Government Road &amp; Building<br \/>\n\tDepartment has closed the office of the Executive Engineer, State<br \/>\n\tRoad Project Division, Godhra dated 31.03.2010. The construction<br \/>\n\tproject of Godhara Shamlaji Road was completed by w.e.f. from dated<br \/>\n\t31.07.2006 which was started from 20.01.2003 and the records of<br \/>\n\tGodhara Division is handed over to Executive Engineer, State Road<br \/>\n\tProject Division, Vadodara vide Government R &amp; B Department<br \/>\n\tResolution NO.EST\/122008\/2323\/36\/G dated 30.03.2010. A copy of the<br \/>\n\tsame is annexed hereto and marked as Annexure R II to this<br \/>\n\treply.&#8221;\n<\/p>\n<p id=\"p_19\">\tHaving<br \/>\n\tgone through the affidavit in replies, we were not satisfied with<br \/>\n\tthe explanation as to how the problem has been taken care of by the<br \/>\n\trespondents. Therefore, on 3rd August, 2008, we passed<br \/>\n\tfollowing order :-\n<\/p>\n<p id=\"p_20\">\t&#8220;An<br \/>\n\taffidavit has been filed on behalf of the third respondent &#8211;<br \/>\n\tGujarat State Road Development Corporation.  Though detailed<br \/>\n\taffidavit has been made, but it has been not made clear as to how<br \/>\n\tmuch water logging which took place during rainy season in adjacent<br \/>\n\tto the road in question due to high-rise road construction.  What<br \/>\n\tremedial measures should be taken to remove water accumulation if<br \/>\n\tthey intend to have cause way or culvert box and as per the<br \/>\n\tagreement if the task is given to one or the other party, then they<br \/>\n\tshould specifically answer to the same and will give time frame to<br \/>\n\tsort out problem.  They should also give specific reply to the query<br \/>\n\tmade by this Court on 8.4.2011 as to whether construction at the<br \/>\n\tplace causes water logging or not.  Though, prima facie, from the<br \/>\n\tphotographs attached with the writ petition at page Nos.74 and 75,<br \/>\n\tit appears that water logging took place during rainy season because<br \/>\n\tof construction of road in question.\n<\/p>\n<p id=\"p_21\">\tIt<br \/>\n\twill be desirable that the Project Director, Gujarat State Road<br \/>\n\tDevelopment Corporation shall remain present in the Court on the<br \/>\n\tnext date. Learned counsel for the third respondent will inform the<br \/>\n\tofficer for his appearance.\n<\/p>\n<p id=\"p_22\">\tPost<br \/>\n\tthe matter on 17.8.2011 within five cases.&#8221;\n<\/p>\n<p id=\"p_23\">\tThe<br \/>\n\trespondent no.3 once again filed an affidavit with photographs and<br \/>\n\tmaps to show that the problem of water logging had cropped up only<br \/>\n\tin the year 2006 when the rains were torrential. In further<br \/>\n\taffidavit filed on behalf of the respondent no.3, it has been<br \/>\n\texplained as under :-\n<\/p>\n<p id=\"p_24\">\t&#8220;2.\tI<br \/>\n\tsay that, I am filing the present affidavit with a view to place on<br \/>\n\trecord the efforts made by the authorities to mitigate the grievance<br \/>\n\tof the petitioner, raised in the captioned petition. I state that I<br \/>\n\thave perused the order passed by this Hon&#8217;ble Court on 03.08.2011<br \/>\n\tand I beg to place on record of this Hon&#8217;ble Court the following<br \/>\n\tdetails pursuant to the same. I state that for redressal of the<br \/>\n\tgrievances of the petitioner as stated in the memo of petition, the<br \/>\n\tauthority have taken adequate measures and due to the same this year<br \/>\n\tthe problem of water logging has not arisen. I state that due to<br \/>\n\tinadvertence the some of the following details could not be placed<br \/>\n\tin my earlier affidavit, and I tender my unconditional apology for<br \/>\n\tthe same.\n<\/p>\n<p id=\"p_25\">\t3.\tIt<br \/>\n\tis submitted that in the present petition, the petitioner has placed<br \/>\n\ton record the photographs of the area whether there was water<br \/>\n\tlogging in the year 2006. It is submitted that, it is true that at<br \/>\n\tthe relevant point of time the problem of water logging was<br \/>\n\tprevailing in the area mentioned in the petition. However, the road<br \/>\n\twas included in the SRP (State Road Projects) in the year 2004-06. I<br \/>\n\tstate that before 2005 pipe culvert of 1.9 sq.mtr. was available for<br \/>\n\tthe purpose of water way, however, in the year 2005 under the SRP<br \/>\n\tproject the same was widened to the extent of 7.5 sq.mtr. It is<br \/>\n\tsubmitted that consequently the decision to further widen the 2 lane<br \/>\n\troad to 4 lane was taken in the 2009. It is submitted that<br \/>\n\taccordingly the work of road widening was taken up and the same at<br \/>\n\tpresent is in the final stage. It is submitted that so far as the<br \/>\n\tarea mentioned in the present petition is concerned, the work of<br \/>\n\troad widening is already completed. It is submitted that as per the<br \/>\n\tpresent project one additional box culvert is already provided as<br \/>\n\tadditional passage for disposal of water. It further submitted that<br \/>\n\tfor the purpose of providing water way, in the present project<br \/>\n\tadditional water way (Channel) is also prepared. Annexed hereto and<br \/>\n\tmarked as Annexure I are the copies of the sketches which<br \/>\n\tclearly indicate that due to the efforts and the work undertaken by<br \/>\n\tthe authorities, the problem of water logging in the area is<br \/>\n\tsubstantially taken care of.\n<\/p>\n<p id=\"p_26\">\t4.\tIt<br \/>\n\tis submitted that after passing of the order by this Hon&#8217;ble Court,<br \/>\n\tI have made site inspection of the area in question on 05.08.2011 as<br \/>\n\twell as on 10.08.2011. I state that in the present season of monsoon<br \/>\n\tno such water logging has taken place till date. Annexed hereto and<br \/>\n\tmarked as Annexure II are the copies of recent photographs,<br \/>\n\twhich clearly indicate that the problem of water logging in the area<br \/>\n\tin question is properly addressed by the authorities by providing<br \/>\n\tadditional box culverts as well as new water channel for disposal of<br \/>\n\twater at the site. The blockage of water channel for disposal from<br \/>\n\tBox culvert (30.mtr x 2.5mtr) at Km.476.872 (provided earlier in<br \/>\n\tyear 2005 in lieu of 3Nos x 0.90mtr. pipe drain) has been cleared by<br \/>\n\tproviding open channel in the 2010 and due to the same this year the<br \/>\n\tproblem of water logging has not arisen though since last more than<br \/>\n\tone week the area in question has received heavy rain fall.\n<\/p>\n<p id=\"p_27\">\t5.\tIt<br \/>\n\tis submitted that the averements made by the petitioner to the<br \/>\n\teffect that road level is likely to be raised to be extent of 4.5<br \/>\n\tfeet is also not correct. The sketch annexed along with the present<br \/>\n\tshows the road length from Chainage 476.617 to 476.880 Km. It is<br \/>\n\tsubmitted that in the said road length maximum 0.401 mtr. (1.31<br \/>\n\tfeet) height has been raised as part of the project. It is submitted<br \/>\n\tthat raising of the height of the road, in the instant case, is not<br \/>\n\tgoing to create the problem of water logging as apprehended by the<br \/>\n\tpetitioner. Annexed hereto and marked as Annexure III is the<br \/>\n\tcopy of Level Difference Statement indicating the difference in<br \/>\n\tlevel of the road before the project and the existing road height.\n<\/p>\n<p id=\"p_28\">\t6.\tIt<br \/>\n\tis submitted that in the year 2006, there was unprecedented heavy<br \/>\n\train and die to the same the villagers have faced certain problems,<br \/>\n\thowever, subsequently the authorities have made efforts to tackle<br \/>\n\tthe situation by providing additional box culvert and widening of<br \/>\n\tthe existing culverts at the site. The relevant date of rain from<br \/>\n\t2005 to 2011, clearly suggest that in 2006, there was flooding<br \/>\n\tsituation in the said area. Annexed hereto and marked as Annexure<br \/>\n\tIV is the relevant data of rain in the respective years.\n<\/p>\n<p id=\"p_29\">\t7.\tAt<br \/>\n\tthis stage, it would not be out of place to submit that the approach<br \/>\n\troad to Anandpura hemlet of Khalikpur vilalge is at Km. 476.890 and<br \/>\n\tthe minor bridge of 4 span of 5.8mtr. is located at Km. 476.617. The<br \/>\n\tdistance between two places is about 270 mtr.only.After taking into<br \/>\n\tconsideration the relevant aspects, additional Box culvert of 10.0<br \/>\n\tmtr. X 3.5 mtr. at Km. 476.702 for existing as well as additional<br \/>\n\ttwo lane road has been provided. Thus, the waterway between the<br \/>\n\taffected area is increased by nearly 5 times then the earlier<br \/>\n\twaterway in the road land width in the area of present petition, to<br \/>\n\tavoid any flooding due to widening or raising of road height.&#8221;\n<\/p>\n<p id=\"p_30\">\tTaking<br \/>\n\tinto consideration the necessary steps which have been taken by the<br \/>\n\trespondents to ensure that in future, there would not be any water<br \/>\n\tlogging problem in village, we would like to close this Public<br \/>\n\tInterest Litigation reserving liberty for the petitioner to approach<br \/>\n\tthis Court in the event if such a problem once again crops up in<br \/>\n\tfuture inspite of all remedial measures, which have been taken by<br \/>\n\tthe respondents to ensure that villagers may not have to face<br \/>\n\tproblems of water logging.
