THANKAPPAN,  J.\n\n                               --------------------------------------\n\n                           Crl.A.NO.1553 OF 2005\n\n                             ---------------------------\n\n                 Dated this the  6th  day of March,  2007.\n\n\n                                  JUDGMENT\n<\/pre>\n<p id=\"p_1\">      The appellant faced trial for the offence punishable under<\/p>\n<p>Section 8(1) read with 8(2)  of the Abkari Act.  The prosecution<\/p>\n<p>allegation   against   the   appellant   is   that   he     was   found     in<\/p>\n<p>possession of 20 packets of  arrack  each  contained  150 ml on<\/p>\n<p>31.3.1999   at   a   place     called     Mithrapuram   near   Udayagiri<\/p>\n<p>temple in  Meloodu Kara without having any licence  or permit<\/p>\n<p>under the provisions of the Abkari Act and Rules.       To prove<\/p>\n<p>the   case   against   the     appellant,     the   prosecution   examined<\/p>\n<p>Pws   1  to  5    and  produced   Exts.P1  to  P7.      The  prosecution<\/p>\n<p>also   produced   MO1   series.       After   the   closing   of   the<\/p>\n<p>prosecution   evidence,   the   appellant   was     questioned   under<\/p>\n<p><a href=\"\/doc\/767287\/\" id=\"a_1\">Section 313<\/a> of the Code of Criminal Procedure.    Denying the<\/p>\n<p>allegations levelled,     the appellant   had stated that   the case<\/p>\n<p>was foisted against him.  The appellant was arrested  from his<\/p>\n<p>house   on   30.3.1999.         To   prove   the     above   case   of   the<\/p>\n<p>appellant,   he had examined one witness as   DW1.     However,<\/p>\n<p>on considering  the evidence  adduced  by the prosecution, the<\/p>\n<p><span class=\"hidden_text\" id=\"span_1\">CRL.A.NO.1553\/205                         2<\/span><\/p>\n<p>  trial court found that the   appellant guilty under <a href=\"\/doc\/1308622\/\" id=\"a_1\">Section 8(1)<\/a><\/p>\n<p>  read with Section 8(2)  of the Abkari Act and  he was convicted<\/p>\n<p>  thereunder     and   sentenced   to   undergo   R.I   for       three   years<\/p>\n<p>  and   to   pay   a   fine   of   Rupees     One   lakh   and   in     default   of<\/p>\n<p>  payment   of   fine,   a   further   period   of     two   years     simple<\/p>\n<p>  imprisonment    was also ordered.   Against that conviction and<\/p>\n<p>  sentence, this appeal is filed.\n<\/p>\n<p id=\"p_1\">\n<p id=\"p_2\">  2.     This   Court   heard   the   learned   counsel   appearing   for   the<\/p>\n<p>  appellant   and   the     learned   Public   Prosecutor.         The   learned<\/p>\n<p>  counsel   appearing   for   the     appellant   submits   that     the   trial<\/p>\n<p>  court   went   wrong   in   placing   reliance   on   the   prosecution<\/p>\n<p>  evidence     to   find   the     appellant     guilty     of   the   charge.       The<\/p>\n<p>  counsel   also       submits     that     the     trial   court     ought   to   have<\/p>\n<p>  considered   the   case   of   the   appellant   on     the   basis   of   the<\/p>\n<p>  suggestions made to the witnesses.   Pws 1, 2, 4 and 5 are  the<\/p>\n<p>  Excise   Officials.     PW3   is   an   independent     witness,   who     was<\/p>\n<p>  examined   to   prove   that     the     appellant     was   arrested   at   the<\/p>\n<p>  place  and  date  as alleged by the prosecution.   However,  he<\/p>\n<p>  turned   hostile   to   the   prosecution.       Hence,   the   trial   court<\/p>\n<p>  considered the evidence of Pws 1, 2 and 4 out of whom  PW1 is<\/p>\n<p><span class=\"hidden_text\" id=\"span_1\">CRL.A.NO.1553\/205                         3<\/span><\/p>\n<p>  the  Preventive Officer, who detected the crime.  He had given<\/p>\n<p>  evidence   before   the     court   that     on   31.3.1999   while   himself<\/p>\n<p>  and  his companions, Excise Officials,  were on patrol duty and<\/p>\n<p>  when they reached near the   house of one Narayanan Nair at<\/p>\n<p>  Mythrapuram,   near   Udayagiri   Temple   road,   they   have   seen<\/p>\n<p>  that the appellant is   walking towards them   holding a plastic<\/p>\n<p>  cover     in   his   hand.       This   witness   has   further   stated   that   on<\/p>\n<p>  seeing the Excise Officials, the appellant tried to escape from<\/p>\n<p>  the scene.  He was waylaid   and  on questioning it is revealed<\/p>\n<p>  that the plastic     cover   contained   20 packets of   arrack each<\/p>\n<p>  contained   150   ml.       On   preparing   Ext.P1     mahazar,   the   said<\/p>\n<p>  plastic     cover     was    recovered   and     one   of   the   packets     was<\/p>\n<p>  taken.     It is revealed that the   packet   contained   arrack and<\/p>\n<p>  thereafter  PW1 had  taken sample   from the packet which  he<\/p>\n<p>  had   taken   from   the   plastic   cover.       Further   this   witness   has<\/p>\n<p>  stated   that     he   had   also   prepared     Ext.P2   arrest   memo   and<\/p>\n<p>  giving  information to the wife of the appellant,  appellant was<\/p>\n<p>  arrested   at the spot.     This witness has also    stated that   the<\/p>\n<p>  contraband   article   and   the     sample   seized     under   Ext.P1<\/p>\n<p>  mahazar     were   produced   before   the     court   on   the   same   day.<\/p>\n<p>  This witness has further stated that   investigation of the case<\/p>\n<p><span class=\"hidden_text\" id=\"span_2\">CRL.A.NO.1553\/205                         4<\/span><\/p>\n<p>  was   continued   by   Pws   4   and     5     and   finally   on   the   basis   of<\/p>\n<p>  Ext.P7      chemical report, a charge   was laid before  the court<\/p>\n<p>  against the appellant.        PW2  is   another   Preventive  Officer,<\/p>\n<p>  who accompanied   PW1  at the time of  detection of the crime<\/p>\n<p>  and this witness  had given evidence in  full  support of  PW1.<\/p>\n<p>  He  had   also   stated that the    appellant was arrested    and  the<\/p>\n<p>  contraband article was seized from the appellant and   sample<\/p>\n<p>  was  taken.    He     justified   the   action  followed  by  PW1.      This<\/p>\n<p>  witness   has   further   stated   that     presence   of   PW3,   an<\/p>\n<p>  independent  witness,     was  also   there   at  the   spot    when   PW1<\/p>\n<p>  detected   the crime.     Evidence of   Pws 4 and 5   is that they<\/p>\n<p>  had   continued   the investigation of the case and on the basis<\/p>\n<p>  of     Ext.P7     chemical     report   it     is   found   that   the   sample<\/p>\n<p>  contained    arrack  and   finally    charge  has been     laid     before<\/p>\n<p>  the  court.\n<\/p>\n<p id=\"p_3\">\n<p id=\"p_4\">  3.       The   trial   court   had     found   that   the   prosecution<\/p>\n<p>  succeeded   in   proving   that   the   appellant   was   arrested   at   the<\/p>\n<p>  place   and     time   as   alleged     by   the   prosecution   and     MO1<\/p>\n<p>  plastic   cover     was     seized     from   the   appellant   and   the   same<\/p>\n<p>  was also taken for analysis.    On the  above evidence, the trial<\/p>\n<p>  court found   the appellant guilty under <a href=\"\/doc\/1308622\/\" id=\"a_2\">Section 8(1)<\/a> read with<\/p>\n<p><span class=\"hidden_text\" id=\"span_3\">CRL.A.NO.1553\/205                       5<\/span><\/p>\n<p>  8(2) of the Abkari Act.\n<\/p>\n<p id=\"p_5\">\n<p id=\"p_6\">  4.    After   considering the   entire   prosecution evidence and<\/p>\n<p>  the   contention   of   the   learned     counsel   appearing   for   the<\/p>\n<p>  appellant, this Court is of the view that the   findings entered<\/p>\n<p>  by the trial court are on evidence and  require no interference.<\/p>\n<p>  With   regard   to  the   sentence,     the   learned   counsel  contended<\/p>\n<p>  that     some   leniency     may   be   shown   to   the   appellant.<\/p>\n<p>  Considering  the entire  facts   proved by the prosecution,   this<\/p>\n<p>  Court     is   not   inclined   to   interfere   with     the     substantive<\/p>\n<p>  sentence   already   awarded by the trial court.     However, the<\/p>\n<p>  sentence imposed  on  default of  payment of  the fine shall be<\/p>\n<p>  reduced to six months  instead of  two years.\n<\/p>\n<p id=\"p_7\">\n<p id=\"p_8\">              With   the     above   modification   of   the   sentence,   in   all<\/p>\n<p>  other respects  the appeal stands dismissed.<\/p>\n<p id=\"p_9\">                                                 K.
