The correctness of the judgment and award dated 5-12-2003
\npassed by the MACE’, Bangalore City, in MVC No.3999\/ is<\/p>\n
called in question by the injured claimant in this appeal. “.2  ”<\/p>\n
2. The facts that are no longer in dispute  V’<\/p>\n
2001 at about 12-30 p.m the claimant sustained road 22<\/p>\n
traffic accident involving KSRTC bus   in<\/p>\n
respect of the said injuries, he filed-..the Aclaini seeking’-2<\/p>\n
compensation under various,headsp.d….The same Was..Acon\u00a7tested by
\nthe respondent. On the basis-of_tlie.  on record, the<\/p>\n
Tribunal assessed comvpens-ation:”: of  ~ and after<\/p>\n
deducting  awarded a sum of
\nRs.41,600\/-   annum from the date of claim
\npetition til].realisa’tion.’ ..l3eingla.ggrieved by the same the claimant
\nhals”preferred.”this appeal} “”” ” if<\/p>\n
    the learned counsel for the appellant and<\/p>\n

 4,_ lflfhe following points would arise for our consideration in<\/p>\n
2 h 2′ appeal: –\n<\/p>\n

i) Whether the Tribunal was justified in deducting 50%
\nof the compensation towards contributory negligence<\/p>\n
of the claimant?\n<\/p>\n
ii) Whether the appellant is entitled   <\/p>\n
compensation?\n<\/p>\n
5. From the material on record it.Vist.selenl’that<\/p>\n
claimant was getting down from  he.__sustain\u00e9.\u00a71″‘injnries,l”<\/p>\n
which aspect of the matter is  the… rcisponcient
\nCorporation. However, the    Driver of the bus
\ndid not have knowledge of the was a passenger
\nand in the abS\u20acIjiCE’.\u00a7LQl”  to stop the bus.
\nsince he didvynot  would be getting down.
\nBe that as   that the accident occurred on
\naccount of user   l V<\/p>\n
 6.  into’ consideration the fact that the claimant was<\/p>\n
alightirig.,eA.the.”bus, we are of the View that the driver and<\/p>\n
 conductor._VyofvV’th’ev\u00bb.hus”Vhave to be cautious in letting him to get<\/p>\n
  fro1h*the:hus: particularly when the Conductor is responsible<\/p>\n
 the safety and security of the passengers. Further,<\/p>\n
  “not pleading nor evidence on the part of the respondent<\/p>\n
 vlcorporation to justify the fact that there was cpntributory<\/p>\n

negligence on the part of the claimant. Therefore, we are of the<\/p>\n
View that the Tribunal was not justified in apponioning\ufb01”‘50%<\/p>\n
towards the contributory negligence on the part <\/p>\n
claimant. Hence, Point (1) is answered in favour of  ” <\/p>\n
7. As far as enhancement of compensation;is-:conc.erned, it<\/p>\n
is seen from the records that the appellant <\/p>\n

\nwhole body disability:'at:'1i15%;-::Hoyvev'er3…vi;hi1e calculating the loss
\nof earning capacity,  taken the monthly income at
\nRs.1800\/– only; which  side. Considering the fact
\nthatthe accjidverit  \u00ab$3001, a sum of Rs.3,000\/ — per month<\/p>\n
shall be the nlotio–niai.yincome of the claimant. In respect of 25%<\/p>\n
 disabilityljlbyl  multiplier 8, the future loss of earning<\/p>\n
Vviyclalpacity is as:se'ss';ed at Rs.72,000\/– instead of Rs.-43,200\/–<\/p>\n
 by th'e:'l'ribunal. Similarly, the compensation on other<\/p>\n
,4<\/p>\n
 \u00ab.hea_'c1s arealso enhanced as under:– <\/p>\n
Pain and Suffering Rs.25,000
\nLoss of amenities 30,000<\/p>\n
Medical expenses 8:\n<\/p>\n
Incidental charges 15,000  ‘<\/p>\n
Loss of income during treatment  ‘ <\/p>\n
Loss of future earning capacity   -1’ _
\nTotal:  1,:-57’*,000~.\n<\/p>\n
The enhanced compensation shall carrggr interest at 06% .anjnurn’= 0<\/p>\n
from the date of petition till realisation_.u’f.__\n<\/p>\n
8. The respondent Corporationf.sshaIl;de\u00abposit the enhanced
\ncompensation with interest   of flourlweekts from the<\/p>\n
date of receipt of_ _o1’~.t4hisi  the same shall be<\/p>\n
released to  i’n~terms of the Award of the
\nTribunal.\n<\/p>\n
9. For theaafovresaiid’relasons, the appeal is partly allowed in<\/p>\n
