Petitioner is aggrieved by the order<\/p>\n<p>                     bearing Memo No. 943 dated 15.12.2003, Annexure-<\/p>\n<p>                     16 whereunder his request to grant him seniority with<\/p>\n<p>                     effect from 13.2.1983 has been rejected observing<\/p>\n<p>                     that petitioner having been appointed as Constable<\/p>\n<p>                     under District Order No. 2046\/97 bearing Memo No.<\/p>\n<p>                     5173 dated 22.9.1997, Annexure-11 cannot claim<\/p>\n<p>                     seniority    with    effect   from    13.2.1983.    Such<br \/>\n<span class=\"hidden_text\" id=\"span_1\">                     2<\/span><\/p>\n<p>observation\/ finding is made in paragraph 3 of the<\/p>\n<p>impugned order dated 15.12.2003, Annexure-16.<\/p>\n<p id=\"p_2\">            3. It is submitted on behalf of the petitioner<\/p>\n<p>that petitioner appeared in the selection test for<\/p>\n<p>appointment on the post of Constable during the<\/p>\n<p>period between 5.1.1982- 10.1.1982 along with<\/p>\n<p>others and had become successful in the test but was<\/p>\n<p>not appointed, although others were appointed under<\/p>\n<p>appointment letter dated 13.2.1983. Raising the<\/p>\n<p>aforesaid     grievance,    petitioner   requested    the<\/p>\n<p>Respondents- authorities to consider his case for<\/p>\n<p>appointment as Constable but such request was<\/p>\n<p>rejected under letter dated 6.11.1995. Challenging the<\/p>\n<p>aforesaid letter dated 6.11.1995, petitioner filed<\/p>\n<p>C.W.J.C. No. 4586 of 1996, which was disposed of<\/p>\n<p>under orders dated 21.5.1997, Annexure-9 setting<\/p>\n<p>aside the order contained in letter dated 6.11.1995<\/p>\n<p>directing the Superintendent of Police, Madhubani to<\/p>\n<p>provide the petitioner with the appointment letter<\/p>\n<p>within a period of one month from the date of receipt\/<\/p>\n<p>production of a copy of the order dated 21.5.1997,<\/p>\n<p>Annexure-9. In compliance of the order of the High<br \/>\n<span class=\"hidden_text\" id=\"span_1\">                   3<\/span><\/p>\n<p>Court, appointment order vide District Order No.<\/p>\n<p>2046\/97 bearing Memo No. 5173 dated 22.9.1997,<\/p>\n<p>Annexure-11 was issued. It is submitted on behalf of<\/p>\n<p>the petitioner, with reference to the appointment<\/p>\n<p>order dated 22.9.1997, Annexure-11 that for the<\/p>\n<p>administrative delay caused in giving the petitioner<\/p>\n<p>appointment in the light of the result of the selection<\/p>\n<p>test held between 5.1.1982 &#8211; 10.1.1982, petitioner<\/p>\n<p>cannot be deprived of the seniority for the aforesaid<\/p>\n<p>period, as those who appeared in the selection test<\/p>\n<p>between 5.1.1982 &#8211; 10.1.1982 have been given<\/p>\n<p>seniority with effect from 13.2.1983. Petitioner was<\/p>\n<p>also appointed under appointment order dated<\/p>\n<p>22.9.1997, Annexure-11       on the basis of his<\/p>\n<p>performance in the same selection test which was<\/p>\n<p>held between 5.1.1982 &#8211; 10.1.1982, as such, he<\/p>\n<p>should also be given same seniority which was given<\/p>\n<p>to others with effect from 13.2.1983.<\/p>\n<p id=\"p_3\">          4. I see substance in the submission of the<\/p>\n<p>counsel for the petitioner and, accordingly, set aside<\/p>\n<p>the impugned order dated 15.12.2003, Annexure-16<\/p>\n<p>which was served on the petitioner on 25.4.2004<br \/>\n<span class=\"hidden_text\" id=\"span_2\">                             4<\/span><\/p>\n<p>         during the pendency of M.J.C. No. 2696 of 2003,<\/p>\n<p>         which was disposed of on 28.3.2006 granting liberty<\/p>\n<p>         to the petitioner to challenge the aforesaid order,<\/p>\n<p>         whereafter the present writ petition was filed on<\/p>\n<p>         9.2.2007.\n<\/p>\n<p id=\"p_4\">                     5. In the result, the impugned order dated<\/p>\n<p>         15.12.2003, Annexure-16 is set aside and the writ<\/p>\n<p>         petition is allowed. Petitioner be granted seniority<\/p>\n<p>         with effect from 13.2.1983, the date from which his<\/p>\n<p>         other colleagues who appeared in the selection test<\/p>\n<p>         between 5.1.1982 &#8211; 10.1.1982 have been allowed.<\/p>\n<pre id=\"pre_1\">Arjun\/                                    ( V.
